THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. October 29, 2019, pursuant to adjournment on October 22, 2019. Commissioners present were: Barth, Bender, Beninga, Heiberger, and Karsky. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

PLANNING & ZONING NOTICE
Kevin Hoekman, Planner, gave the first reading and requested authorization for the Auditor to publish a Notice of Hearing for November 19, 2019, to consider the adoption of the 2018 International Building Code, the 2018 International Residential Code, and the 2018 International Existing Building Code Ordinances. MOTION by Barth, seconded by Heiberger, to authorize the Auditor to publish a Notice of a Public Hearing at or after 9:00 am on November 19, 2019, for the adoption of the 2018 International Building Code, 2018 International Residential Code, and the 2018 International Existing Building Code.  5 ayes.
PUBLIC COMMENT
Lori Montis, Human Services Assistant Director, reported that the County has been selected to participate in a grant through the National Association of Counties with the City of Sioux Falls for the Housing and Health Action Learning Cohort.
Gerry Karpen, 200 2nd Street, Sherman, with the Sherman Town Council, raised concerns regarding an apportionment check that the County sent, but was not received by Sherman. Pam Nelson, Treasurer, spoke on the process for County issued checks that are not cashed. Bob Litz, Auditor, spoke on the options discussed with Mr. Karpen to ensure that Sherman gets paid and spoke on the current apportionment check process.
PRESENTATION
Scott Wick, President and CEO of the Sioux Empire Fair Association, presented the 2019 Sioux Empire Fair Report including contributions, special events, the new carnival, the arts center, the livestock shows, and fairground improvements. The total attendance was up by 2.3% at 306,370 people. A total of $1,288,835 in expenses and $1,423,571 in revenue resulted in a net income of $134,736.
TAX DEED
Bob Litz, Auditor, requested approval of a tax deed restoration resolution for Tax Deed 2606, RDID 64111. On October 1, 2019, the property was approved to be sold at the 2019 Tax Deed Sale. Payments were received by the Minnehaha County Treasurer on October 25, 2019, in the amount of $9,124.85 on behalf of the former owner of record. MOTION by Beninga, seconded by Karsky, to approve Resolution MC19-51, restoring Tax Deed #2606 to the former owner of record according to SDCL 10-25-41 and to authorize the County Treasurer to issue a Quit Claim Deed. By roll call vote: 5 ayes.
RESOLUTION MC19-51
WHEREAS, Minnehaha County holds under Tax Deed proceedings Tax Deed #2606, RDID #64111, covering property legally described as:
Tract 2A of Lee’s Addition in the Northeast Quarter (NE1/4) of Section 2, Township 101 North, Range 48 west of the 5th PM, except Tract 5 of McHardy Addition to the city of Brandon, Minnehaha County, South Dakota, according to the recorded plat thereof.
WHEREAS, Cory Lee, 2005 E. Aspen Blvd, Brandon, SD, 57005, is the prior record owner of the above described property; and 
WHEREAS, SDCL 10-25-41 provides for the restoration of title to said record owner upon payment of all taxes, interest, and cost represented in the Tax Deed; and
WHEREAS, Cory Lee has deposited $9,124.85 with the Minnehaha County Treasurer, this amount representing all the taxes, assessments, interest, and costs owing on said Tax Deed; now, therefore, be it
RESOLVED, by the Minnehaha County Commission, that the property be restored to Cory Lee, and that the Minnehaha County Treasurer is hereby authorized to issue a quitclaim deed thereto.

LIAISON REPORT
Commissioner Barth reported that the October 28, 2019, Planning Commission Meeting went well. Items such as the following were discussed: moving eligibilities, the removal of trees, and the suggestion for a location at 26th Street and Highway 101 to be annexed into the City.
OLD BUSINESS
Commissioner Barth reported on attending the October 28, 2019, Wall Lake Area Trail Informational Meeting. The meeting went well, and Commissioner Barth suggested to the group that the County may consider co-signing on a grant if they needed governmental support of the project.
MOTION by Heiberger, seconded by Beninga, to adjourn.  5 ayes.
The Commission adjourned until 9:00 a.m. on Tuesday, November 5, 2019.
