COMMISSION MEETING
THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M. May 26, 2020, pursuant to adjournment on May 12, 2020. Commissioners present were: Barth, Bender, Beninga, Heiberger, and Karsky. Also present were Olivia Larson, Commission Recorder, and Margaret Gillespie, Senior Deputy State’s Attorney.

David Heinold, Planner, gave the first reading and requested authorization for the Auditor to publish a Notice of Hearing for an amendment to the 1990 Revised Zoning Ordinance for Minnehaha County to rezone from A-1 Agriculture District to C Commercial District on property legally described as Tract 3 Wold Tracts (Ex H-1) in the NW1/4 NW1/4, Section 27-T103N-R49W, Minnehaha County, SD, located south of the County Highway 122 and South Dakota State Highway 115 intersection. MOTION by Heiberger, seconded by Barth, to authorize the Auditor to publish a Notice of Hearing for June 23, 2020, to consider the rezoning amendment, #20-02, An Ordinance Amending The 1990 Revised Zoning Ordinance For Minnehaha County By Rezoning Certain Property. PUBLIC COMMENT
Commissioner Karsky introduced Jesse Fonkert as the new Executive Director of the Minnehaha County and Lincoln County Economic Development Association. Mr. Fonkert spoke on his career history, his new position, and looking forward to working with the Commission.
PRESENTATIONS
Crystal Johnson, State’s Attorney, presented on the Minnehaha County State’s Attorney’s Office including topics such as: the reorganization of felony attorneys, mental health court, the impact of COVID-19 on the office and court system, digital discovery, budgeting, and staffing levels.
Jason Gearman, Director of Emergency Management, gave a presentation on the Minnehaha County Sheriff’s Office Emergency Management highlighting the role of the department, the Police Reserve, Rural Fire & Ambulance, the Rescue Squad, the Dive Team, grant management, the impact of COVID-19 on the office, and other services.
RESOLUTION
Carol Muller, Commission Administrative Officer, presented a resolution to rescind Resolution MC20-29, thus removing restrictions on public gatherings and establishments. It was announced that the Minnehaha County Administration Building will re-open on June 3, 2020. This is not to be confused with the Minnehaha County Courthouse, which has remained open throughout the pandemic. MOTION by Barth, seconded by Heiberger, approve Resolution MC20-31 to rescind Resolution MC20-29 regarding public health and to declare an emergency. By roll call vote: 5 ayes.

A RESOLUTION TO RESCIND RESOLUTION 20-29 REGARDING PUBLIC HEALTH
AND TO DECLARE AN EMERGENCY
WHEREAS, COVID-19 has been designated a pandemic and the U.S. Centers for Disease Control and Prevention (CDC) has declared a public health emergency; and
WHEREAS, on April 10, 2020, the Secretary of the Department of Health for the State of South Dakota, with the consent and authorization of the Governor, declared a public health emergency to exist within Minnehaha County, South Dakota; and
WHEREAS, on April 28, 2020, the Governor issued Executive Order 2020-20 implementing South Dakota’s “Back to Normal Plan”, local governments are encouraged to follow the guidelines which include, but are not limited to, the following criteria to initiate the plan: a downward trajectory of documented cases within a 14-day period in areas with sustained community spread, no evidence of clusters which pose a risk to the public, and evidence that hospitals are able to reserve 30 percent of their hospital beds to treat COVID-19 patients; and
WHEREAS, as of May 18, 2020, there is a 14-day negative trajectory in new active daily COVID-19 positive cases in Minnehaha County; and
WHEREAS, as of May 18, 2020, COVID-19 related hospitalizations are able to be managed by Avera and Sanford Health, the local health care systems;
WHEREAS, Minnehaha County will continue monitor and assess community data;
NOW, THEREFORE BE IT RESOLVED by the Minnehaha County Board of Commissioners that within Minnehaha County and outside of the exterior boundaries of an incorporated municipality:
1.Resolution 20-29, titled A Resolution to Address a Public Health Crisis Pertaining to Coronavirus (COVID-19) and to Declare an Emergency is rescinded.
2.Minnehaha County encourages the public to be diligent in their behavior to slow the spread of the virus and to protect individuals who may be vulnerable to serious complications or death.
3.Businesses, establishments, events, and public gatherings should follow the South Dakota Department of Health and the Center for Disease Control and Prevention guidelines and best practices for COVID-19, to protect the health and safety of their employees and patrons.
4.This resolution is hereby deemed necessary for the immediate preservation of the public peace, health, and safety, and as an emergency measure this resolution shall become effective immediately upon approval.

