THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. May 6, 2020, pursuant to adjournment on April 28, 2020. Commissioners present were: Bender, Barth, and Karsky. Commissioners Beninga and Heiberger joined the meeting via teleconference and videoconference. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

Chair Bender called the meeting to order and explained the two items on the agenda would be switched in order to accommodate a separate meeting schedule for Kari Benz, Human Services Director.

AGREEMENT

Kari Benz, Human Services Director, presented a Case Management Agreement between Minnehaha County and the City of Sioux Falls to provide services within the City. Per the agreement, case management services would be provided by Minnehaha County to vulnerable individuals who have tested positive for COVID-19 and who have received clearance to be released from the Recovery Center. The City has an agreement with a hotel to operate as the Recovery Center. Expenses such as hotel room rent, hotel cleaning, damage to hotel rooms, transportation costs, direct personnel costs, and similar fees and expenses would be reimbursed to the County by the City up to $75,000. MOTION by Karsky, seconded by Barth, to authorize the Chair to sign the Case Management Agreement between Minnehaha County and the City of Sioux Falls terminating on December 31, 2020. By roll call vote: 5 ayes.

RESOLUTION

Carol Muller, Commission Administrative Officer, presented a resolution to address a public health crisis pertaining to coronavirus (COVID-19) and to declare and emergency. This resolution would rescind and replace Resolution MC20-21 passed on March 27, 2020. Jason Gearman, Emergency Management Director, provided the background, the measures taken, the goals, and the current status regarding COVID-19 in Minnehaha County. MOTION by Barth, seconded by Beninga, to approve Resolution MC20-29. By roll call vote: 5 ayes.

MINNEHAHA COUNTY RESOLUTION MC20-29

A RESOLUTION TO ADDRESS A PUBLIC HEALTH CRISIS PERTAINING TO CORONAVIRUS (COVID-19) AND TO DECLARE AN EMERGENCY

WHEREAS, COVID-19 has been designated a pandemic and the U.S. Centers for Disease Control and Prevention (CDC) has declared a public health emergency; and

WHEREAS, on April 10, 2020, the Secretary of the Department of Health for the State of South Dakota, with the consent and authorization of the Governor, declared a public health emergency to exist within Minnehaha County, South Dakota; and

WHEREAS, as of 12 noon on May 4, 2020, there have been 2,170 confirmed cases of COVID-19 within Minnehaha County, of which 657 are active; and 

WHEREAS, on April 28, 2020, the Governor issued Executive Order 2020-20 implementing South Dakota’s “Back to Normal Plan”; and

NOW, THEREFORE BE IT RESOLVED by the Minnehaha County Board of Commissioners that within Minnehaha County and outside of the exterior boundaries of an incorporated municipality the following guidelines should be met: 

•  Any establishment that serves food, alcohol or beverages should not exceed the greater of ten (10) patrons or the number of patrons for which the establishment can provide seating to all parties which is no less than six (6) feet apart from other parties.   Minors are not included in the party limits.  

•  Any establishment for events, and public gatherings, including entertainment and recreational venues, should not exceed the greater of ten (10) patrons or 50% of the occupant load as determined by the South Dakota Fire Marshall or the Minnehaha County Planning and Zoning Department.

BE IT FURTHER RESOLVED that A RESOLUTION TO ADDRESS A PUBLIC HEALTH CRISIS BY RECOMMENDING CERTAIN MEASURES TO SLOW THE COMMUNITY SPREAD OF CORONAVISUS (COVID-19) AND TO DECLARE AN EMERGENCY, passed by the Board of commissioners on March 27, 2020, is rescinded and that A RESOLUTION TO ADDRESS A PUBLIC HEALTH CRISIS PERTAINING TO CORONAVIRUS (COVID-19) AND TO DECLARE AN EMERGENCY is deemed necessary for the immediate preservation of the public peace, health, and safety, and as an emergency measure this resolution shall become immediately effective upon approval.
