THE MINNEHAHA COUNTY BUILDING COMMITTEE CONVENED AT 7:45 A.M. March 23, 2021, pursuant to adjournment on March 2, 2021. Committee Members present were: Barth, Bender, Beninga, Heiberger, Karsky, Kriens, Kyte (via Zoom Videoconference), and Muller.
MOTION by Bender, seconded by Barth, to approve the March 2, 2021, Building Committee Meeting Minutes. 8 ayes.
OFFICE STANDARDS
Craig Dewey, Assistant Commission Administrative Officer, presented proposed office standards for discussion. Committee Members discussed standards for new or remodeled spaces versus existing spaces. The use of personal items such as coffee pots, mini fridges, and space heaters was also discussed. Sheriff Mike Milstead commented on the need to consider flexibility in shared buildings such as the Law Enforcement Center. Auditor Ben Kyte suggested that the office standards should designate the person or department responsible for enforcement of the standards. Julie Hofer, Public Advocate, commented on feedback from her staff including the use of personal items. Ms. Hofer also expressed interest in the standardization of space heaters. Dan Haggar, State’s Attorney, commented on feedback received from his staff, the need to ensure that employees feel valued, and the concern that future elected officials may not appreciate certain standards. Mr. Haggar further advised that a resolution should be utilized to adopt office standards.
BUILDING PROJECTS
Craig Dewey, Assistant Commission Administrative Officer, presented on the Highway Facility Project, the Administration Building and Extension Building Projects, and the Gravel Pit Sale. The following updates were provided regarding the Highway Facility Project: design documents have been reviewed and will be turned over to the Construction Manager At-Risk, the location of structural columns was reviewed as part of the floorplan, and Building 7 will be relocated for future use. Additionally, ways to prevent drainage issues are being considered. The following updates were provided regarding the Extension Building Remodel: the floorplan has been revised to meet budgetary needs, the roof needs to be replaced, and the basement contains concrete walls with most being load bearing walls. Mark Kriens, Facilities Director, spoke on a roof inspection that was conducted and explained that a second opinion will be sought before deciding the best course of action. The Administration Building Remodel will move the Commission Office to the third floor, the State’s Attorney’s Office will occupy the second floor, and an area on the third floor will be available to conduct certain election activities. The County Gravel Pit was sold by auction in February. The closing date for the sale is scheduled for March 30, 2021.

THE MINNEHAHA COUNTY COMMISSION CONVENED IN A JOINT SESSION WITH THE SIOUX FALLS CITY COUNCIL AT 5:00 P.M., March 23, 2021, pursuant to adjournment on March 23, 2021. Commissioners present were: Barth, Bender, Beninga, and Karsky. Commissioner Heiberger was absent. Also present was Olivia Larson, Commission Recorder.
City Council Members present: Erickson, Jensen, Neitzert, Selberg, Soehl, and Starr. City Council Members Brekke and Kiley were present via teleconference. Mayor Paul TenHaken was absent.
Chair Karsky called the meeting to order.
MOTION by Barth, seconded by Beninga, to approve the agenda. 4 ayes. The City concurred.
CONDITIONAL USE PERMIT
Kevin Hoekman, Planner II, was present for the public hearing and spoke on Conditional Use Permit (CUP) #21-17, filed by Aeroprops, LLC to allow the expansion of a private airport on the property legally described as Tract 2A Resurrection Addition, N1/2 and N1/2 (Ex. Tracts 8 & 9, Costello Addition & Ex. Resurrection Addition) and SW1/4 and SE1/4 (Ex. Hein Addition & Ex. Klein’s Tracts 1 & 2) and Klein’s Tract No. 1, SE1/4; all in Section 32-T101N-R50W. Mr. Hoekman explained that the applicant has requested a deferral of the decision due to pending air traffic studies in the area. Chair Karsky inquired if anyone in attendance wanted to give testimony on the item or if those in attendance were comfortable withholding their testimony until the new hearing date. Greg Jamison, Jamison Real Estate Company, 6300 S Grand Prairie Drive, Sioux Falls, spoke as a proponent of the CUP and suggested waiting until the new hearing date to give his entire presentation. Dan Letellier, Sioux Falls Regional Airport Authority Executive Director, came forward as an opponent expressing that the deferral would be preferred to allow time for completion of the Air Space Study by the Federal Aviation Administration. MOTION by Barth, seconded by Bender, to defer action on Conditional Use Permit #21-17 until the May 25, 2021, Minnehaha County and Sioux Falls City Council Joint Meeting. 4 ayes. The City concurred.

