THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. January 5, 2021, pursuant to adjournment on December 29, 2020. Commissioners present were: Barth, Bender, Beninga, Heiberger, and Karsky. Also present were Olivia Larson, Commission Recorder, and Eric Bogue, Chief Civil Deputy State’s Attorney.
Judge Power administered the Oath of Office to Commissioners Bender and Karsky.
MOTION by Karsky, seconded by Barth, to approve the agenda. 5 ayes.
ELECTION OF 2021 CHAIR AND VICE CHAIR
2020 Commission Chair Bender called for nominations for the 2021 Commission Chair. MOTION by Beninga, seconded by Heiberger, to nominate Dean Karsky as Commission Chair for 2021. Roll Call Vote to elect Dean Karsky as the 2021 Commission Chair. By roll call vote: 5 ayes.
Chair Karsky called for nominations for the 2021 Commission Vice Chair. MOTION by Bender, seconded by Beninga, to nominate Cindy Heiberger as Commission Vice Chair for 2021. Roll Call Vote to elect Cindy Heiberger as the 2021 Commission Vice Chair. By roll call vote: 5 ayes.
DESIGNATION OF OFFICIAL NEWSPAPERS
Craig Dewey, Assistant Commission Administrative Officer, was present to report on proposals received from the Argus Leader, Brandon Valley Journal, Garretson Gazette, and the Minnehaha Messenger for designation as official county newspapers. The proposal from the Argus Leader included a rate for the Argus Leader of $0.49 per line and rates for the Dell Rapids Tribune and Brandon Valley Challenger of $0.28 per line for meeting minutes and $0.32 per line for all other types of notices. The Brandon Valley Journal proposal offered a rate of $0.307 per line. The Garretson Gazette and Minnehaha Messenger proposals offered a rate of $0.3042 per line for meeting minutes and $0.338 per line for other types of notices. MOTION by Heiberger, seconded by Barth, to designate the Argus Leader, the Brandon Valley Journal, the Garretson Gazette, and the Minnehaha Messenger as official newspapers for Minnehaha County in 2021. By roll call vote: 5 ayes. Garrick Moritz, Garretson Gazette Owner; Jill Meier, Brandon Valley Journal Publisher/General Manager; and Lisa Miller, New Century Press General Manager, were present and thanked the Commission for supporting small newspapers.

AUTHORIZING THE APPOINTMENT OF THE
MINNEHAHA COUNTY CORONR
WHEREAS, the Legislature of the State of South Dakota adopted SDCL § 7-7-1.4 which established that the board of county commissioners in any county with a population of seventy-five thousand or more may, by resolution, appoint a coroner who shall serve at the pleasure of such board;
WHEREAS, The Minnehaha County Board of Commissioners previously appointed Dr. Kenneth S. Snell, a duly qualified medical pathologist, to perform the duties of the Minnehaha County Coroner and to serve in the capacity of Medical Examiner for a one-year term in 2020;
WHEREAS, The Minnehaha County Board of Commissioners wish to re-appoint Dr. Snell in 2021 in order to satisfy the intent of the statutes for Coroner;
NOW THEREFORE, BE IT RESOLVED, that the Minnehaha County Board of Commissioners hereby appoint Dr. Kenneth S. Snell as Coroner for Minnehaha County for a one-year term beginning on January 1, 2021, and ending on December 31, 2021.

COMMISSION SALARY
Carol Muller, Commission Administrative Officer, gave a briefing on the determination of the 2021 salary for Minnehaha County Commissioners. To accommodate the payroll system, a salary of $29,765.32 for non-chair Commissioners and $31,265.52 for the Chair would be a divisible number for 26 pay periods in 2021. This would be an increase of 2% for the Commissioners and a little more than $1,500.00 of additional pay for the Chair. MOTION by Barth, seconded by Beninga, to elect a salary and to approve Resolution MC21-02. By roll call vote: 5 ayes.

