General Notice
The City of Valley Springs, South Dakota (Owner) is requesting Bids for the construction of the following
Project:

Street and Utility Improvements

Bids for the construction of the Project will be received at the City Hall located at 401 Broadway Avenue, Valley Springs, SD 57068, until January 26, 2021 at 2:00 PM local time. At that time, the Bids received will be publicly opened and read.
The Project includes the following Work: Replacement of existing sanitary sewer, water main, services and surfacing.
Obtaining the Bidding Documents
The Contract Documents including the Bid Forms that must be used are available as follows:

Addendums, if any, will be issued by email from QuestCDN only.
Additionally, in accordance with South Dakota Codified Law 5-18B-1, one copy of Plans and Specifications shall be furnished, without charge, to each Contractor resident in South Dakota who intends, in good faith, to bid upon the project. For qualifying Contractors, Plans and Specifications can be obtained by contacting Mr. Gabriel Laber, HDR Engineering, 101 S. Phillips Avenue, Suite 401, Sioux Falls, SD 57104, phone number 605-977-7754, or by email at gabriel.laber@hdrinc.com.
Each bid shall be accompanied by a Bid Security payable to the Owner for five percent (5%) of the total amount of the bid as a certified or bank check issued by a State or National bank or for ten percent (10%) as a bid bond.
With submission of a bid, the Bidder acknowledges he has visited the site and become familiar with the conditions under which the work is to be performed.
The Owner reserves the right to reject any or all bids, waive technicalities, and make award(s) as deemed to be in the best interest of the Owner. All bids shall remain subject to acceptance for thirty days beyond the date of bid opening.
The bid guarantee will be retained by the OWNER as liquidated damages if the successful bidder refuses or fails to enter into an Agreement within fourteen (14) days after Notice of Award or fails at time of executing the contract to furnish a construction performance bond and construction payment bond guaranteeing the faithful performance of the work.
Bids may not be withdrawn after the time fixed for opening them. The OWNER reserves the right to reject any and all bids, and to waive any irregularities therein.
The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 899, Prohibition on Certain Telecommunications and Video Surveillance Services or equipment
Instructions to Bidders
Davis Bacon and Related Acts wages apply to this project. All provision relative to those acts must be met.
Bidders on this work will be required to comply with the Presidents Executive Orders Nos. 11246 as amended, 11518, and 11635 as amended. The requirements for bidders and contractors under these orders are explained in the specifications.
Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138. The requirements for bidders and contractors under this regulation, which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women’s Business Enterprises (WBE) are explained in the specifications. The DBE/MBE and WBE goals for participation in this contract in terms of percentage of contract value are as follows:
MBE – 1.0%
WBE – 4.0%
The low responsive bidder will be required to certify to compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of 2014. This certification form may be found on page BA-2 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal.
Please be advised that waivers or exemptions from the American Iron and Steel provisions that cite International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Steel provision does not apply to certain products based on the International Trade Agreement exemptions of the Consolidated Appropriations Act of 2014 will not be accepted.

APPROVED MINUTES
REGULAR SESSION
JANUARY 12, 2021
CALL TO ORDER
The Commissioners of the City of Valley Springs met in regular session on Tuesday, January 12, 2021 at 6:00 PM in the VS American Legion. Due to COVID-19, audience members and commissioners were required to practice social distancing within the legion meeting room. Mayor Carl Moss presided. Answering roll call were Commissioners Brian Staeffler, Dean Helgeson, Lance Bauske and Lynn Schmidt. Also present was City Maintenance Blaine Eilts, Finance Officer Linda Hunnel, City Attorney Patrick Glover, Jill Meier from the BV Journal, and City Engineers Gabe Laber and Kyle Lentsch. Motion by Bauske to approve the agenda as posted. Helgeson seconded the motion. Motion carried, all voting aye.
APPROVAL OF MINUTES
Motion by Staeffler to approve the December 8, 14 and 29, 2020 Minutes as presented.
Bauske seconded the motion. Motion carried, all voting aye.
CLAIMS AND PAYROLL
Motion by Staeffler to approve the January 12, 2021 Claims in the amount of $75,166.61. Bauske seconded the motion. Motion carried, all voting aye.
MONTHLY FINANCIAL REPORTS
The Commission reviewed the December Proof of Cash Report and the December YTD Budget Report, as submitted by the Finance Officer. Motion by Helgeson, second by Staeffler, to approve the December 2020 Proof of Cash Report. Motion carried, all voting aye. Motion by Staeffler, second by Schmidt, to approve the December YTD Budget Report. Motion carried, all voting aye.
PUBLIC COMMENT
Weslie Vik was present to speak about the increased water & sewer rates due to the upcoming SRF Construction Project surcharges. Vik said that due to the $24 per month per unit increase he would now pay approximately $1200 a year more in utility payments. The Commission took this into consideration; however they did not vote to reduce apartment surcharges.
CITY ENGINEER REPORT
City Engineers Gabe Laber and Kyle Lentsch gave a report on the upcoming street and utility improvements. Laber went over the timeline of the project, which could run from April to October. There will be a public community meeting this spring to enable homeowners affected by the construction to get answers to any questions or concerns. Some homes on Cliff Ave. will not be accessible by vehicle for a limited time during construction. The engineers will work to coordinate the project with homeowners and keep them informed. The contractor will mill the asphalt removed and the city employees will spread the crushed asphalt in alleys and around the lagoon ponds. Mayor Moss did not think that eight inch sewer pipe would be adequate on Cliff Avenue due to problems in the past with sewer back-ups into homes and also the many services from numerous areas in the city that drain into the Cliff Avenue sewer main. The engineer will add the increased pipe size to the plans. Laber warned that bids could come in high due to inflation. There will be a bid opening for the project January 26 in the City Hall.
NEW BUSINESS
UTILITY BILLING SURCARGE
There was no motion made to change the current surcharge resolution in effect.
SRF CONSTRUCTION PROJECT PAY REQUEST
Motion by Bauske to approve the SRF Loan Reimbursement Request of $37,327.50, Drinking Water, and $41,422.50, Clean Water. Helgeson seconded the motion. Motion carried, all voting aye.
OLD BUSINESS
COMMUNITY CLUB DONATION
Valley Springs Community Members Jessica Murphy and Carmen Ruhlman presented Mayor Moss with a $5,000 check for the purchase of two flashing speed limit signs. The Commission thanks the community club for the volunteer work that made this donation possible.
UPCOMING NOTICE OF VACANCY
Hunnel said Commissioner Lance Bauske’s position as Commissioner, 5 year term, will be up this year. Nominating Petitions can be circulated as of January 29, 2021 and must be filed in the Finance Office by February 26, 2021 at 5pm.
PUBLIC WORKS REPORT
Maintenance Employee Blaine EIlts presented his monthly report. Items included: snow removal, sign repair, cutting trees out of lagoon fence lines, well house repairs, installing meters with remote shut off, flushing dead end hydrants, shop maintenance, water and sewer inspections, locates, etc. Eilts had also researched checklist items from a previous construction meeting with HDR and reported on his findings.
FINANCE OFFICER REPORT
BLOCK ENHANCEMENT GRANT UPDATE
FO Hunnel said she has looked online for a Block Enhancement Grant and found info on a BLOCK Grant, which is a federal grant that deals with Medicaid, Education Funding, Child Care Development, Community Development and Services. There is also CDBG funding but the City of Valley Springs is over household income guidelines for this. She could not find any info on a Block Enhancement Grant.
COVID Relief Grant Update
FO Hunnel reported the City was authorized for $44,242.43 in grant funding and the VS Fire Department was authorized for $42,269.80 in grant funding.
