Supplemental Retirement
Carey Deaver, Human Resources Director, presented on a change in the County’s supplemental retirement plan and requested approval of notice letters expressing the County’s intent to transition from one plan to another. The current plan is through ICMA-RC. The new supplemental retirement plan would be through the South Dakota Retirement System (SDRS). After a briefing to the Commission on February 16, 2021, employees and department heads were asked to provide feedback. The primary difference between the two plans is lower expense ratios overall with the SDRS plan. MOTION by Bender, seconded by Barth, to authorize the Commission Vice Chair to sign a notice to ICMA-RC of the County’s intent to transition to another supplemental retirement plan provider and to sign a notice to SDRS of the County’s intent to offer a Roth 457. BRIEFING & AGREEMENT
Judge Robin Houwman and Erin Srstka, University of South Dakota Community Projects Director, gave a briefing on the MacArthur Foundation’s Safety & Justice Challenge Renewal for 2021-2023 highlighting carry-over funding to the second cycle, programs aimed to assist justice impacted individuals, and successes from the first cycle. Tamien Dysart, Leaders of Tomorrow Co-Founder, spoke on the Leaders of Tomorrow (LOT) program for the purpose of providing needed skills and empowering justice impacted individuals to become effective leaders in the community. Serene Thin Elk, South Dakota Urban Indian Health Director of Behavioral Health, spoke on her involvement in LOT and the programming offered through South Dakota Urban Indian Health in areas such as culture, substance use, and trauma informed care. Ms. Srstka introduced her team from the University of South Dakota: Bridget Diamond-Welch, Associate Director of Center for Rural Improvement; Char Green-Maximo, Community Engagement Coordinator; and Clara Pierskalla, Research Associate II.
An agreement between Minnehaha County and the John D. and Catherine T. MacArthur Foundation was on the agenda for consideration. In September 2020, the Commission authorized the Safety and Justice Challenge Implementation Site Renewal grant application through the MacArthur Foundation. The agreement would accept the grant award resulting from the application in the amount of $700,000 to be disbursed to the County in two installments of $350,000 each. The purpose of the grant is to support criminal justice reform initiatives to reduce over-incarceration. MOTION by Barth, seconded by Bender, to authorize the Vice Chair to sign the agreement between Minnehaha County and the John D. and Catherine T. MacArthur Foundation for the acceptance of the Safety and Justice Challenge Implementation Site Renewal grant in the amount of $700,000 beginning on January 1, 2021, and ending on December 31, 2022. 3 ayes.

AGREEMENT
Jamie Phelps, Quality Assurance and Improvement Manager, via teleconference, presented the annual renewal agreement between Minnehaha County and Lincoln County for Human Services caseworker services. Lincoln County will reimburse Minnehaha County for its services at a rate of $6,995.27 per month. The total projected cost of the agreement is $83,943.29. MOTION by Bender, seconded by Barth, to approve the Agreement for Casework Services between Minnehaha County and Lincoln County beginning on April 1, 2021, through March 31, 2022. 3 ayes.
ALCOHOL LICENSE COMPLIANCE
Olivia Larson, Deputy Auditor, gave a briefing on recent alcohol compliance check failures. The Minnehaha County Sheriff’s Office conducted a compliance check of 61 alcohol beverage licensees in February 2021. Of the five failing licensees, one of them, MZT LLC dba Pump N Pak, is licensed by Minnehaha County. At the time of their next renewal, the failing licensee will be required to have a public hearing. Additionally, the South Dakota Department of Revenue will be imposing monetary penalties to the licensee.
RESOLUTION
Ben Kyte, Auditor, presented a resolution to request partial termination and release of the ground lease by removing certain properties. The County’s Work Release Center, Juvenile Detention Center, and certain land for expansion was encumbered under a ground lease due to the 2016A bond issuance. Because all proceeds related to the 2016A bond issuance have been paid, these properties are eligible to be removed from the ground lease. This would also allow the Work Release Center to be declared as surplus and sold at a future time. MOTION by Bender, seconded by Barth, to approve Resolution MC21-14, authorizing the Auditor to request that the Trustee, U.S. Bank, amend the ground lease by removing certain properties. WHEREAS, the Facilities located on the real estate described in Exhibit A attached hereto (the “Land”) were financed and or refinanced by only by the following series of Certificates (the “Related Certificates”):

NOW, THEREFORE BE IT RESOLVED by the Minnehaha County Board of Commissioners that the County hereby requests that the Trustee release the Land and the Facilities located on the Land described in Exhibit A, attached hereto and incorporated herein by this reference, and terminate the Ground Lease to the extent that it was applicable to the Land and such Facilities and assign, release and transfer to the County all property, money, investments and rights in the Land and such Facilities, subject to the Permitted Encumbrances described in the Ground Lease.

RESOLUTION
Shannon Schultz, Assistant Highway Superintendent, presented a resolution for participation in the SD Department of Transportation (SDDOT) Bridge Inspection Program. The U.S. Federal Highway Administration requires inspection of all bridges every two years and box culverts every four years. Mr. Schultz requested participation in the program using Civil Design, Inc. of Brookings, SD for the inspection work. BRIDGE REINSPECTION
PROGRAM RESOLUTION
FOR USE WITH SDDOT RETAINER CONTRACTS
WHEREAS, Title 23, Part 650, Subpart C, Code of Federal Regulations, requires initial inspection
of all bridges and reinspection at intervals not to exceed two years with the exception of reinforced
concrete box culverts that meet specific criteria. These culverts are reinspected at intervals not to
exceed four years.
THEREFORE, Minnehaha County is desirous of participating in the Bridge Inspection Program
using Bridge Replacement funds.
The County requests SDDOT to hire Civil Design, Inc. (Consulting Engineer) for the inspection
work. SDDOT will secure federal approvals, make payments to the Consulting Engineer for inspection
services rendered, and bill the County for 20% of the cost. The County will be responsible for
the required 20% matching funds.

LIAISON REPORTS
Commissioner Barth reported on last week’s Urbanized Development Commission Meeting and suggested the County Commission advocate for sound barriers on Highway 11 near the motorcycle race track.
Commissioner Heiberger reported the South Dakota Association of County Commissioners Convention will begin on March 17, 2021, with the Board of Directors Meeting starting on March 16, 2021.
NEW BUSINESS
Commissioner Barth suggested the Commission begin to strategize for the following considerations: a home rule charter, funding needs, and building needs.
