THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. January 29, 2019, pursuant to adjournment on January 22, 2019. Commissioners present were: Barth, Bender, Beninga, Heiberger, and Karsky. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

REPORTS
The December 2018 Juvenile Detention Center Report, the Minnehaha County/Lincoln County Human Services 4th Quarter Report, the Minnehaha County/Lincoln County Human Services 2018 Annual Report, and the November 2018 Minnehaha County Coroner Report were received and placed on file in the Auditor’s Office. Jamie Phelps, Quality Assurance and Improvement Manager, was present to answer questions regarding the reports submitted by the Human Services Department and spoke on upcoming reports.

Special Personnel Action
Upon the request of Jen Adix, Human Resources Generalist, MOTION by Heiberger, seconded by Beninga, to convert the Lieutenant position in the Sheriff’s Office (pay grade 22) to a Captain position (pay grade 23) effective January 29, 2019.  5 ayes.
LIEN COMPROMISE
Melinda Storley, Commission Assistant, gave a briefing on an application for a compromise of lien for DPNO 66462 in the amount of $10,422.30. Public Defender and Court Appointed Attorney services were provided to the applicant’s spouse between April 2010 and March 2017. The applicant and her spouse were married in June 2017. They separated in November 2018 and are pending finalization of divorce. The applicant purchased a home at 215 N Hawthorne Ave, Sioux Falls, in January 2017. In order to sell the home, the applicant submitted a request to compromise the lien in full only as it applies to the real property with no payment. Commissioner Heiberger spoke on South Dakota Codified Law that allows for separate property to not be liable for debts incurred by a spouse. MOTION by Heiberger, seconded by Barth, to approve Resolution MC19-5. By roll call vote: 5 ayes.
RESOLUTION  MC19-5
WHEREAS, a County Aid Lien in the amount of $10,422.30, purports to exist in favor of Minnehaha County and against DPNO 66462 as Lienee, and 
WHEREAS, an application has been filed with the County Auditor stating such facts as provided for by Law, NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorize the Chair of the County Board and the County Auditor to execute the following:
Compromise and release the lien in full with no payment only as it applies to the real property legally described as Lot 1 in Block 3 of West Park Addition to Sioux Falls, Minnehaha County, South Dakota, according to the recorded plat thereof, located at 215 N Hawthorne, Sioux Falls; leaving the full amount of $10,422.30 against the lienee.

LIQUOR LICENSE TRANSFER
Olivia Larson, Deputy Auditor, was present for a public hearing to consider an application for the transfer of a 2019 Retail On-Sale Liquor License for the Red Rock Bar & Grill. Mitch Runge, Red Rock Bar & Grill Inc. took ownership of the Red Rock Bar & Grill from Rickey Runge, R&K Landholdings LLC, on January 1, 2019. The application was reviewed by the State’s Attorney’s Office, the Planning & Zoning Office, and the Sheriff’s Department. MOTION by Barth, seconded by Karsky, to approve the transfer of the 2019 Retail On-Sale Liquor License, RL-6163, from R&K Landholdings LLC to Red Rock Bar & Grill Inc on the licensed premises legally described as Tract 1B McBeth Addn in the NE1/4 and SE1/4 27-101-48 located at 48181 HWY 42, Brandon, SD. By roll call vote: 5 ayes.
BRIEFING
Mike Lynch, Forward Sioux Falls Director of Investor Relations, gave the 2019 investors briefing on Forward Sioux Falls including the governing structure, funding, initiatives, and partnerships, as well as Sioux Falls area construction values, job growth, employment rates, labor participation, and population.
David Johnson, Glory House Executive Director, gave a briefing to update the County on the Glory House Apartments affordable housing project in Sioux Falls, and spoke on the loss of a contract with the Federal Bureau of Prisons.
GRANT
Jason Gearman, Emergency Management Director, requested the termination of participation in the South Dakota Health Care Coalition and Ebola Grant programs. The grant programs are not a core function of the Emergency Management Department, and time could be better used for other work requirements of the department. Termination of their correlating sub-recipient grant agreements is required to end participation in the grant programs. MOTION by Beninga, seconded by Barth, to approve ending participation in the South Dakota Health Care Coalition and Ebola Grants through the termination of the following two agreements: 1) the State of South Dakota Sub-Recipient Agreement dated September 5, 2018, between Minnehaha County dba Minnehaha County Emergency Management and the South Dakota Department of Health, Office of Public Health Preparedness and Response for the South Dakota Health Care Coalition Grant; and 2) the State of South Dakota Sub-Recipient Grant Agreement dated May 10, 2016, between Minnehaha County dba Minnehaha County Emergency Management and the South Dakota Department of Health, Office of Public Health Preparedness for the Ebola grant.  5 ayes.
LEGISLATIVE UPDATE
Craig Dewey, Assistant Commission Administrative Officer, gave an update and status report of the 2019 Legislative Session on bills that impact Minnehaha County. The Commission directed Mr. Dewey to gather more information on Senate Bill 110 to bring forward at the next meeting where they will decide whether or not to issue a letter of support.
LIAISON REPORTS
Commissioner Barth reported on the January 28, 2019, Planning Commission Meeting where they discussed a hog barn, cattle barn, wedding barn, and gravel pit.
Commissioner Barth reported on attending the January 26, 2019, Minnehaha County Fire Chiefs Association Dinner where Chief LeRoy Koopman’s retirement from the Colton Fire Department was recognized.
OLD BUSINESS
Commissioners Heiberger and Bender urged everyone to stay warm and indoors.

Minnehaha County Highway Department requests bids for “Culvert Replacements,
 County Highway 159 Mile Route Marker 18.0 and County Highway 102 Mile Route Marker 30.8”.
Replace culverts at the two locations noted above. They will be 42” RCP and 36” RCP. The RCP will be provided by the County. Locations will be backfilled and finished with gravel. The County will pave these locations after the project is complete. 
Sealed bids shall be received by Minnehaha County Auditor’s Office, 415 N Dakota Avenue, Sioux Falls, SD  57104, not later than 10:15 a.m. Wednesday, February 20. Bids shall be publicly opened and read at the Auditor’s Office at 10:30am.
