LIEN COMPROMISE
Melinda Storley, Commission Assistant, gave a briefing on an application for a compromise of lien for DPNO 7988 in the amount of $10,395.52. The lien represents Court Appointed Attorney, Fuel/Utilities, Rent, Food, Public Defender, and Public Advocate services recorded between February 1980 and February 2013. The lien is in the name of the applicant’s ex-spouse, who passed in April 2017. The couple were married in April 1990 and divorced in January 1994. The applicant is in the process of purchasing a home. The compromise requested was to release the lien in full upon payment of $493.92 to settle the amount owed during the time of the marriage. Commissioner Beninga expressed concerns about compromising the lien without verification of the applicant’s financial situation and whether or not the applicant received any assets after the death of the lienee. Carol Muller, Commission Administrative Officer, suggested deferring action on the lien compromise until later in the meeting if more time is needed to consider action. Upon the request of Commissioner Karsky, Eric Bogue, Chief Civil Deputy State’s Attorney, provided procedural guidance to the Commission. MOTION by Heiberger, seconded by Barth, to approve Resolution MC21-05. By roll call vote: 4 ayes. Commissioner Beninga voted nay.

WHEREAS, a County Aid Lien in the amount of $10,395.52, purports to exist in favor of Minnehaha County and against DPNO 7988 as Lienee, and
WHEREAS, said lienee’s ex-spouse has filed an application with the County Auditor stating such facts as provided for by Law,
NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorize the Chair of the County Board and the County Auditor to execute the following:
Remove the applicant from the lien upon payment of $493.92, leaving the remaining lien balance of $9,901.60 against the lienee.

PUBLIC COMMENT
Austin Carlson, 48763 256th Street, Garretson, brought forward concerns regarding a proposed Large Wind Energy Conversion System across the border from Minnehaha County in Rock County, MN. Mr. Carlson provided a map and documentation on the comment period made available by the Minnesota Department of Commerce, and he requested the Commission consider submitting written comments regarding the potential negative impacts on Minnehaha County residents. Scott Anderson, Planning & Zoning Director, spoke on his communications with Mr. Carlson and explained the zoning and notification requirements are likely to be different between Rock County, MN and Minnehaha County.
BRIEFING
Craig Dewey, Assistant Commission Administrative Officer, gave a briefing on the proposed Highway Facility design. Josh Muckenhirn, ISG Architect, was present for the briefing. Direction was given by the Commission to move forward with the current scope of work for the schematic design and design documents.
AGREEMENT
Craig Dewey, Assistant Commission Administrative Officer, presented a second Interim Agreement between Minnehaha County and JLG Architects for the Administration and Extension Building Remodel. The Interim Agreement approved on October 27, 2020, expired. The second Interim Agreement will remain in effect through February 15, 2021. The hourly rates and reimbursable expenses will remain the same. Additional services regarding office furniture inventory will be included at a cost of $75,000.00. MOTION by Bender, seconded by Beninga, to authorize the Chair to sign the second Interim Agreement between Minnehaha County and JLG Architects for the Administration and Extension Building Remodel ending on February 15, 2021. BRIEFING
Craig Dewey, Assistant Commission Administrative Officer, gave a briefing on the terms of sale for the County Gravel Pit and requested direction from the Commission to move forward. Commissioner Beninga brought up, for the purposes of notification to the public and potential buyers, the auction’s minimum reserve price of $950,000.00. Olivia Larson, Commission Recorder, explained the reserve price was published with the Notice of Auction in the official County newspapers. Eric Bogue, Chief Civil Deputy State’s Attorney, advised against allowing a 48-hour time period to make a down payment after the date of the sale. Direction was provided by the Commission to require a 10% down payment on the date of the sale, to require a letter from the buyers’ financial institution showing available funding to make the purchase, and to close no longer than 60 days after the sale.
PRESENTATIONS
Scott Anderson, Planning Director, presented on the Minnehaha County Planning & Zoning Department and highlighted the following: code enforcement, building and septic permits, the manufactured home ordinance, joint building inspections, the 2020 census, GIS mapping and Pictometry aerial imagery, the life jacket station at Wall Lake, the platting submittal process, staff reports and site visits, social media, Planning Commission Meetings, zoning text amendments, park improvements, potential for online building permit submittals, and planning efforts with municipalities.
Carey Deaver, Human Resources Director, presented on the Human Resources Department’s projects, goals, and COVID-19 impacts. Ms. Deaver also briefed the Commission on the annual workforce review identifying trends and/or significant changes in areas such as demographics, turnover, recruitment, and step distribution.
LIAISON REPORTS
Commissioner Beninga reported on attending an Urbanized Development Commission Meeting with Commissioner Karsky. Projects for Interstate 229 Exits 3 (Minnesota Ave) and 4 (Cliff Ave) have been moved back for one year.
Commissioner Heiberger reported the National Association of Counties Legislative Conference will be held virtually this year.
Commissioner Bender reported on attending Building Committee Subcommittee Meetings with Commissioner Barth. The meetings are held every other week to discuss the Administration and Extension Building projects with the architects and contractors.
Commissioner Bender gave a shout out to Commissioner Heiberger for having gone through the National Association of Counties High Performance Leadership Academy.
Commissioner Bender reported the Accessible Housing Advisory Board will meet on Thursday January 21, 2021.
