BUILDING COMMITTEE CONVENED AT 8:00 A.M. December 15, 2020, pursuant to adjournment on November 24, 2020. Committee Members present were: Bender, Beninga, Heiberger, Karsky, and Kriens. Committee Members Barth and Muller were present via teleconference. Committee Member Litz was absent.
MOTION by Beninga, seconded by Heiberger, to approve the November 24, 2020, Building Committee Meeting Minutes. By roll call vote: 5 ayes.
OFFICE STANDARDS
Craig Dewey, Assistant Commission Administrative Officer, gave a briefing on a proposal from JLG Architects to conduct a furniture study. The study was proposed to assist with future decision making on office standards due to a lack of information on current County owned furniture. The cost of the study would be approximately $85,500 and would include inventory, design, documentation, and spec and bid for any new items needed. Direction was given to staff to move forward with preparing a contract to move forward with the study.
INSURANCE
Craig Dewey, Assistant Commission Administrative Officer, introduced Todd Flickema, SilverStone Group Director of Professional Risk Services. Mr. Flickema presented the 2021 property liability insurance policy rates from Travelers. Multiple levels of wind/hail deductible with All Other Perils was provided. Mark Kriens, Facilities Director, spoke on an instance of roof damage caused by wind in previous years. Kim Adamson, Finance & Budget Officer, spoke on the current budget in relation to insurance. Direction was given to Mr. Flickema to further negotiate with Travelers specific to a $100,000 wind/hail deductible.
NEW BUSINESS
Craig Dewey, Assistant Commission Administrative Officer, requested direction regarding the audio/visual updates specific to monitors for the Commissioners and the number of controls for the Zoom Room. Direction was given to request quotes for the monitors, commercial grade televisions, and controls. Additionally, staff was directed to request the audio/visual company’s recommendation on the minimum number of controls.

Special Personnel Action
Carey Deaver, Human Resources Director, presented a resolution for the establishment of County elected department head annual salaries. South Dakota Codified Law provides the statutory minimum annual salaries for County Treasurer, Auditor, Register of Deeds, State’s Attorney, and Sheriff. The resolution will set the current sitting elected officials’ annual salary, and the minimum salaries for any newly elected officials. ESTABLISHMENT OF COUNTY ELECTED DEPARTMENT HEAD ANNUAL SALARIES
WHEREAS, the Minnehaha County Commission is dedicated to attracting citizens of the highest quality to public service by establishing proper salaries for elected officials, basing those salaries on realistic standards, and paying them according to the duties of their office; and
WHEREAS, South Dakota Codified Law provides for certain statutory minimum annual salaries for these five elected officials, absent a resolution from the County Commission establishing a different annual salary for each official, pursuant to SDCL 7-7-9.1, SDCL 7-7-12, and SDCL 7-12-15; and
WHEREAS, it is the sense of the County Commission that these statutory minimum annual salaries are inadequate compensation for the duties discharged by these officials;
NOW THEREFORE BE IT RESOLVED, by the Minnehaha County Board of Commissioners, that the minimum annual base salaries for newly Elected Officials are set as follows:

LIEN COMPROMISE
Melinda Storley, Commission Assistant, gave a briefing on an application for a compromise of lien for DPNO 28736 in the amount of $7,422.69. The lien represents Public Defender and Court Appointed Attorney services provided to the applicant between 1992 and 1996. The applicant and his spouse are purchasing a home and have found a buyer for their current home. According to a 2019 joint tax return, the applicant had an adjusted gross income of $95,409.00 and owed $8,277.00. Financial statements provided indicate total assets of $358,568.40 and total liabilities of $207,092.77. The compromise request was to release the lien in full with no payment or upon payment of $4,193.64. The applicant was present, spoke on his compromise request, and was available to answer Commissioner questions. Ms. Storley confirmed that payments totaling $2,178.60 were paid to Lincoln County for the Lincoln County lien. Payments in the amount of $50.70 were paid to Minnehaha County. Commissioners Karsky and Beninga expressed being in favor of a compromise due to the events that caused the liens and the applicant’s current home situation. BUDGET SUPPLEMENT
Kim Adamson, Finance & Budget Officer, presented requests for authorization to supplement budget short-falls with personnel savings. The Department of Equalization has requested to utilize $25,000 of Personnel Savings to cover the cost of a vehicle replacement. The Air Guard has requested the use of $27,450 from their Personnel Savings to offset additional uniform and safety equipment purchases. The Highway Department has requested the utilization of an estimated $243,000 in Personnel Savings to go towards Contracted Construction. MOTION by Karsky, seconded by Beninga, to authorize unused Personnel Services budget appropriation to be used for Operational Expenses in the Department of Equalization, the Air Guard, and the Highway Construction budgets. AGREEMENTS
