THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. June 9, 2020, pursuant to adjournment on June 8, 2020. Commissioners present were: Barth, Bender, Beninga, Heiberger, and Karsky. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

PUBLIC COMMENT

Pam Nelson, Treasurer, gave an update on the Treasurer’s Office. The wait time at the office is around two to two and a half hours since re-opening the building. Treasurer Nelson stated that more overtime will be needed to catch up on mail-in work. Additionally, concerns were brought forward regarding the length and placement of the line of customers waiting for service.

PUBLIC HEARINGS

Olivia Larson, Deputy Auditor, was present for a public hearing to consider approval of the 2020-2021 Retail On-Off Sale Malt Beverage & SD Farm Wine License Renewal Application for CC&F Retail Inc. dba Friendly’s Fuel Stop (Baltic). Baltic had an alcohol compliance check violation in the current licensing year. Blaine Corlett, CC&F Retail Inc. Vice President of Retail Operations, spoke on steps taken since the violation and policies in place to avoid future violations. MOTION by Heiberger, seconded by Karsky, to approve the 2020-2021 Retail On-Off Sale Malt Beverage & SD Farm Wine License Renewal Application for CC&F Retail Inc. dba Friendly’s Fuel Stop (Baltic). By roll call vote: 5 ayes.

Olivia Larson, Deputy Auditor, was present for a public hearing to consider approval of the 2020-2021 Retail On-Off Sale Malt Beverage & SD Farm Wine License Renewal Application for 38 Roadhouse. 38 Roadhouse had an alcohol compliance check violation in the current licensing year. Dan Winklepleck, 38 Roadhouse Owner, spoke on the alcohol compliance violation received and the steps taken to avoid future violations. MOTION by Barth, seconded by Heiberger, to approve the 2020-2021 Retail On-Off Sale Malt Beverage & SD Farm Wine License Renewal Application for 38 Roadhouse. By roll call vote: 5 ayes.

PRESENTATIONS

Tom Weerheim, Co-Chair of the Board of Mental Illness, gave a presentation on the board’s activities including the challenges from the past year, how COVID-19 has affected their operations, budgeting, the change of processes to be more electronically based, and the use of telehealth.

Dr. Jeff Luther, Rural Ambulance Quality Assurance Director, reported via teleconference on the 2019 Fourth Quarter Minnehaha County Emergency Medical Service Summary and provided a 2019 Year End Summary.

AGREEMENTS

Scott Anderson, Planning Director, presented an agreement between Minnehaha County and Lincoln County for the provision of building inspection services. The agreement would allow Lincoln County to provide building inspection services to Minnehaha County in the event that the Chief Building Official is unable to perform his/her duties due to illness or extended periods of paid time off. The County will pay Lincoln County $65.00 per inspection for the services upon receipt of an itemized statement. The agreement has a 24-month term. MOTION by Barth, seconded by Heiberger, to authorize the Chair to sign the agreement between Minnehaha County and Lincoln County for the provision of building inspection services beginning upon execution and remaining in effect for 24 months.  5 ayes.

DJ Buthe, Highway Superintendent, presented, via Zoom Video Conference, a Right-Of-Way Purchase Agreement for property owned by William K. Bly and Jon H. Bly. In conjunction with Banner Associates, Inc., the Highway Department is rebuilding four culverts in various locations. The Bly land is located along County Highway 105. In order to meet current safety standards, additional right-of-way is needed. MOTION by Heiberger, seconded by Barth, to approve the Right-Of-Way Purchase Agreement for 0.46 acres of land owned by William K. Bly and Jon H. Bly, for the amount of $3,956.00, and is legally described as Lot H-2 in the Northeast Quarter (NE¼) of Section 5, Township 102 North, Range 47 West of the 5th P.M., Minnehaha County, South Dakota, except Co. Aud. Lot H-1 contained therein, and except the East 660 Ft. of the North 660 Ft. therein.  5 ayes.

Kari Benz, Human Services Director, presented a Joint Participation Agreement among Minnehaha County, Sanford Health, Avera McKennan Hospital & University Health Center, the City of Sioux Falls, and the Sioux Empire Triage Center. The Sioux Empire Triage Center was incorporated on December 10, 2019, with the purpose of providing a mid-level care alternative for non-violent persons with drug and alcohol abuse and mental illness. The agreement provides for the creation of a cooperative forum and funding for the development of the Community Triage Center. The term of the agreement is three years. Per Exhibit D of the agreement, the County’s financial contribution includes $100,000 in 2020, $400,000 in 2021, $400,000 in 2022, and $400,000 in 2023. Erin Srstka, University of South Dakota Community Projects Director, was present and available for any questions. MOTION by Heiberger, seconded by Karsky, to authorize the Chair to sign the Joint Participation Agreement among Minnehaha County, Sanford Health, Avera McKennan Hospital & University Health Center, the City of Sioux Falls, and the Sioux Empire Triage Center for a term of three years.  5 ayes.

LIAISON REPORTS

Commissioner Heiberger reported that the Siouxland Libraries Bookmobile is back on the road. Additionally, bin deliveries re-started for daycare centers, and a new Grab and Go program has been started.

Commissioners Heiberger and Karsky reported on a Public Defender’s Office Advisory Board Meeting. The current budget is on track. Two new attorneys will be hired in August. During the meeting, Tracy Smith, Public Defender, was asked to create a five-year plan.

Commissioner Bender reported that Budget Hearings begin next Monday June 15, 2020.

Commissioner Barth reported on last week’s Museum Board Meeting. The Old Courthouse Museum housed the absentee board and ballot counting for the 2020 Primary Election and the City of Sioux Falls/School District Election. Museum staff assisted during the election process.

Commissioner Barth reported on attending a Minnehaha County Conservation District Meeting. Board member positions will be up for election this Fall. Thirty-five acres of tree were planted. A grant is being considered for the funding of a trail at Wall Lake. It was reported that the South Dakota Game, Fish, & Parks wants the trail to be made of concrete and be wheelchair accessible.

Commissioner Heiberger reported on a South Dakota Association of County Commissioners call where COVID-19 related funding from the State to the Counties was discussed, along with the annual convention to be held in September. Commissioners were encouraged to respond to the e-mail they received from the association regarding the convention that included a convention survey.

Commissioner Beninga reported on meeting with the City of Sioux Falls Mayor and the Sioux Empire Fair Board to discuss options for the 2020 Sioux Empire Fair. Commissioner Heiberger reported a carnival vendor was found. However, 4-H Achievement Days will take place separately from the fair.

NEW BUSINESS

Commissioner Barth reported that a bill for over $21,000 included in Item 3, Bills To Be Paid, stemmed from a habeas case for a serious crime.

OLD BUSINESS

Bob Litz, Auditor, reported on the 2020 Primary Election held in conjunction with the Combined City of Sioux Falls/School District Election. There will be a recount for Legislative District 9. The City will take petitions after their canvas for a recount in a city council race. Absentee voting was heavily utilized for the elections. Due to the increased use of absentee voting, Commissioner Beninga suggested an Ad Hoc Committee be formed to review the absentee process.

Commissioner Barth made comments regarding current events taking place in the United States noting that the country is better when united and quoted the Pledge of Allegiance stating “liberty and justice for all.”

MOTION by Barth, seconded by Karsky, to adjourn.  5 ayes.
