MANUAL UPDATE
Carey Deaver, Director of Human Resources, presented updates to the Minnehaha County Drug and Alcohol Testing Procedure Manual and the Minnehaha County Employee Handbook. Along with minor language changes, revisions were made to reflect the current Department of Transportation random selection rates for drug and alcohol testing. Within the Minnehaha County Employee Handbook, Section 12.7 Drug Testing was updated. In the Minnehaha County Drug and Alcohol Testing Procedure Manual, the primary changes were made to Section 9.4 and Appendix A. MOTION by Beninga, seconded by Bender, to approve the updates to the Minnehaha County Drug and Alcohol Testing Procedure Manual and the Minnehaha County Employee Handbook regarding Department of Transportation random selection rates.  5 ayes.
BRIEFING
Carey Deaver, Director of Human Resources, gave a briefing on Minnehaha County’s supplemental retirement plans highlighting the differences between the ICMA-RC supplemental retirement plan and the South Dakota Retirement System supplemental retirement plan referred to as SDRS-SRP. The current supplemental retirement plan utilized by County employees is the ICMA-RC supplemental plan. The County is considering switching from ICMA-RC to SDRS-SRP.

Sheriff Mike Milstead, via Zoom teleconference, presented an agreement between Minnehaha County and the South Dakota Department of Social Services (DSS) for the Restoration to Competency Program services. The agreement would establish a jail-based Restoration to Competency Program. The program would decrease the amount of time it takes for a defendant to begin the restoration process and would allow for more beds to be available at the Human Services Center for defendants that would benefit from a therapeutic environment. Sheriff Milstead provided an explanation on restoration to competency programs noting the program ensures a defendant is competent enough to stand trial. More specifically, the defendant is educated to understand the justice system, the authority of the courts, the authority of the judge, the authority of the jury, what they are dealing with, and what they are facing. Eric Bogue, Chief Civil Deputy State’s Attorney, expressed Sheriff Milstead’s explanation was a good summarization of the program. MOTION by Heiberger, seconded by Barth, to authorize the Chair to sign the agreement between Minnehaha County and the South Dakota Department of Social Services for Restoration to Competency Program Services in the Minnehaha County Jail.  5 ayes.
GRANTS
Jason Gearman, Emergency Management Director, requested approval to apply for the 2021 Homeland Security Grant. The grant program provides funding for the purposes of enhancing the ability of local, state, and federal agencies to prevent, respond, and recover from major events such as disasters, terrorist attacks, and other emergencies. The 2021 application includes purchases for the Sheriff’s Office, Emergency Management, the Minnehaha County Courthouse, and the Sioux Falls Police Department. For the Sheriff’s Office and Emergency Management, the grant application would request funding for the purchase of P25 compliant digital radios and two (2) digital message boards. Funding for security upgrades to the Courthouse’s door access systems and duress alarms would be requested. For the Sioux Falls Police Department, funding would be requested for an explosive ordinance disposal trailer. MOTION by Barth, seconded by Beninga, to authorize the Minnehaha County Emergency Management Director to apply for the 2021 Homeland Security Grant with the South Dakota Office of Homeland Security. By roll call vote: 5 ayes.
Joe Bosman, Deputy Sheriff Captain, requested authorization to submit a grant application for the Fiscal Year 2020 State Criminal Alien Assistance Program (SCAAP). The funds are designated by the Federal Government to be used for reimbursement of costs for detaining individuals whom are believed to be criminal aliens, based on investigative and other information, for which no formal DHS documentation of alien status is available.  MOTION by Heiberger, seconded by Barth, to authorize the Sheriff’s Office to submit the Fiscal Year 2020 State Criminal Alien Assistance Program grant application. By roll call vote: 5 ayes.
AGREEMENT
Joe Bosman, Deputy Sheriff Captain, presented an annual agreement to participate in the Department of Justice Asset Forfeiture Program. The program allows participants to receive a share of federally forfeited proceeds that may be used for law enforcement purposes. The forfeited cash and property are from cases involving illegal activities, such as white-collar crimes, that would provide financial gain to the criminals. MOTION by Beninga, seconded by Bender, to authorize the Chair to sign the Federal Equitable Sharing Agreement and Certification.  5 ayes.
BRIEFINGS
DJ Buthe, Highway Superintendent, via Zoom teleconference, presented on the Minnehaha County Highway Department by highlighting the emerging needs, issues, and future budget requests for building needs, equipment, and large capital projects.
Chris Lilla, Director of Equalization, provided a year-end progress report and assessment notice timeline. The following topics were highlighted: final software conversion from the AS400 to Proval, Sioux Falls residential land equalization, the redefining of neighborhood boundaries in Sioux Falls and small towns, defining house types by age throughout the County, and County wide market increases from 2020 to 2021. Mr. Lilla further explained the appeals process and the Equalization Boards timelines.

WHEREAS, Minnehaha County holds, under Tax Deed proceedings, Tax Deed #2610 for RDID #47471, affecting the following described real property: 
Lot Seven (7), Block Three (3), of Southmoor Addition to the City of Sioux Falls, Minnehaha County, South Dakota, according to the recorded plat thereof.
 WHEREAS, Keith Netten, 205 West 41st Street, Sioux Falls, South Dakota 57105, is the prior owner of record of the above described property; and 
WHEREAS, SDCL Ch. 10-25 provides for the restoration of title to said record owner upon payment of all taxes, interest, and cost represented in the Tax Deed along with any other taxes, interest or costs that are unpaid on the property; and 
WHEREAS, Keith Netten has deposited $10,453.72 with the Minnehaha County Treasurer the amounts due on Parcel RDID 47471; now, therefore, be it

