TREE PESTICIDE APPLICATORS LICENSE PROVISIONS

BE IT ORDAINED by the City Council of Brandon South Dakota that Chapter 6-10 Tree Pesticide Applicators License Provisions is hereby adopted:

6-10-1 DEFINITIONS

Owner:  Is a natural person who owns the property on which the treated tree(s) or shrub(s) are located.

Tree Pesticide Applicator:  A person who engages in the business or sale of applying or treating trees or shrubs for disease.

6-10-2 LICENSE REQUIRED

All pesticide treatment of trees or shrubs located within the city right of way must be performed by a Licensed Tree Pesticide Applicator licensed by the City of Brandon, South Dakota.

6-10-3 LICENSE FEE

The Brandon City Council may, from time to time, establish a license fee by resolution.

6-10-4 LICENSE TERM AND RENEWAL

All licenses issued under the provisions of this chapter are annual and expire on December 31st of every year regardless of issue date.  All renewal fees shall be paid prior to the license being renewed.

6-10-5 TREATED TREES TO BE MARKED AND REGISTERED

Pursuant to 13-1-18, all treated trees must be marked with an approved tag on the street side of the tree and registered with the City of Brandon.

6-10-6 SUSPENSION, DENIAL OR REVOCATION OF LICENSE

The application for a license or a current license may be denied, suspended or revoked in accordance with the procedure outlined in Brandon City Ordinance 6-2-9, 6-2-10, 6-2-11, and 6-2-12.
