An ordinance amending MC16-90 the 1990 Revised Zoning Ordinance for Minnehaha County.
The Minnehaha County Board of Commissioners adopted Ordinance MC16-166-20 on July 21, 2020. Ordinance MC16-90, the 1990 Revised Zoning Ordinance for Minnehaha County, amending the Cedar Ridge Planned Development to allow accessory structures in Subarea A to follow the total permissible area of accessory building as shown in Table 4 of Article 12.07; that 47534 Cedar Ridge Place is located in Subarea C; to require that the loop road is to be completed and graveled by December 31, 2022; and to add six (6) single family residential lots to Subarea A from Subarea C on property described as: N1/2 SW1/4 all in Section 3-T102N-R49W.
The entire ordinance is on file in the office of the County Auditor and available for inspection during regular business hours.

THE MINNEHAHA COUNTY COMMISSION CONVENED IN A JOINT SESSION WITH THE SIOUX FALLS CITY COUNCIL AT 5:00 P.M., July 28, 2020, pursuant to adjournment on July 28, 2020. Commissioners present were: Barth, Bender, and Heiberger. Commissioners Beninga and Karsky were absent. Also present was Olivia Larson, Commission Recorder.
City Council Members present: Erickson, Jensen, Kiley, Neitzert, Selberg, Soehl, and Starr. City Council Member Brekke was present via teleconference.
Chair Bender called the meeting to order.
MOTION by Barth, seconded by Heiberger, to approve the agenda. By roll call vote: 3 ayes. The City concurred.
BRIEFINGS
A briefing was given on a proposal to share facility space at the future Public Safety Training Campus. City of Sioux Falls Police Chief Matt Burns spoke on the history of the training facility. Scott McMahon, Director of Metro Communications Agency, spoke on three primary justifications for sharing facility space including public safety, public service, and organizational needs. Mr. McMahon also spoke on the benefits of the chosen site and partnership with the City. Rick Kuhl, WSKF Architects Principal, and Tommy Abercrombie, Abercrombie Planning & Design Owner & Principal, spoke on the site’s schematic design. Shawn Pritchett, City of Sioux Falls Director of Finance, spoke on the costs, funding, and space allocation associated with the sharing of facility space.
Bill Hoskins, Museum Director, presented the 2019 Museum Special Enterprise Fund Report. The fund receives revenues and accounts for expenses associated with the rental of space in the museum system, sponsorships, and the provision of programs, events, and services for which a fee is charged. The fund is used to support two staff positions and to further the mission of the Siouxland Heritage Museum.

PUBLIC COMMENT
Scott Wick, President & CEO of the Sioux Empire Fair Association, thanked the Commission for their continued support of the Sioux Empire Fair over the years. Mr. Wick spoke on COVID-19 related measures, the events taking place, and the vendors for the upcoming Sioux Empire Fair.
PROVISIONAL BUDGET
Carol Muller, Commission Administrative Officer, presented the FY2021 Provisional Budget in the amount of $114,977,021. The provisional budget includes $67,459,468 in the General Fund, $13,446,176 in the Highway Fund, $3,976,678 in the Building Fund, $4,568,122 in the Debt Service Fund, and a General Fund cash applied amount of $5,115,546. No additional opt-out will be utilized. $20,000 was budgeted for capital projects. A 15% increase was budgeted for health insurance premiums. A matrix adjustment of 2% was included for non-elected personnel. A Corporal position in the Jail and a Deputy Sheriff position in the Sheriff’s Office were approved to move from grant funded to general funds. Additionally, a new paralegal position for the Public Defender’s Office and a new Correctional Systems Operator position in the Jail were approved. A public hearing on the proposed FY2021 budget will be held during the Minnehaha County Commission meeting at 9:00 a.m., Tuesday, September 8, 2020. MOTION by Heiberger, seconded by Beninga, to approve the FY2021 Provisional Budget and Adoption Resolution MC20-55. By roll call vote: 5 ayes. RESOLUTION
DJ Buthe, Highway Superintendent, presented, via videoconference, a resolution to apply for grant funding through the 2021 Bridge Improvement Grant. Based on scores from previous years where projects were awarded, four bridge structures have been selected to request funds. If awarded, the County’s responsibility to participate is 20% of the preliminary engineering costs. The cost range is estimated between $6,400 and $10,000 per structure. APPROVAL OF PROPERTY TAX PAYMENT PROPOSAL ON
PARCEL RECORD 035525
WHEREAS, Minnehaha County has received notice from the owner of record that property taxes are delinquent by nine years; and
WHEREAS, a total of $18,301.16 in back taxes, penalties, and interest is owed on the property; and
WHEREAS, the owner of record has requested support from the county to assist with re-payment options over a thirty-six (36) month period; and
WHEREAS, the owners of record, Howard Thomas, proposed the following payment plan to the county commission for consideration in order to satisfy all outstanding taxes, penalties, and interest:
• Initial Payment of $508.37 due by September 1, 2020.
• Payment of $508.37 is due by the first of each following month through July 2023.
• Final Payment of any additional unpaid property taxes, plus any additional accrued interest and penalties due by August 1, 2023.
WHEREAS, in the event that the owner of record does not pay all back taxes, penalties and interest owing on property record 035525 in accordance with the aforementioned terms, Minnehaha County may proceed with the tax deed process.

Commissioner Beninga reported on a July 27, 2020, meeting with Commissioner Karsky, the Highway Department, and architects and engineers from ISG to discuss six different site options for the Highway Facility and begin hiring a construction manager.
Commissioner Barth reported on the July 27, 2020, Planning Commission Meeting where a gravel extraction near Hartford was approved and action was deferred on a project due to conditions previously set in 2016 not having been met.

There is a $75.00 pre-paid fee required for plans requested to be sent by mail or private courier.
The Owner reserves the right to reject any or all bids, waive technicalities, and make award(s) as deemed to be in the best interest of the Owner.
The project generally consists of the following scope of work:
• Traffic Control
• Removal of existing asphalt pavement
• Scarification re-compaction of the existing gravel base course
• Placing of additional aggregate base course as needed
• Excavation & re-compaction of subgrade areas where soft spots are identified
• Construction of two lifts of asphalt pavement as per typical section
• Driveway pavement tie-in as indicated
• Topsoil and turf restoration adjacent to new asphalt pavement
The project is to proceed in the event a bid is accepted, and a contract is awarded. Tentative project completion is scheduled for late September or early October 2020 with the asphalt removal, base course placement and shaping, and asphalt paving. Completion and project schedule is open to negotiation with the Split Rock Township, Mystic Meadows Property Owners, and the Engineer. Dates subject to change to due to the ongoing COVID-19 situation.