RESOLUTION FOR THE ESTABLISHMENT OF AN ADMINISTRATIVE FEE 
FOR CERTAIN TITLE AND REGISTRATION SERVICES
WHEREAS South Dakota allows out-of-state and resident applicants to title motor vehicles entirely by mail; and
WHEREAS any application for a certificate of title, under SDCL Chpt. 32-3, processed entirely by mail requires additional staff time resulting in higher administrative expenses and allocation of staff time; and 
WHEREAS SDCL 32-3-18.1 allows counties to charge an administrative fee for processing an application for certificate of title received and processed entirely by mail; and 
WHERAS, any application for a certificate of title for a large boat, under SDCL Chpt. 32-3A, processed entirely by mail also requires additional staff time which results in higher administrative expenses and allocation of time; and 
WHEREAS SDCL 32-3A-21.1 allows counties to charge an administrative fee for processing an application for certificate of title received and processed entirely by mail; and 
NOW, THEREFORE BE IT RESOLVED, by the Board of County Commissioners of Minnehaha County, South Dakota, that as of April 1, 2021, the Minnehaha County Treasurer’s Office will charge an administrative fee of Twenty-Five Dollars ($25.00) for any application made to the Minnehaha County Treasurer, under SDCL Chpt. 32-3 or SDCL Chpt. 32-3A, for a certificate of title that is received and processed entirely by mail.

GRAVEL PIT SALE
Craig Dewey, Assistant Commission Administrative Officer, via Zoom teleconference, requested approval of a Resolution of Sale and the allocation of funds resulting from the proceeds of the sale. On February 8, 2021, the County Gravel Pit was sold by auction to Great Bear Sand & Gravel, LLC for the amount of $2,025,000.00. The Resolution of Sale approves the sale and authorizes the Chair to sign the corresponding Real Estate Auction Purchase Agreement. In response to a question posed by Commissioner Beninga, Carol Muller, Commission Administrative Officer, explained the original payment was listed for $1.00 on the deed when the County acquired the gravel pit. MOTION by Heiberger, seconded by Bender, to approve Resolution MC21-11, a resolution of sale, and to allocate the proceeds from the sale to the Building Fund. By roll call vote: 5 ayes.
RESOLUTION OF SALE

WHEREAS, after due notice and advertisement, the County Auditor offered for sale on February 8, 2021, at public auction, the following described surplus real property:
Tract 1 Sierra Addition in the SE1/4SE1/4 of Section 6, Township 101 North, Range 50 West of the 5th P.M., Minnehaha County, South Dakota, according to the recorded Plat thereof
WHEREAS, the County received a bid from Great Bear Sand & Gravel, LLC in the sum of Two Million Twenty-Five Thousand Dollars ($ 2,025,000.00), which sum was the highest and best bid for said property, payable as follows: 
1. Earnest money in an amount equal to ten percent (10%) of the Purchase Price, to wit: Two Hundred Two Thousand Five Hundred Dollars ($ 202,500.00) shall be due and payable to Closing Agent from Buyer, by either certified check or other valid payment by which Buyer’s funds will be immediately available, upon the signing of this Agreement on the date of sale and such earnest money shall be held in escrow until the date of Closing hereinafter set forth. Buyer acknowledges that the earnest money payment shall be deposited by Closing Agent no later than the next legal banking day following the signing of this Agreement.
2. A letter of credit from Buyer’s financial institution guaranteeing the availability of Buyer’s funds for the balance of the Purchase Price shall be delivered to Seller prior to executing of this Agreement and shall be attached to Agreement, or this Agreement, at the option of Seller, without notice to Buyer may be voided.
3. The remaining balance of the Purchase Price, without interest, to wit: One Million Eight Hundred Twenty-Two Thousand Five Hundred Dollars ($ 1,822,500.00) shall be due and payable to Closing Agent from Buyer, by certified check or other valid payment by which Buyer’s funds will be immediately available, on the date of the Closing hereinafter set forth.
WHEREAS, said bidder has tendered the nonrefundable down payment due and signed the attached Real Estate Purchase Agreement;
NOW, THEREFORE, BE IT RESOLVED by the Minnehaha County Commission that this sale be approved as set forth above, and the Commission Chairman is authorized to sign the Purchase Agreement and Warranty Deed therefor.

AGREEMENT
Craig Dewey, Assistant Commission Administrative Officer, via Zoom teleconference, presented an agreement between Minnehaha County and JLG Architects for the Administration and Extension Building remodeling design services. The agreement follows the expiration of two interim agreements. Negotiation was conducted by Tegra Group and the agreement received approval from outside legal counsel. The negotiated service fee will be 6.5% of the building cost. MOTION by Bender, seconded by Barth, to authorize the Chair to sign the agreement between Minnehaha County and JLG Architects for the Administration and Extension Building remodeling design services at a fee of 6.5% of the building cost.  5 ayes.
LEGISLATIVE UPDATE
Carol Muller, Commission Administrative Officer, reported on the 2021 Legislative Session bills that impact Minnehaha County.
LIAISON REPORTS
Commissioner Heiberger reported Human Services’ Spanish version of the financial assistance application is available to print from the Minnehaha County website.
Commissioner Heiberger reported on the transition from the Public Safety Building to the Carroll Institute for detox services.
Commissioner Heiberger reported on the Unified Judicial System Annual Report highlighting the expansion of people able to perform a competency evaluation, the availability of South Dakota Association of County Commissioners reimbursement funding to counties for their part in competency restorations, and the statewide mental health training.
Commissioner Beninga reported on a Zoom call that was also attended by Commissioner Karsky. The final bid specifications and documents are close to being finalized for the Highway Facility project.
Commissioner Beninga reported on the Sioux Empire Fair Board receiving two grants to help support ag related issues.
