STREET AND UTILITY IMROVEMENTS PROJECT
General Notice
The City of Valley Springs, South Dakota (Owner) is requesting Bids for the construction of the following
Project:
City of Valley Springs, South Dakota
Street and Utility Improvements

Bids for the construction of the Project will be received at the City Hall located at 401 Broadway Avenue, Valley Springs, SD 57068, until January 26, 2021 at 2:00 PM local time. At that time, the Bids received will be publicly opened and read.
The Project includes the following Work: Replacement of existing sanitary sewer, water main, services and surfacing.
Obtaining the Bidding Documents
The Contract Documents including the Bid Forms that must be used are available as follows:
Bidding Documents may be viewed and ordered online by registering with Quest CDN at www.questcdn.com. Following registration, complete sets of Bidding Documents, Project No. 7464060 may be downloaded for $20.00 from the website as portable document format (PDF) files. Please contact QuestCDN.com at 952-233-1632 or info@questcdn.com for assistance in free membership registration, downloading and working with the digital project information. Addendums, if any, will be issued by email from QuestCDN only.
Additionally, in accordance with South Dakota Codified Law 5-18B-1, one copy of Plans and Specifications shall be furnished, without charge, to each Contractor resident in South Dakota who intends, in good faith, to bid upon the project. For qualifying Contractors, Plans and Specifications can be obtained by contacting Mr. Gabriel Laber, HDR Engineering, 101 S. Phillips Avenue, Suite 401, Sioux Falls, SD 57104, phone number 605-977-7754, or by email at gabriel.laber@hdrinc.com.
Each bid shall be accompanied by a Bid Security payable to the Owner for five percent (5%) of the total amount of the bid as a certified or bank check issued by a State or National bank or for ten percent (10%) as a bid bond.
With submission of a bid, the Bidder acknowledges he has visited the site and become familiar with the conditions under which the work is to be performed.
The Owner reserves the right to reject any or all bids, waive technicalities, and make award(s) as deemed to be in the best interest of the Owner. All bids shall remain subject to acceptance for thirty days beyond the date of bid opening.
The bid guarantee will be retained by the OWNER as liquidated damages if the successful bidder refuses or fails to enter into an Agreement within fourteen (14) days after Notice of Award or fails at time of executing the contract to furnish a construction performance bond and construction payment bond guaranteeing the faithful performance of the work.
Bids may not be withdrawn after the time fixed for opening them. The OWNER reserves the right to reject any and all bids, and to waive any irregularities therein.
The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 899, Prohibition on Certain Telecommunications and Video Surveillance Services or equipment
Instructions to Bidders
Davis Bacon and Related Acts wages apply to this project. All provision relative to those acts must be met.
Bidders on this work will be required to comply with the Presidents Executive Orders Nos. 11246 as amended, 11518, and 11635 as amended. The requirements for bidders and contractors under these orders are explained in the specifications.
Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138. The requirements for bidders and contractors under this regulation, which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women’s Business Enterprises (WBE) are explained in the specifications. The DBE/MBE and WBE goals for participation in this contract in terms of percentage of contract value are as follows:
MBE – 1.0%
WBE – 4.0%
The low responsive bidder will be required to certify to compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of 2014. This certification form may be found on page BA-2 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal.
Please be advised that waivers or exemptions from the American Iron and Steel provisions that cite International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Steel provision does not apply to certain products based on the International Trade Agreement exemptions of the Consolidated Appropriations Act of 2014 will not be accepted.
