THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. May 12, 2020, pursuant to adjournment on May 6, 2020. Commissioners present were: Bender, Heiberger, and Karsky. Commissioners Barth and Beninga joined the meeting via Zoom. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

COVID UPDATE

Jason Gearman, Emergency Management Director, gave an update on COVID-19 in Minnehaha County. Case levels are being monitored, and the hospitals are still at a level where they can handle a surge.

PRESENTATIONS

Chris Lilla, Director of Equalization, presented on the Minnehaha County Equalization Department highlighting the following: maintenance of County data, real estate assessment, tracking and recording of sales data, establishment of growth and TIF Increment Value, administration of exempt programs, and future projects.

Monte Watembach, Information Technology Director, presented on the Minnehaha County Information Technology Department highlighting the following: completed projects, current projects, future opportunities, and staffing requests.

GRANT

DJ Buthe, Highway Superintendent, via Zoom, requested authorization to proceed with the 2020 Better Utilizing Investments to Leverage Development (BUILD) Planning Grant Application for the Maple Street Park Street Design. The BUILD Planning Grant is a federal grant opportunity for the investment in road, rail transit, and port projects. The Maple Street Park Street project is a joint project between Minnehaha County, the City of Sioux Falls, and the City of Brandon. HDR is the contractor for preliminary design of the project with proposed fees of $1,226,121.00 to complete the roadway design, a NEPA environmental review, and appraisals and negotiations with property owners. A 20% match was proposed to be competitive. The County’s share would be $142,230.04, the City of Sioux Falls’ share would be $56,401.10, and the City of Brandon’s share would be $46,592.60. If awarded, the County would need to pay the project costs and submit proof of those costs to the Department of Transportation for reimbursement. MOTION by Heiberger, seconded by Beninga, to proceed with the 2020 BUILD Planning Grant Application for the Maple Street Park Street Design. By roll call vote: 5 ayes.

RESOLUTION

DJ Buthe, Highway Superintendent, via Zoom, presented a resolution to authorize a local match for federal aid. A 20% match was proposed for the 2020 BUILD Planning Grant Application for the Maple Street Park Street project. Because the project is joint between Minnehaha County, the City of Sioux Falls, and the City of Brandon, the resolution would be needed to commit to the County’s share of the funding match. MOTION by Karsky, seconded by Heiberger, to approve Resolution MC20-30, a resolution authorizing local match for federal aid. By roll call vote: 5 ayes.

RESOLUTION MC20-30

RESOLUTION AUTHORIZING LOCAL MATCH FOR FEDERAL AID

WHEREAS, Minnehaha County supports the development of a Maple Street/Park Street corridor between the City of Sioux Falls and the City of Brandon; and

WHEREAS, Minnehaha County desires to provide increased economic development opportunities, connectivity and safety improvements through the development of a Maple Street/Park Street corridor; and

WHEREAS, the Federal Government has grant funds available through the Better Utilizing Investments to Leverage Development (BUILD) Grant Program; and

 WHEREAS, Minnehaha County desires to facilitate the application for the federal BUILD Grant program by committing the necessary funds toward the proposed local match by the Cities of Brandon and Sioux Falls; and

WHEREAS, under SDCL 10-12-17, use of general road and bridge funds for matching federal aid is permitted; and

NOW, THEREFORE, BE IT RESOLVED, that the Minnehaha County Board of County Commissioners supports the described application for the Maple Street / Park Street Corridor and will commit a 20% funding match of approximately $142,230.04 towards the completion of the project’s final design.

AGREEMENT

DJ Buthe, Highway Superintendent, via Zoom, presented an amendment to a utility relocation agreement between Minnehaha County and Minnehaha Community Water Cooperation for Highway Project MC17-01, County Highway 146 Reconstruction. During construction, it was discovered the water line relocation and the power line relocation were in conflict. Because changing the water line relocation was most the cost effective, an amendment was needed resulting in an additional cost of $20,697.25. MOTION by Heiberger, seconded by Karsky, to authorize the Chair to sign Amendment No. 1 to the Force Account Agreement between Minnehaha County and Minnehaha Community Water Corporation for utility relocation for Highway Project MC17-01, County Highway 146 Reconstruction, at a total cost of $183,378.25. INSURANCE

Carol Muller, Commission Administrative Officer, requested the approval of insurance proceeds for loss and business interruption on the Community Correction Center fire and requested authorization to record the proceeds in the Building Fund. Traveler’s Insurance has provided a settlement offer of $951,669.90 with $140,771.71 of the total for business interruption. Todd Flickema, SilverStone Group Director of Professional Risk Services, and Ryan Gebauer, SilverStone Group Vice President of Retail Risk Services, spoke on the claim process and how the settlement amount was determined. MOTION by Beninga, seconded by Barth, to approve insurance proceeds of $951,669.90 for loss and business interruption on the Community Corrections Center fire and authorize recording these proceeds to the Building Fund. LIAISON REPORTS

Upon the request of Commissioner Bender, the following individuals spoke in relation to a grant application through the Bureau of Justice Assistance’s Comprehensive Opioid, Stimulant, and Substance Abuse Program: Michelle Boyd, Programs & Services Manager; Erin Srstka, University of South Dakota Community Projects Director; and Crystal Johnson, State’s Attorney. The three primary components of the grant are 1) a diversion program through the State’s Attorney’s Office, 2) temporary housing, and 3) a peer support navigator.

Commissioner Heiberger gave the following liaison reports.

The deadline to submit legislative platform ideas to the South Dakota Association of County Commissioners is July 31, 2020. A meeting will be scheduled with the municipalities to work on legislative ideas collaboratively. Additionally, a call is scheduled for later in the week to discuss the convention that is scheduled for September 30, 2020.

The Siouxland Libraries will be closed until May 18, 2020, and then will start looking at partial openings. Certain library locations offer curbside pick-up at this time. The budget is looking flat for 2021 unless revenues come in better than expected.

The 4-H Office will remain closed until May 31, 2020. Staff are working on summer programing models.

Children’s Inn has been contacted to discuss the decreasing number of people going in for services.

Mental illness related bills through the Mental Illness HB 1183 Oversight Council were passed in the most recent legislative session including the ability to use telehealth with mental illness and the statewide funding of 211.

Commission Karsky suggested a legislative study on public safety answering points.

Commissioner Bender reported that it is budget season for the County noting that she will be meeting with some of her liaisons to go over budgets. Budgets are due on Friday.
