Specifically, the City Council will be considering Ordinance No. 643, amending Chapter 15-6-11, R-3: High Density Residential District, Lot And Yard Regulations.

THE MINNEHAHA COUNTY COMMISSION CONVENED IN A JOINT SESSION WITH THE SIOUX FALLS CITY COUNCIL AT 5:00 P.M., September 28, 2021, pursuant to adjournment on September 28, 2021. Commissioners present were: Barth, Bender, Heiberger, and Karsky. Commission Beninga was absent. Also present was Rhonda Bennett, Deputy Auditor. 

City Council Members present: Brekke, Jensen, Kiley, Neitzert, Selberg, Soehl, City Council Members absent were Erickson and Starr.  Mayor Tenhaken was also absent.

Chair Karsky called the meeting to order.

MOTION by Barth, seconded by Bender, to approve the agenda. 4 ayes. The City concurred.

ORDINANCE

 Scott Anderson, Planning and Zoning Director, was present for the public hearing and second reading of proposed Amendment of MC30-02 the Revised Joint Zoning Ordinance for Minnehaha County and the City of Sioux Falls by adding Medical Cannabis Dispensary as a permitted special use in the C Commercial District and I1 Light Industrial District and to add a definition of Medical Cannabis Dispensary in Article 24.00. MOTION by Barth, seconded by Bender, to adopt Ordinance MC30-43-21. The entire ordinance is on file in the office of the County Auditor and available for inspection during regular business hours. No proponents or opponents spoke.  By roll call vote: 4 ayes. The City concurred.

BRIEFINGS

Dr. Charles Chima, Public Health Director, gave a briefing on Covid and the homeless population. He stated they the key to reducing transportation from the shelters to the clinics involved isolation and quarantines. He also stressed that making the vaccine available to the homeless population has help during the recent surge. 

Bill Earley, Executive Director of the Link, and Madeline Miller, Nurse Manager, gave a presentation on the success of the first four months of operation for the Link. Madeline Miller stated that they were able to help with mental health crisis stabilization and withdrawal management. The Link has had community impact by reducing incarcerations and ER visits. 

PUBLIC COMMENT

Linda Oliver, Sioux Falls, commented on the COVID vaccine. 

 MOTION by Heiberger, seconded by Bender, to adjourn. 4 ayes.  

The City concurred. 

The Commission adjourned until the Regular Commission Meeting on Tuesday, October 5, 2021.

ORDINANCES

 Scott Anderson, Planning and Zoning Director, was present for the public hearing and second reading of proposed Amendment #21-05 to the 1990 Revised Zoning Ordinance for Minnehaha County amendment by adding Medical Cannabis Dispensary as a permitted special use in the C Commercial District and I1 Light Industrial District and to add a definition of Medical Cannabis Dispensary in Article 26.00. MOTION by Heiberger, seconded by Bender, to adopt Ordinance MC16-171-21. The entire ordinance is on file in the office of the County Auditor and available for inspection during regular business hours. No proponents or opponents spoke.  By roll call vote: 5 ayes. 

Eric Bogue, Chief Civil Deputy State’s Attorney, gave a second reading of an ordinance establishing the licensing and regulations of Medical Cannabis Dispensaries in Minnehaha County.  No action was taken and a revised second reading with be given at the October 5, 2021 Commission Meeting. This time will allow the commissioners to review changes in the ordinance since the first reading. 

BUDGET

Ben Kyte, Minnehaha County Auditor presented the final FY2022 budget for Minnehaha County. ADOPTION OF THE ANNUAL BUDGET FOR MINNEHAHA COUNTY, SOUTH DAKOTA

Whereas, (7-21-5-thru 13), SDCL provides that the Board of County Commissioners shall each year prepare a Provisional Budget of all contemplated expenditures and revenues of the County and all its institutions and agencies for such fiscal year and,

Whereas, the Board of County Commissioners did prepare a Provisional Budget and cause same to be published by law, and 

Whereas, due and legal notice has been given to the meeting of the Board of County Commissioners for the consideration of such Provisional Budget and all changes, eliminations and additions have been made thereto.

 Now therefore be it resolved, That such provisional budget as amended and all its purposes, schedules, appropriations, amounts, estimates and all matters therein set forth,  shall be approved and adopted as the Annual Budget of the appropriation and expenditures for Minnehaha  County, South Dakota and all its institutions and agencies for calendar year beginning January 1, 2022 and ending December 31, 2022 and the same is hereby approved and adopted by the Board of County Commissioners of Minnehaha County, South Dakota,  this 28th day of September, 2021.  The Annual Budget so adopted is available for public inspection during normal business hours at the office of the County Auditor Minnehaha County, South Dakota.  The accompanying taxes are levied by Minnehaha County for the year January 1, 2022 through December 31, 2022.

WHEREAS, Thomas Sullivan is the prior record owner of the above-described property; and

AGREEMENTS

Upon the request of Jason Gearman, Director of Emergency Management, MOTION by Barth, seconded by Heiberger, to authorize chair to sign the third lease extension between First Dakota National Bank and Minnehaha County for the Fusion Center. 5 Ayes. 

Jason Gearman, Director of Emergency Management, presented the 2022 Local Emergency Management Performance Grant (LEMPG). The LEMPG provides 50% salary and benefits reimbursement for the following positions: 95% of EM Director’s duties and 60% of Assistant EM Director’s duties. MOTION by Beninga, seconded by Barth, to authorize chair to sign the 2022 LEMPG Sub-Recipient Agreement managed by the South Dakota Office of Emergency Management. 5 Ayes. 

Upon the request of Carol Muller, Commission Officer, MOTION by Barth, seconded by Bender, to approve the purchase of CivicPlus software pending legal review. 5 ayes. CivicPlus is a meeting management software that will increase public transparency, reduce printing, and increase efficiency for creation of agendas and minutes.  Chair Karsky reported the project was a collaboration with the Auditor, Commission Staff, and IT. 

LIAISON REPORTS

Commission Bender reported on The Link Board meeting and the new Executive Director of the Link, Bill Earley. She also attended the Sioux Falls Development Foundation Meeting held at Augustana University. New projects at Augustana and Foundation Park were discussed.    

Commissioner Barth asked Scott Anderson, Planning and Zoning Director, to report on the Planning and Zoning meeting. He reported that the final development plan for the Wedding Barn near the VA cemetery and Great Bear Gravel Pit plan had been approved. 

NEW BUSINESS

Chair Karsky mentioned the search for a new Director of the Multi-Cultural Center Intergovernmental Board. 

MOTION by Barth, seconded by Bender, to recess at 9:56 am until 10:05 am. 5 ayes. Commissioner Heiberger left the meeting before entering into Executive Session. 

MOTION by Barth, seconded by Bender, to enter into Executive Session pursuant to SDCL 1-25-2 (1), (3) and (4).  4 ayes.
