THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. February 25, 2020, pursuant to adjournment on February 18, 2020. Commissioners present were: Barth, Bender, Beninga, Heiberger, and Karsky. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

The January 2020 Juvenile Detention Center Report, the Auditor’s Office Financial Reports for January 2020, and the Minnehaha County Auditor’s Account with the County Treasurer as of January 31, 2020, were received and placed on file in the Auditor’s Office. Vicki Huitt, Accounting Manager, reported on the following Auditor’s Office Financial Reports: General Fund Cash Balance Report, Highway Fund Cash Balance Report, the General Fund YTD Expenditures Report, and the General Fund YTD Revenue Report.

Upon the recommendation of Chris Lilla, Director of Equalization, the following motions were made:

MOTION by Barth, seconded by Heiberger, to approve abatement for South Dakota Department of Game Fish & Parks, Parcel ID 16620, legally described as Tract 1 Cooley’s Addn (Ex H-1) W1/2 31-103-47 Palisade Township 103-47, 2019 Property Taxes, in the amount of $296.04, representing tax exempt status. By roll call vote: 5 ayes.

MOTION by Heiberger, seconded by Karsky, to approve abatement for the City of Sioux Falls Catholic Schools Property Corp, Parcel ID 44734, legally described as N 35’ 13 & All 14 Block 1 Roger’s Park Addn To City Of Sioux Falls, 2019 Property Taxes, in the amount of $1,280.86, representing a re-valuation due to significant storm damage. By roll call vote: 5 ayes. Mr. Lilla stated that the property will also be changed to tax exempt status due to a change in the use of the property.

MOTION by Heiberger, seconded by Barth, to approve abatement for Jerry & Barb Vanvliet, Parcel ID 87530, 1404 S Scarlet Oak Tr, 2019 Property Taxes, in the amount of $629.20, to correct an error. By roll call vote: 5 ayes.

MOTION by Beninga, seconded by Heiberger, to approve abatements for 2019 Property Taxes representing the Elderly Assessment Freeze: Parcel ID 35239, in the amount of $1,639.34, 1712 E 5th St; Parcel ID 81943, in the amount of $461.05, 8610 W Laverne Wipf St; Parcel ID 56522, in the amount of $765.93, 6009 W Silver Valley Dr; and Parcel ID 36005, in the amount of $597.18, 3001 E 20th St. By roll call vote: 5 ayes. 

MOTION by Karsky, seconded by Heiberger, the following abatements representing the disabled veterans tax exemption under SDCL 10-4-40 for Parcel ID 74036: 2018 Property Taxes, in the amount of $43.56 and 2019 Property Taxes, in the amount of $264.08. By roll call vote: 5 ayes.

PUBLIC COMMENT

Upon the request of Commissioner Karsky, Steve Lindquist, 4109 S Pillsberry Ave, Sioux Falls, spoke as the Triage Center Project Director. Mr. Lindquist provided an update on the Triage Center development and spoke on his previous work experience.

BRIEFINGS

Holly Rader, Sioux Falls Area Chamber of Commerce Agri-Business Division Manager, gave a briefing on the Sioux Empire Livestock Show, Ag Appreciation Day, and the National Famer’s Day at the Barn. Ms. Rader introduced Jeff Griffin, the new Sioux Falls Area Chamber of Commerce President & CEO. Mr. Griffin spoke on his first month and a half on the job.

Gary Tuschen, Carroll Institute Executive Director, and Tiffany Butler, Carroll Institute Director of Operations Regulatory Compliance, gave a briefing on the utilization of their services, the expansion of their services, and their treatment programs. Additionally, a shared practice clinic will be opening the week of March 9, 2020.

Carey Deaver, Human Resources Director, gave a briefing on the Human Resources Department’s projects and goals, as well as, a briefing on the annual workforce review identifying trends and significant changes in areas such as demographics, turnover, recruitment, and step distribution.

AGREEMENT

DJ Buthe, Highway Superintendent, presented a Professional Services Agreement between Minnehaha County and Short Elliot Hendrickson, Inc. (SEH) for Project MC18-07, Highway 110 Culvert Replacement. SHE will provide construction administration at a cost not to exceed $28,919.00. The work is expected to begin in the Spring of 2020 and will be completed by October 23, 2020. MOTION by Barth, seconded by Beninga, to authorize the Chair to sign the Professional Services Agreement between Minnehaha County and Short Elliot Hendrickson, Inc. for MC18-07, Highway 110 Culvert Replacement, construction administration at a cost not to exceed $28,919.00.  5 ayes.

BRIEFING

Kevin Hoekman, Planner, gave a briefing on proposed building permit fee increases. A draft resolution was prepared and will be presented to the Commission at the March 10, 2020, Regular County Commission Meeting to request approval.

AGREEMENT

Jamie Gravett, Juvenile Detention Center Director, presented a Long-Term Staffing Agreement between Minnehaha County and Tri-State Nursing Enterprises for nursing services as an independent contractor at the Juvenile Detention Center. Billing is based on the number of hours worked, the type of nursing professional working, the shift being worked, and any necessary millage. The term of the agreement is for twelve months. MOTION by Beninga, seconded by Heiberger, to authorize the Chair to sign the Long-Term Staffing Agreement between Minnehaha County and Tri-State Nursing Enterprises for nursing services at the Juvenile Detention Center for a term of twelve months beginning on February 25, 2020.  5 ayes.

LEGISLATIVE UPDATE

Craig Dewey, Assistant Commission Administrative Officer, gave an update and status report on the 2020 Legislative Session bills that impact Minnehaha County highlighting Senate Bill (SB) 157, SB 79, and SB 70.

LIAISON REPORT

Commissioner Heiberger reported on plans to attend the 2020 National Association of Counties Legislative Conference with Commissioner Barth in Washington, D.C. where she will first attend meetings for the Justice & Public Safety Committee. Commissioner Barth reported that President Trump and General Colin Powell are scheduled to speak at the conference.

Commissioner Barth reported on the February 24, 2020, Planning Commission Meeting where a roller coaster for Wild Water West was approved. Items that were turned down included a property in violation of County ordinance and a proposed subdivision that was located in a floodplain.

NEW BUSINESS

Commissioner Karsky suggested postponing the Building Committee Meeting scheduled for Tuesday, March 3, 2020, due to only three Commissioners being able to be present for the meeting.

MOTION by Barth, seconded by Karsky, to recess the Minnehaha County Commission Meeting at 10:11 a.m.  5 ayes.

MOTION by Karsky, seconded by Beninga, to reconvene the Minnehaha County Commission Meeting at 10:20 a.m.  5 ayes.

MOTION by Barth, seconded by Beninga, to enter into Executive Session pursuant to SDCL 1-25-2 (1), (3) and (4).  5 ayes.

MOTION by Barth, seconded by Karsky, to adjourn.  5 ayes.

The Commission adjourned until 9:00 a.m. on Tuesday, March 3, 2020.
