Settlement of Claim Held by the Estate pursuant to SDCL 21-5-5 through 21-5-8. In that Motion, Estela Santos Virves is requesting that the Court enter an Order approving the settlement and apportioning all proceeds of the settlement funds, less attorneys’ fees and expenses to decedent’s minor son.

6. A full Guardianship and Conservatorship is requested by Petitioner for the following reasons: Santos Santos Diego is a minor. Santas’ father, Nicolas Santos Virves, recently passed away. Santas’ mother, Mildred Amarilis Diego Sanchez, may live in Guatemala or may have moved to the United States and Petitioner has been unable to locate her after a diligent search. Santas Santos Diego is the sole heir ofNicolas Santos Virves’ estate. Santas needs a guardian and conservator appointed so someone is able to address his medical and financial needs.
7. The proposed Guardian and Conservator is Estela Santos Virves, whose address is 1900 N. Richard Place, Sioux Falls, South Dakota 57101, whose age,occupation and relationship, if an individual, is: 51 years of age, works as a dish washer at All Day Cafe, and the grandmother of Santos Santas Diego.
8. No Guardian and Conservator has been nominated.
9. No Guardian and Consei-vator has been previously appointed in this state or elsewhaere.
10. Petitioner, as the natural guardian and grandmother of the minor, requests that the requirement for the filing of a bond be waived.
Petitioner requests the Court set a time and place for hearing, that notice be given as provided by law, that the Court issue an Order granting Guardianship and Conservatorship, and that Letters of Guardianship and Conservatorship be issued.
