THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. January 26, 2021, pursuant to adjournment on January 19, 2021. Commissioners present were: Bender, Beninga, and Karsky. Commissioner Barth was present via Zoom Videoconference. Commissioner Heiberger was absent. Also present were Olivia Larson, Commission Recorder, and Eric Bogue, Chief Civil Deputy State’s Attorney.

LIEN COMPROMISE
Melinda Storley, Commission Assistant, gave a briefing on an application for a compromise of lien for DPNO 56817 in the amount of $19,368.42. The lien represents Poor Relief, Public Defender, and Court Appointed Attorney services provided to the applicant’s parents between July 2005 and February 2018. Payments totaling $342.00 and $3,121.00 were made by the lienees for the attorney services and Poor Relief services respectively. The applicant’s parents reside in a nursing home. The Department of Social Services recommended the applicant assist her parents in selling their home to ensure her mother would be able to qualify for Medicaid. The home is dilapidated with a remaining mortgage of $72,569.90. An offer of $85,000.00 has been received for the home with the contingency that the lien be settled. Proceeds in the amount of $7,000.00 is expected to result from the sale. The compromise request was to release the real property from the lien with no payment or upon payment of approximately $7,000.00. The applicant was present, spoke on the compromise request, and was available to answer questions from the Commission. Commissioners Bender, Beninga, and Barth expressed interest in removing the lien from the home with no payment. Commissioner Karsky spoke on protecting the interests of the County and spoke in favor of a compromise based on the sale proceeds. Eric Bogue, Chief Civil Deputy State’s Attorney, provided guidance on the ability of the Commission to compromise the lien specific to releasing the home. MOTION by Bender to release the house from the lien, leaving the lien in force against the lienees. In response to a question posed by Commissioner Beninga, Mr. Bogue explained the legal priority of payment after the sale based on the lien being against the home versus releasing the home from the lien. Mr. Bogue suggested compromising the lien down to the proceeds of the sale to ensure the County retains their priority of payment over the State after the sale. Commissioners Bender expressed concerns over jeopardizing the sale of the home if the compromise is based on sale proceeds. In response to a question from Commissioner Bender, Mr. Bogue explained the purchaser is unlikely to be negatively affected by a compromise specific to sale proceeds. Commissioner Bender’s motion died for lack of a second. In response to a question posed by Commissioner Beninga, Lori Montis, Human Services Assistant Director, stated she had not had discussions with the State regarding their expectations. MOTION by Barth to compromise the lien in full. Motion died for lack of a second. MOTION by Bender, seconded by Beninga, to approve Resolution MC21-06. By roll call vote: 3 ayes. Commissioner Karsky voted nay.
RESOLUTION MC21-06
WHEREAS, a County Aid Lien in the amount of $19,368.42, purports to exist in favor of Minnehaha County and against DPNO 56817 as Lienee, and
WHEREAS, said lienee’s daughter has filed an application with the County Auditor stating such facts as provided for by Law,
NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorize the Chair of the County Board and the County Auditor to execute the following:
Release from DPNO 56817, with no payment, the real property legally described as Lot 101 of County Auditor’s Subdivision of the Southeast Quarter (SE1/4) of Section 15, Township 101 North, Range 49 West of the 5th P.M., Minnehaha County, South Dakota, according to the recorded plat thereof; located at 300 S. Blaine Ave, Sioux Falls.
Leave DPNO 56817 only in the name of the Lienees in the full amount of $19,368.42.

BRIEFING
Jeff Gromer, Chief Deputy Sheriff, gave a briefing on an adjustment to the scope of work for jail medical services with Correctional Medical Management (CMM). Due to the delay in the Link project, CMM requires more staffing to safely manage the chronically inebriated population. The estimated cost associated with the temporary change is $203,262.00. The staffing needs will be re-evaluated once Link is operational. Additionally, CMM proposed necessary adjustments to current staffing and salaries to effectively recruit and retain staff providing comprehensive medical coverage for inmates. Due to these changes, the projected costs are expected to be above the 2021 budget for medical services.
Lori Montis, Human Services Assistant Director, gave a briefing on the One Sioux Falls Fund. Minnehaha County received a total of $688,000 in One Sioux Falls funds to dispense to those in need of assistance with rent, mortgage, and utilities. To date, a total of $516,279.83 of the total available funds have been dispensed. A handout was provided regarding the South Dakota Cares housing applications.
Dr. Jeff Luther, Rural Ambulance Quality Assurance Director, gave a briefing on the 2020 Third Quarter Minnehaha County Emergency Medical Service Summary including COVID-19 impacts and vaccinations.
LEGISLATIVE UPDATE
Craig Dewey, Assistant Commission Administrative Officer, gave reported on the 2021 Legislative Session bills that impact Minnehaha County specifically highlighting House Bills (HB) 1050 and 1058. HB1050 would modify publishing requirements, as well as the way in which publishing costs are determined for official newspapers. HB 1058 would authorize the recall of County Commissioners.
LIAISON REPORTS
Commissioner Bender reported on the first official Accessible Housing Advisory Board Meeting last Thursday, January 21, 2021. An orientation was given to the board members during the meeting. The City of Sioux Falls hired a Housing Navigator position for which the County provides partial funding.
Commissioner Beninga reported on attending Fair Board Meetings. Fair activities have increased on a regular basis. Commissioner Karsky noted that the Farm Show is this week.
Commissioner Beninga reported on having met with Ben Kyte, Minnehaha County Auditor, who has been actively touching base on every function of the Auditor’s Office to ensure he is informed on his responsibilities.
Commissioner Barth reported on last week’s East Dakota Water Development District Meeting. Two new members have joined the board.
Commissioner Barth reported on the January 25, 2021, Planning Commission Meeting. There were fourteen (14) items on the agenda including campgrounds for both Wild Water West and Huset’s Speedway.
Commissioner Karsky reported on last week’s Minnehaha County and Lincoln County Economic Development Associations Meeting where they voted to combine into one entity.
Commissioner Karsky reported a Link Board Meeting will be held on Thursday January 28, 2021.
NEW BUSINESS
Craig Dewey, Assistant Commission Administrative Officer, reported an updated quote was provided by AVI Systems for the County’s audio/visual system update. In order for an internal committee to have time to review the updated quote, the Building Committee originally scheduled for February 2, 2021, will be moved to February 16, 2021.