Bill Hoskins, Museum Director, gave a briefing on the 2021 Lease Agreements for the Sioux Valley Genealogical Society and the Minnehaha County Historical Society. Under the terms of the agreements, the Genealogical Society will lease approximately 600 square feet of office space on the second floor of the Old Courthouse Museum. The Historical Society will lease approximately 178 square feet of office space on the first floor of the Old Courthouse Museum. Both leases are for 12 month periods. There is no charge for the lease space. The County pays for light, heat, and custodial services. The Societies pay for their phone and comprehensive general liability insurance. MOTION by Heiberger, seconded by Beninga, to authorize the Chair to sign the Lease Agreement between Minnehaha County and the Sioux Valley Genealogical Society beginning on January 1, 2021, and ending on December 31, 2021; and to authorize the Chair to sign the Lease Agreement between Minnehaha County and Minnehaha County Historical Society beginning on January 1, 2021, and ending on December 31, 2021. Jamie Gravett, Juvenile Detention Center Director, via Zoom Videoconference, presented the renewal agreement with Southeastern Behavioral Healthcare, Inc. to provide on call qualified mental health professional (QMHP) services and ongoing needs counseling for the youth detained in the Juvenile Detention Center (JDC). The rate for on call services will remain the same at $150 per week. The cost for counseling and training to residents of the JDC remains the same at $50.00 per hour. MOTION by Heiberger, seconded by Beninga, to authorize the Chair to sign the Agreement for Professional Services between Minnehaha County and Southeastern Behavioral Healthcare, Inc. for Qualified Mental Health Professional services beginning on January 1, 2021, and ending December 31, 2021. Jamie Gravett, Juvenile Detention Center Director, via Zoom Videoconference, presented an agreement between Minnehaha County and Lutheran Social Services for the Evening Report Center. The Evening Report Center supervises youth, provides community service, assists with homework, and teaches life skills. Total payments shall not exceed $87,910.10. The program will include four (4) hours of service delivery per day and will run six (6) days a week. MOTION by Beninga, seconded by Heiberger, to authorize the Chair to sign the agreement between Minnehaha County and Lutheran Social Services for the Evening Report Center with total payments not to exceed $87,910.10 beginning on January 1, 2021, and ending December 31, 2021. AMBULANCE LICENSE RENEWALS
Jason Gearman, Emergency Management Director, gave a briefing on applications received from ambulance services to obtain county licenses to operate for the 2021-2022 term. There are six Primary Service Areas (PSA) in Minnehaha County, and applications were received from the following providers: Dell Rapids Community Ambulance, PSA 1; Garretson Community Ambulance, PSA 2; Humboldt Fire & Ambulance Service, PSA 3; Jasper Community Ambulance, PSA 4; Med-Star Paramedic Ambulance Inc., PSA 5; and Patient Care EMS, PSA 6. All applicants met the requirements for county licensure per Ordinance MC31-6-19. Scott Anderson, Planning Director, gave a briefing on applications received for appointment to the Minnehaha County Planning Commission Board. The following two individuals submitted applications for appointment: Bonnie Duffy, 2300 S River Bluff Rd, Sioux Falls; and Michael Ralston, 400 Kelsey Circle, Crooks. Both applicants are current Planning Commissioners whose terms expire on December 31, 2020. BRIEFING
DJ Buthe, Highway Superintendent, introduced Chris Brozik, Civil Design Inc. Principal Engineer. Mr. Brozik gave a briefing via Zoom Videoconference on the 2020 Bridge Inspection highlighting the inspection process, the rankings given, the documentation and reporting, and a summary of postings and recommendations.
AGREEMENTS & CONTRACTS
Kari Benz, Human Services Director, presented an Agreement for Detoxification Services between Minnehaha County and The Carroll Institute. Due to the delayed opening of the LINK Community Triage Center (LINK) and the contract with Armor Correctional ending on December 31, 2020, the need for a detoxification services provider was identified. The agreement would be effective on a month-to-month basis beginning on December 28, 2020, until LINK is operational. The Carroll Institute would provide 8 beds for 93 days at $170.00 per day per bed resulting in a total cost of $126,480. Under the agreement, detoxification services will move to The Carroll Institute’s facility at 327 S Spring Ave, Sioux Falls. Services include operations oversight, food, cleaning, supplies, additional staffing for program and education needs, and contracted medical services to meet accreditation standards. Gary Tuschen, The Carroll Institute Executive Director, spoke on process leading to the creation of the agreement. MOTION by Beninga, seconded by Heiberger, to authorize the Chair to sign the Agreement for Detoxification Services between Minnehaha County and The Carroll Institute at a cost of $126,480 beginning on December 28, 2020. Craig Dewey, Assistant Commission Administrative Officer, presented the 2021 contract between Minnehaha County, Sanford Health Pathology Clinic, and Dr. Kenneth S. Snell (an employee of Sanford Clinic), for Coroner and Medical Examiner Services. Under the terms of the contract, Dr. Snell will receive $6,000 per month for coroner duties, and a flat rate of $19,936.17 per month for medical examiner duties. Lab fees, ambulance transports, and monthly cell phone/electronic communication costs will be paid separately from the 