GRANT
Michell Boyd, Programs & Services Manager, presented on the Comprehensive Opioid, Stimulant, and Substance Abuse Program Grant application. The purpose of the grant is to provide financial and technical assistance to develop, implement, or expand comprehensive efforts to identify, respond to, treat, and support those impacted by illicit opioids, stimulants, and other drugs or abuse. The County will aim to develop strategies to support access to treatment, recovery, and diversion for substance abuse, with a focus on methamphetamine and alcohol. Erin Srstka, University of South Dakota Community Projects Director, was available to answer questions during the presentation. MOTION by Karsky, seconded by Barth, to approve the submission of the Comprehensive Opioid, Stimulant, and Substance Abuse Program Grant application. By roll call vote: 5 ayes.
CHANGE ORDER
Jacob Maras, Senior Project Engineer, gave a briefing on Change Order #1 to the contract with Reede Construction Inc for Project #MC17-01, Highway 146 Reconstruction. The change order includes the following: an increase of $5,040.00 for grove cleaning; a decrease of $538,217.40 for salvage and stockpile asphalt mix and granular base material; an increase of $172,912.00 for unclassified excavation; an increase of $404,800.00 for base course; an increase of $9,430.00 for type 2 temporary fence; a decrease of $262,070.00 for base course, salvaged asphalt mix; and an increase of $139,701.20 for salvage topsoil. MOTION by Heiberger, seconded by Barth, to authorize the Chair to sign Change Order #1 to the contract with Reede Construction Inc for Project #MC17-01, Highway 146 Reconstruction, for a new contract amount of $9,353,918.32. MALT BEVERAGE LICENSE RENEWAL
Olivia Larson, Deputy Auditor, presented two 2020-2021 renewal applications received by the Auditor’s Office for Retail On-Off Sale Malt Beverage & South Dakota Farm Wine Licenses for establishments within Minnehaha County from Wall Lake Oil Co and MAS LLC dba The Riviera by Roccos. The applications were reviewed by the Sheriff’s Department, Planning & Zoning Department, and State’s Attorney’s Office. There were no objections or violations reported within the current license period. MOTION by Barth, seconded by Karsky, to approve the 2020–2021 Retail On-Off Sale Malt Beverage & South Dakota Farm Wine License renewals for Wall Lake Oil Co and MAS LLC dba The Riviera by Roccos. AGREEMENTS
Craig Dewey, Assistant Commission Administrative Officer, presented a Consulting Agreement between Minnehaha County and The Tegra Group for County office renovations. Tegra Group will provide services in order to reach the following milestones: an approved schematic design, an approved construction/relocation timeline, an approved disruption avoidance plan, and a corresponding approved project budget. Per the agreement, the County will pay a fixed fee of $93,000.00 in monthly installments of $15,500.00 through October 30, 2020. Additionally, Tegra will be reimbursed for routine out-of-pocket expenses such as lodging, food, travel, mileage, printing, copying, and reproduction. MOTION by Beninga, seconded by Heiberger, to authorize the Chair to sign the Consulting Agreement for Minnehaha County Offices Renovations between Minnehaha County and The Tegra Group, Inc. beginning on March 1, 2020, and ending upon project completion at a fixed fee of $93,000.00. 5 ayes.

Per the agreement, the County will pay a fixed fee of $185,700.00 in monthly installments of $12,750.00 for the first six months and then $8,400.00 per month for the following 13 months. Additionally, Tegra will be reimbursed for routine out-of-pocket expenses such as lodging, food, travel, mileage, printing, copying, and reproduction. LEGISLATIVE PRIORITIES
Craig Dewey, Assistant Commission Administrative Officer, gave a briefing on the 2021 legislative priorities. The first meeting to collaborate with the City of Sioux Falls and other municipalities has been scheduled for June 5, 2020. Commissioners were directed to notify Mr. Dewey of any priorities to consider for submission.
LIAISON REPORTS
Commissioner Barth reported on attending a Southeastern Council of Governments Executive Board Meeting where Lynn Keller Forbes spoke on alternative ways to use grant funds. Commissioner Barth suggested enhancing remote meeting capabilities.
Commissioner Heiberger reported that Court Administration is having a difficult time replacing court reporters who have resigned.
OLD BUSINESS
Commission Karsky announced it was his 36-year wedding anniversary.
Carol Muller, Commission Administrative Officer, gave an update on the Commission Meeting and Budget Hearing schedule. There will be no Commission Meeting on June 2, 2020, due to the Primary Election. The next Commission Meeting will be on June 9, 2020. Budget Hearings are scheduled for June 15, 16, 29, and 30, 2020.
