REGULAR SESSION
FEBRUARY 9, 2021
CALL TO ORDER
The Commissioners of the City of Valley Springs met in regular session on Tuesday, February 9, 2021 at 6:00 PM in the VS American Legion. Due to COVID-19, audience members and commissioners were required to practice social distancing within the legion meeting room. Mayor Carl Moss presided. Answering roll call were Commissioners Brian Staeffler, Dean Helgeson, Lance Bauske and Lynn Schmidt. Also present was City Maintenance Blaine Eilts, Finance Officer Linda Hunnel, City Attorney Patrick Glover, Keeley Meier from the BV Journal, Superintendent Dr. Jarod Larson of the Brandon Valley School District and City Engineers Gabe Laber and Kyle Lentsch. Motion by Bauske to approve the agenda as posted. Helgeson seconded the motion. Motion carried, all voting aye.
APPROVAL OF MINUTES
Motion by Staeffler to approve the January 12, 2021 Minutes as presented.
Schmidt seconded the motion. Motion carried, all voting aye.
CLAIMS AND PAYROLL
Motion by Bauske to approve the February 9, 2021 Claims in the amount of $130,183.56 with the following addition: SRF Water\Sewer Construction Loan Pay Request of $37,000. Staeffler seconded the motion. Motion carried, all voting aye.
MONTHLY FINANCIAL REPORTS
The Commission reviewed the January Proof of Cash Report and the January YTD Budget Report, as submitted by the Finance Officer. Motion by Staeffler, second by Bauske, to approve the January 2021 Proof of Cash Report. Motion carried, all voting aye. Motion by Bauske, second by Staeffler, to approve the January YTD Budget Report. Motion carried, all voting aye.
PUBLIC COMMENT
Citizen Ardell Johnson handed out Valentine candy and wished the Commission and audience a Happy Valentine’s Day. She thanked the Commission for their dedication and hard work. We thank Ardell for her support and attendance at city meetings.
CITY ENGINEER REPORT
City Engineers Gabe Laber and Kyle Lentsch gave a report on the upcoming street and utility improvements. Laber reported that eight bids came in on the 2021 Water\Sewer Construction Project. Lowest bid was ASCO. Laber said although the high number of bidders gave us good prices on the project; inflation caused price overruns on materials. The next step will be scheduling phases of construction and holding a pre-construction meeting for residents involved or interested in the project.
Staeffler made a motion to award the Street and Utility Improvements Project to Asphalt Surfacing Company for a bid of $2,657,281.05. Schmidt seconded the motion. Motion carried, all voting aye.
During the utility construction project, the Ellis & Eastern rail line will need to be crossed three times. Therefore, permits need to be in place between the City of Valley Springs and the Ellis & Eastern Company. Schmidt made a motion to approve Ellis & Eastern Permits 224, 225 and 226. Helgeson seconded the motion. Motion carried, all voting aye.
NEW BUSINESS
Mayoral Proclamation ‘The Lynx Way Coffee Bean Day’
Dr. Jarod Larson, Brandon Valley Superintendent, spoke to the Commission and audience of the new message for positive change that the Brandon Valley School District has implemented. Helgeson made a motion to approve the Mayoral Proclamation declaring February 11, 2021 as ‘The Lynx Way Coffee Bean Day.’ Schmidt seconded the motion. Motion carried, all voting aye.
Garbage Haulers 2021 Renewal License
Motion by Bauske to approve the 2021 Garbage Haulers License Renewal of Waste Management. Second by Helgeson. Motion carried, all voting aye.
Motion by Staeffler to approve the 2021 Garbage Haulers License Renewal of Marv’s Sanitary Inc. Second by Bauske. Motion carried, all voting aye.
Motion by Bauske to approve the 2021 Garbage Haulers License Renewal of Bolte’s Sunrise. Second by Schmidt. Motion carried, all voting aye.
OLD BUSINESS
Developers Agreement-Homestead @ Valley View Addition-moved to 7:00 PM P&Z Hearings.
Citywide Clean-Up Day Discussion
The Commission scheduled Citywide Cleanup Day as May 8, 2021.
PUBLIC WORKS REPORT
City Maintenance Supervisor Blaine Eilts gave his monthly maintenance report. Items discussed included: dump truck\plow repairs, bucket truck repairs, plumbing projects at the well, water\sewer certifications, routine maintenance, etc. Eilts said there are some banners that are in bad shape and no longer usable. Mayor Moss suggested that Eilts talk to the Community Club about the banners.