2020 Minnehaha County Coroner/Medical Examiner Budget. These fees are estimated at $109,311 for 2020. MOTION by Karsky, seconded by Heiberger, to authorize the Chair to sign the 2021 Coroner/Medical Examiner Services Contract between Minnehaha County, Sanford Clinic dba Sanford Health Pathology Clinic, and Dr. Kenneth S. Craig Dewey, Assistant Commission Administrative Officer, presented the 2021 renewal Lease Agreement between Minnehaha County and Metro Communications Agency. Under the terms of the agreement Metro Communications will lease 4,296 square feet of space in the Public Safety Building at $11.88 per square foot. Rates for subsequent years will be increased based on the Midwest Urban Consumer Price Index. Utilities, housekeeping, and upkeep of the facility is provided by the County. MOTION by Beninga, seconded by Heiberger, to authorize the Chair to sign the 2021 Lease Agreement between Minnehaha County and Metro Communications Agency for space in the Public Safety Building at $11.88 per square foot effective January 1, 2021 thru December 31, 2021. Craig Dewey, Assistant Commission Administrative Officer, presented the 2021 Agreement for Mobile Crisis Team Services between Minnehaha County and Southeastern Behavioral Healthcare (SBH). Minnehaha County will pay SBH a program administrative fee of $5,000 per year in twelve monthly installments of $416.67. The County will also be responsible for the on-call costs of mental health professionals at a rate of $100 per 24 hour on-call period, $50 for on-call periods of less than 24 hours, $25 per hour for on-call as-needed crisis intervention services, and a rate of $37.50 per hour for Southeastern Employees eligible for overtime. The County will also reimburse the provider $0.40 per mile for mileage incurred. MOTION by Heiberger, seconded by Karsky, to authorize the Chair to sign the 2021 Agreement for Mobile Crisis Team Services between Minnehaha County and Southeastern Behavioral Healthcare beginning on January 1, 2021, and ending on December 31, 2021. Craig Dewey, Assistant Commission Administrative Officer, presented the 2021 Contract between Minnehaha County and the Sioux Falls Area Humane Society for animal control services. Minnehaha County has allocated $47,000 for animal control in the 2021 budget. $36,036 will be paid out in 12 monthly installments of $3,003. In addition, the Humane Society will bill $56.00 per hour plus the IRS approved mileage rate for any emergency after-hours calls. Once the billing exceeds 80% of the budget, the Humane Society and the County will consider a change in protocol to reduce costs or determine if a budget supplement is necessary. MOTION by Heiberger, seconded by Karsky, to authorize the Chair to sign the contract between Minnehaha County and the Sioux Falls Area Humane Society for animal control services for the period of January 1, 2021, through December 31, 2021. Craig Dewey, Assistant Commission Administrative Officer, presented the 2020 and 2021 Agreement for Detoxification Services funding with the City of Sioux Falls. For detoxification services provided in 2020, the City will pay the County $157,500. Beginning in January 2021, the City will reimburse the County in the amount of $13,125 on a monthly basis in such time that LINK takes over detoxification services or until December 2021, whichever comes first. MOTION by Beninga, seconded by Heiberger, to authorize the Chair to sign the 2020 and 2021 Agreement for Detoxification Services funding between the City of Sioux Falls and Minnehaha County in the amount of $157,500 for 2020 and monthly payments of $13,125 beginning in January 2021. Craig Dewey, Assistant Commission Administrative Officer, presented the Consulting/Independent Contract Agreement between Minnehaha County and Dr. Jeff Luther to perform the services of Quality Assurance Director for the rural ambulance quality assurance program in accordance with county ordinance. Under the terms of the contract, Dr. Luther will receive $30,000 payable in twelve (12) equal monthly installments. MOTION by Karsky, seconded by Beninga, to approve the 2021 Consulting/Independent Contractor Agreement for Quality Assurance Director for Rural Ambulance Service between Minnehaha County and LuDoc, LLC, Dr. Jeff Luther, at a cost of $30,000 beginning January 1, 2021, and ending December 31, 2021. By roll call vote: 5 ayes.
LIAISON REPORT
Commissioner Heiberger reported on attending last week’s South Dakota Association of County Commissioners Board of Directors Meeting. Commissioner Karsky was also in attendance.
Commissioner Heiberger reported on a phone conference set up by the City of Sioux Falls Mayor for the Sioux Empire Leadership Council to hear from the Colorado Springs, CO mayor on the effect of marijuana legalization on his community.
Commissioner Barth reported on last week’s South Eastern Council of Governments Board Meeting where the board conducted the director’s annual review.
Commissioner Barth reported on the retirement of Harold Boer from the Lyons Fire Department. Mr. Boer was the founder of the company now known as Rosenbauer.
Commissioner Bender reported on conducting four Zoom interviews on December 14, 2020, for responders to the Construction Manager At-Risk request for proposals for the Administration and Extension Building Remodels. Commissioner Barth also attended the interviews.
Commissioner Bender reported on attending a meeting with legislators to discuss the MacArthur Grants received and the strategies developed as a result of the grants.
