An ordinance amending the 1990 Revised Zoning Ordinance for Minnehaha County.
The Minnehaha County Board of Commissioners adopted Ordinance MC16-168-20 on September 29th, 2020. This ordinance amended Ordinance MC16-90, the 1990 Revised Zoning Ordinance for Minnehaha County by amending Article 12.06 – Mobile Homes/Manufactured Homes – to amend requirements for manufactured home placements by conditional use permit.
The entire ordinance is on file in the office of the County Auditor and available for inspection during regular business hours.

THE MINNEHAHA COUNTY BUILDING COMMITTEE CONVENED AT 8:00 A.M. October 6, 2020, pursuant to adjournment on September 1, 2020. Committee Members present were: Barth (via Zoom Videoconference), Bender, Beninga, Heiberger, Karsky, and Kriens. Committee Members Litz and Muller were absent.
MOTION by Karsky, seconded by Heiberger, to approve the September 1, 2020, Building Committee Meeting Minutes. 6 ayes.
FACILITIES PROJECTS UPDATE
Mark Kriens, Facilities Director, gave an update on the following projects: the Information Technology Remodel, the Public Defender First Floor Remodel, the Human Services Remodel, the Energy Plant chiller replacement, various security upgrades, and additional projects.
GRAVEL PIT UPDATE
Craig Dewey, Assistant Commission Administrative Officer, gave an update on the sale of the County’s Gravel Pit. The Appraisal Board members are visiting the site individually due to social distancing, travel schedules, and quarantine requirements. The Appraisal Board will meet via teleconference the week of October 12, 2020, to set the appraisal value. The Planning and Zoning Department confirmed that a purchaser of the land would need to apply for a Conditional Use Permit if their intention was to operate a mining operation. The fee for sale by auction is $3,000. For the purposes of the record, the name of the auction company was listed as Goeman Auction in the briefing memo, but should have been Wieman Auction. The Committee directed staff to schedule the auction for November 2020. DJ Buthe, Highway Superintendent, spoke on the scheduling of the auction in regard to feedback from a contractor who indicated that they would have cash available at the end of the year.
FACILITY COMMITTEE UPDATE
Craig Dewey, Assistant Commission Administrative Officer, gave an update on the status of facility construction and renovation. The Construction Manager At-Risk contract has been drafted and reviewed by Tegra Group and Mr. Dewey. The Highway Committee held design meetings where initial concept designs were reviewed, site selection was discussed, and Henry Carlson Construction was contacted to work on a cost model. Proposals were received from responding architecture firms for the Administration & Extension Buildings. Mark Kriens, Facilities Director, responded to questions from the Committee regarding process for the remodels, funding, and the potential disruption to employees during the remodels. Commissioner Karsky requested Mr. Kriens attend the Public Defender Advisory Board Meeting on October 27, 2020. Commissioner Beninga left the meeting.

Carey Deaver presented the Letter of Resignation received from Minnehaha County Auditor Robert Litz. Auditor Litz was present and spoke on his resignation. The resignation of Robert Litz, Minnehaha County Auditor, will be effective December 31, 2020.
OLD BUSINESS
Due to scheduling conflicts, Jill Franken, City of Sioux Falls Health Department, was allowed to speak early via Zoom Videoconference. Ms. Franken provided an update on COVID-19 regarding the City’s new mask policy for employees, the increase of positive cases, the hospitalization rate, and the recommendation to follow social distancing guidelines. Demand for services at the Recovery Center is being monitored to ensure needs will be met going into the fall season. Siouxfalls.org/COVID19 is a website available for people to stay up-to-date on COVID-19 in the Sioux Falls area. Commissioner Bender expressed interest in issuing a mask policy for Minnehaha County employees that reflects what the City has implemented. The other Commissioners agreed. The topic will be discussed at the October 6, 2020, 1:30 p.m. Department Head Meeting.
PERSONNEL
Carey Deaver, Human Resources Director, requested approval of changes to the Minnehaha County Employee Handbook for minor edits, clarifications, or updates to reflect current procedures. PUBLIC COMMENT
Jason Gearman, Emergency Management Director, spoke on current weather conditions raising concerns for the fire danger level. At the October 13, 2020, Commission Meeting, a fire ban resolution will be brought forward for consideration.
TAX DEED PAYMENT PLAN

APPROVAL OF PROPERTY TAX PAYMENT PROPOSAL ON
PARCEL RECORD 059074
WHEREAS, Minnehaha County has received notice from the owner of record that property taxes are delinquent by five years; and
WHEREAS, a total of $15,298.27 in back taxes, penalties, and interest is owed on the property; and
WHEREAS, the owner of record has requested support from the county to assist with re-payment options over a twenty-four (24) month period; and
WHEREAS, the owner of record, Brian Ray Matthies, proposed the following payment plan to the county commission for consideration in order to satisfy all outstanding taxes, penalties, and interest:
• Initial Payment of $637.42 due by November 2, 2020.
• Payment of $637.42 due by the last business day of each following month through October 2022.
• Final Payment of any additional unpaid property taxes, plus any additional accrued interest and penalties due by the 30th of November 2022.
WHEREAS, in the event that the owner of record does not pay all back taxes, penalties and interest owing on property record 059074 in accordance with the aforementioned terms, Minnehaha County may proceed with the tax deed process.
NOW, THEREFORE BE IT RESOLVED, by the Minnehaha County Board of Commissioners, the proposed payment plan, as described above is hereby approved for property record 059074.

BRIEFINGS
Kim Adamson, Finance & Budget Officer, via Zoom Videoconference, gave a briefing on the State’s COVID Recovery Fund claims status. Based on claims filed and approved thus far, the County expects to claim a full allocation of $12.7 million by the end of the year. The funds will be recorded in the General Fund as Federal Grant Revenue.
Paul Schaefer, representing the Independent Order of Odd Fellows, gave a briefing on their grave marking project. The project is to raise funds and place grave markers on currently unmarked graves. LIAISON REPORT
Commissioner Barth reported items approved at the September 28, 2020, Planning Commission Meeting were not appealed. This included the rock and gravel operation north of Corson.
NEW BUSINESS
Commissioner Karsky spoke on October being Breast Cancer Awareness Month noting that his wife is a 17-year breast cancer survivor.
Commissioner Heiberger reported of the South Dakota Association of County Commissioners Annual Convention. Commissioner Karsky was elected as the Second Vice President. A breakout session was held by the South Dakota Public Assurance Alliance during the convention regarding public comment.
Commissioner Karsky congratulated Commissioner Heiberger on her successful year as the South Dakota Association of County Commissioners President.