MOTION by Heiberger, seconded by Barth, to amend the motion made authorizing the Auditor to publish a Notice of Request for Proposals for Comprehensive Institutional Food Service and Technology Services for the Minnehaha County Jail to include that the Commission has determined that the use of competitive sealed bids is not practical or advantageous to the County in acquiring a vendor for food service, commissary service, and the associated technological services for the Minnehaha County Jail and to utilize a competitive sealed proposals process. 5 ayes.

APPOINTMENT OF COUNTY DESIGNEE REQUESTING FIRE SUPPRESSION
RESOURCES FROM THE SOUTH DAKOTA WILDLAND FIRE DIVISION
WHEREAS, the State Wildland Fire Coordinator, at the request of the Minnehaha County appointed designee, shall assist in the suppression of any range fire within the county to provide up to six state personnel and two state vehicles for mutual aid at no cost to the county; and
WHEREAS, additional resources may be required beyond the assistance provided at no cost, the county designee shall reimburse the State Wildland Fire Coordinator for reasonable expenses incurred;
NOW, THEREFORE BE IT RESOLVED, by the Minnehaha County Board of Commissioners, that the Minnehaha County Emergency Manager is appointed as designee for Minnehaha County, and is authorized to request fire suppression assistance from the South Dakota Department of Agriculture Wild Fire Division and to obligate county funds for reimbursement of additional resources in accordance with SDCL 41-20A-11.

PRESENTATIONS
Jessica Wells, LifeScape Foundation President, gave a presentation on LifeScape and highlighted the following: the history of Lifescape, the individuals they serve, and their programs and services.
Tim Even, Humboldt Fire and Ambulance Service, gave a presentation on the Humboldt Fire and Ambulance Service and highlighted the following: fundraising, grant funding, staffing and certifications, call types and call volume, equipment needs, volunteers, mutual aid and training, and the impacts of COVID-19.
Traci Smith, Public Defender, and Betsy Doyle, Chief Deputy Public Defender, presented on the Public Defender’s Office highlighting the following areas: the history of the office, alternative court, alternative sentencing, recruitment, homicides and crimes of violence, training, the misdemeanor unit, the impacts of COVID-19, and future goals.
Commissioner Karsky handed the gavel to Commissioner Heiberger and left the meeting.
Julie Hofer, Public Advocate, presented on the Public Advocate’s Office and highlighted the following areas: 2020 expenditures, the number of closed and opened cases in 2020, partnerships, and the overall caseload.
Commissioner Karsky returned to the meeting at 9:49 a.m. and received the gavel back from Commissioner Heiberger.
PURCHASE
Joe Bosman, Deputy Sheriff Captain, requested authorization to purchase five (5) 2020 Ford Utility Interceptors off of the 2021 City of Sioux Falls Bid, Contract #21-0023, from Sioux Falls Ford, Sioux Falls, SD at a total cost of $170,235. The purchase of the vehicles was part of the approved FY2021 budget. MOTION by Barth, seconded by Beninga, to authorize the purchase of five (5) 2020 Ford Utility Interceptors off of the 2021 City of Sioux Falls Bid, Contract #21-0023, from Sioux Falls Ford, 4901 W. 26th Street, Sioux Falls, SD at a total cost $170,235. RESOLUTION
Craig Dewey, Assistant Commission Administrative Officer, presented a resolution to rescind Resolution MC20-78 conveying County-owned property subject to a covenant in the warranty deed. The State’s Attorney’s Office recommended removing covenant language from the warranty deed that was specific to the law enforcement shooting range. Eric Bogue, Chief Civil Deputy State’s Attorney, clarified the effects of the resolution on the purchase agreement and spoke on statutory protections specific to shooting ranges. MOTION by Bender, seconded by Barth, to approve Resolution MC21-17, a resolution to remove covenant language from the Gravel Pit Warranty Deed and rescinding Resolution MC20-78. WHEREAS, on December 8, 2020, the Minnehaha County Board of Commissioners required by and through Resolution MC 20-78 that a restrictive covenant, pertaining to the County’s adjacent sport shooting range, be inserted into the Warranty Deed for the sale of the County Gravel Pit, parcel No. 93053, also described as follows:
Tract 1 Sierra Addition in the SE1/4SE1/4 of Section 6, Township 101 North, Range 50 West of the 5th P.M., Minnehaha County, South Dakota, according to the recorded Plat thereof
WHEREAS, the Board of Commissioners having been advised that the provisions of SDCL §§21-10-28 to 21-10-34 provide sufficient protection to the County’s sport shooting range, as defined by SDCL 21-10-33, located on the following described real property: N1/2SE1/4, including the former RR ROW located in the NW1/4SE1/4, of Section 6, Township 101 North, Range 50 West of the 5th P.M., Minnehaha County, South Dakota, and that such sport shooting range is adjacent to the Property described above.
WHEREAS, the Board of Commissioners also acknowledge that the Purchase Agreement between the County and the Buyer of the County’s Gravel Pit included Buyer’s acknowledgement that such sport shooting range commenced operation on or about July 1, 1975, prior to Buyer’s purchase of the Property pursuant to this Agreement, and Seller’s continued operation of such sport shooting range is protected pursuant to SDCL §§21-10-28 to 21-10-34.
NOW, THEREFORE, BE IT RESOLVED by the Minnehaha County Board of Commissioners, upon recommendation of the Minnehaha County State’s Attorney’s Office, that Resolution MC 20-78 is hereby repealed effective immediately.