The John Deere mower lease is up in April. The mower will have to be purchased for $14,293 or returned.
Eilts gave the commission information on a new John Deere 1570 Terrain Cut Mower and Deck and on a John Deere 3039R Compact Utility Tractor with a side discharge mower and pallet fork. Staeffler made a motion to move forward with the lease of the new mower and tractor: the mower for three years at $6618.48 per year out and the tractor for three years at $5100 per year. Schmidt seconded the motion. Motion carried, all voting aye. The current mower will be purchased and sold as surplus property, along with the 2007 John Deere tractor.
FINANCE OFFICER REPORT
February 4, 2021 P&Z Meeting
Hunnel, Zoning Administrator, gave a report on the February 4th P&Z Meeting. The Board approved the Final Plat and Rezoning of LOTS 13-20, BLOCK 1, and LOTS 18-21, BLOCK 3 and LOTS 1-3, BLOCK 4, Homestead @ Valley View Addition. Building Inspector Dave Swier was present and spoke of the need to adopt a building code every three years. The Board will review the 2021 IRC. The International Property Maintenance Code was also discussed. Blaine Eilts agreed to be an alternate member of the P&Z Board. Hunnel will schedule a meeting in March to discuss the International Residential Code.
2019 Municipal Annual Report-Approval
FO Hunnel has completed the 2019 Annual Report for the City of Valley Springs. The Commission reviewed the report. Motion by Helgeson to approve the 2019 Annual Report. Bauske seconded. Motion carried, all voting aye. The 2020 Annual Report has been started and should be complete by the March meeting.
March Equalization Hearings
The Commission set the date to hear Objections to Real Property Assessments as March 16, 2021 at 6 PM in City Hall, 401 Broadway. Hearings are by appointment only.
SD DOT TAP Grant
Valley Springs was not selected for the TAP Grant, which would have extended the Shared Use Path from Southside to Skyline. The Commission asked Hunnel to look into reapplying for the grant.
Hunnel reported that the deadline for nominating petitions for Commissioner-5 year term, to be filed for the April 13 election, is February 26th at 5 PM.

Final Plat Homestead Lots
Ron Kuipers, Homestead @Valley View Addition Developer presented a final plat for certain lots within his development. Motion by Staeffler to approve Res. 2021-01, the Final Plat of LOTS 13-20, BLOCK 1, and LOTS 18-21, BLOCK 3 and LOTS 1-3, Blk 4, Homestead @ Valley View Addition. Bauske seconded the motion. Motion carried, all voting aye.
7:00 PM Hearing Ordinance 351-Rezone Homestead Lots
Mayor Moss gave the First Reading of Ordinance 351:
Section 1. LOTS 13-20, BLOCK 1, and LOTS 18-21, BLOCK 3 and LOTS 1-3, BLOCK 4, Homestead @ Valley View Addition in the SE ¼ Section 4, Township 101 N, Range 47 W of the 5th P.M., City of Valley Springs, Minnehaha County, South Dakota is hereby rezoned from A-1 Agriculture District to R-1 Residential District.
The Second Reading of Ordinance 351 will be at the March 9. 2021 meeting.
CITY ATTORNEY REPORT –City Attorney Patrick Glover reported that the new marijuana law will be appealed as unconstitutional and will likely end up in the SD Supreme Court.
COMMISSIONER REPORTS – Commissioner Staeffler spoke of the need for a snowfall guideline for plowing and sanding when there is under two inches of snowfall.
EXECUTIVE SESSION
Bauske made a motion to enter into executive session at 7:18 PM In accordance with SDCL 1-25-2 (1) Personnel SDCL 1-25-2 Discussing the qualifications, competence, performance, character or fitness of any public officer or employee or prospective public officer or employee.
Schmidt seconded the motion. Motion by Bauske to come out of Executive Session at 7:26 PM. Second by Helgeson. The Commission will hold a wage review for City Maintenance Employee Blaine Eilts in 90 days.

There being no further business before the Commission, Bauske made a motion to adjourn at 7:26 PM. Helgeson seconded. Motion carried, all voting aye. The next regular meeting of the
Valley Springs City Commission will be March 9, 2021 at 6 PM in the Valley Springs American Legion, 615 Broadway Avenue.