NOTICE
Notice of Change Order #2 was received from the Minnehaha County Highway Department with a net increase of $3,347.57 and a new contract price of $502,316.85 for Highway Project MC18-10, Structures 50-245-050 and 50-198-085 Replacement.
LIEN COMPROMISE
Melinda Storley, Commission Assistant, gave a briefing on an application for a compromise of lien for DPNO 42783 in the amount of $3,457. The lien represents Court Appointed Attorney services, recorded in September 2019, provided to the applicant’s ex-spouse. The applicant is in the process of selling her home. The lien is attached to the property and must be settled or removed from the property to move forward. The applicant’s ex-spouse transferred the property to the applicant via a quit claim deed recorded in the Register of Deeds Office in December 2020. The divorce was final in July 2019. The compromise requested was to release the lien in full only as it applies to the property and leave the lien in full against the applicant’s ex-spouse. The applicant was present, spoke on her request, and thanked Ms. Storley for her assistance with the compromise process. MOTION by Bender, seconded by Heiberger, to approve Resolution MC21-03. WHEREAS, a County Aid Lien in the amount of $3,457.00, purports to exist in favor of Minnehaha County and against DPNO 42783 as Lienee, and
WHEREAS, said lienee’s ex-spouse has filed an application with the County Auditor stating such facts as provided for by Law,
NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorize the Chair of the County Board and the County Auditor to execute the following:
1) Remove the following property from the lien: located at 206 E 4th Street, Hartford, and legally described as The West 129.7 Feet of Lot 6, North Lawn Addition to Hartford, Minnehaha County, South Dakota, according to the recorded plat thereof.
2) Leave the full amount of $3,457.00 against and in the name of the lienee.

Kim Adamson, Finance & Budget Officer, presented a resolution for the restoration of a tax deed to the former owner of title for RDID 45063 and RDID 45065, Tax Deed #1333 and Tax Deed #1335 respectively. Payments were received from Maynard Keath Gilbertson, which represented all taxes, assessments, interest, and costs owing on the tax deeds. MOTION by Heiberger, seconded by Beninga, to approve Resolution MC21-04. By roll call vote: 5 ayes.

WHEREAS, Minnehaha County holds under Tax Deed proceedings Tax Deed #1333 for RDID #45063, and Tax Deed #1335 for RDID #45065, covering property legally described, respectively:
The East 1/3 of Lots 7, 8, and 9 in Block 1 of Rowland’s Addition to the City of Sioux Falls, Minnehaha County, South Dakota, according to the recorded plat thereof; and
Lots One (1), Two (2), and Three (3), Except the East Three Feet (E3’) thereof, and Lots Ten (10), Eleven (11) and Twelve (12), in Block One (1) of Rowland’s Addition to Sioux Falls, Minnehaha County, South Dakota, according to the recorded plat thereof.
WHEREAS, Maynard Keath Gilbertson, 5901 W 35th Street, Sioux Falls, South Dakota, 57106, is the prior record owner of the above described property; and
WHEREAS, SDCL Ch. 10-25 provides for the restoration of title to said record owner upon payment of all taxes, interest, and cost represented in the Tax Deed along with any other taxes, interest or costs that are unpaid on the property; and

BRIEFING
Bill Hoskins, Museum Director, gave a briefing on the Siouxland Heritage Museums for 2020 and the future highlighting topics such as the impacts of COVID-19, switching the focus from the Museum collection to Museum visitors, a survey report for future repairs, generous donations received, volunteer hours, and the Mountain Plains Museum Association Annual Meeting to be held October 5-8, 2021.
POLICY REVIEW
Craig Dewey, Assistant Commission Administrative Officer, presented the annual review of the Minnehaha County Facility Power Outage Response Protocol that went into effect January 1, 2012. The policy has been sent to Department Heads for review and discussion with staff.

THE MINNEHAHA COUNTY BUILDING COMMITTEE CONVENED AT 8:00 A.M. January 5, 2021, pursuant to adjournment on December 15, 2020. Committee Members present were: Barth, Bender, Beninga, Heiberger, Karsky, Kyte, and Muller. Committee Member Kriens was absent.
MOTION by Beninga, seconded by Barth, to approve the December 15, 2020, Building Committee Meeting Minutes. 5 ayes.
AUDIO VISUAL UPGRADE
Craig Dewey, Assistant Commission Administrative Officer, introduced Chuck Risty, AVI Systems Account Manager. Mr. Risty provided an overview of the original audio visual upgrade plan and the additional options for consideration. Discussion included topics such as Commissioners utilizing monitors versus iPads, camera placement, automation of controls (volume stabilization etc.), and utilizing the current televisions or upgrading to new commercial televisions.
FACILITY UPDATE
Craig Dewey, Assistant Commission Administrative Officer, gave an update on the following: the administration & extension building renovations design process and Construction Manager At-Risk selection, office standards, the new Highway Facility project, and the County Gravel Pit. Mr. Dewey also provided an update on the termination of the ground lease on the Community Correction Center (CCC). The Committee directed staff to begin the appraisal process on the CCC with the formation of an appraisal board and getting a broker’s opinion of value.