AGREEMENTS
Upon the request of Carol Muller, MOTION by Bender, seconded by Barth, to defer Item #18, an item authorizing the Chair to sign an agreement with USD School of Medicine, Family Medicine for community engagement services, to April 6, 2021. 5 ayes.
Carol Muller, Commission Administrative Officer, presented the following two Memorandums of Agreement (MOA).
The first MOA was between Minnehaha County and South Dakota Urban Indian Health, Inc. (SDUIH) for the provision of health care services specific to mental health and substance use that are culturally relevant for individuals involved with the justice system. The County will pay SDUIH a total of $179,000.00 to provide services within the specified budget, to oversee all programs and treatment plans, to provide progress and finance reports monthly, and to manage the storage of data obtained through the services. MOTION by Heiberger, seconded by Barth, to authorize the Chair to sign the Memorandum of Agreement between Minnehaha County and South Dakota Urban Indian Health, Inc. for culturally relevant health care services at a total cost of $179,000.00 beginning on March 26, 2021, and ending on March 25, 2023. 5 ayes.
The second MOA was between Minnehaha County and Think 3D to establish a Leaders of Tomorrow program. The program is to be designed specifically for justice involved individuals. The County will pay Think 3D $179,541.00 to create the program, to ensure a secure training facility, to provide a twelve-week training program, to provide weekly updates, to provide a six-month mentorship continuation, to provide support for virtual training equipment, and to participate in grant related evaluation activities. MOTION by Bender, seconded by Barth, to authorize the Chair to sign the Memorandum of Agreement between Minnehaha County and Think 3D for the establishment of a Leaders of Tomorrow program for justice involved individuals at a cost of $179,541.00 beginning on March 26, 2021, and ending on March 25, 2023. 5 ayes.
DISCUSSION
Carol Muller, Commission Administrative Officer, brought up for discussion, the future Commission Meeting dates. The Commission determined that the second and fifth Tuesdays of the month will remain as non-Commission Meeting days through the end of 2021.
LIAISON REPORTS
Commissioner Bender reported on touring the new chillers with Mark Kriens, Facilities Director, on March 22, 2021.
Commissioner Heiberger reported on attending the South Dakota Association of County Commissioners Convention where Commissioners and other elected officials met. The convention was well attended and had excellent speakers. Commissioner Karsky also attended the convention.
Commissioner Barth reported on the March 22, 2021, Planning Commission Meeting. The Board of Adjustment denied a request for a setback reduction west of the Dell Rapids interchange. An expansion for the Boadwine Farms Dairy was approved, as well as a gravel pit for Soukup. An equestrian development may be coming to the Commission due to the applicant’s request to subdivide their property.
OLD BUSINESS
Commissioner Heiberger noted that Resolution MC20-16, authorizing the Commission Chair to make emergency policy decisions regarding COVID-19 related issues, will be coming before the Commission to rescinded at a future meeting.

Comprehensive Institutional Food Service and Technology Services
for the Minnehaha County Jail
Proposals will be received by the Board of Commissioners of Minnehaha County at the office of the County Auditor, 415 N. Dakota Avenue, Sioux Falls, South Dakota 57104 until, 3:00 p.m. on Friday, May 21st, 2021, from organizations/firms interested in providing for Comprehensive Institutional Food Service and Technology Services for the Minnehaha County Jail, Sioux Falls, South Dakota. Proposals will be evaluated by a committee and a contract recommendation will be made to the Minnehaha County Commission at a regular meeting of the Commission.
All proposals shall be made in accordance with forms and specifications detailed in the Request for Proposals. The Request for Proposal specifications have been placed on file and may be reviewed at the Office of the Minnehaha County Auditor, Minnehaha County Administration Building, 415 N. Dakota Avenue, Sioux Falls, South Dakota, 57104 AND on Minnehahacounty.org.
