The regular meeting of the Brandon Valley Board of Education, Brandon, SD was held at 6:30 p.m. on the 25th of October 2021 at the Brandon Valley High School Community Room with the following members present:  Renee Ullom, Gregg Ode, Ellie Saxer, Gregg Talcott, Nick Scott.  Absent:  None.  Also present were Superintendent Jarod Larson, High School Principal Mark Schlekeway, Middle School Principal Brad Thorson, Intermediate School Principal Nick Skibsted, Intermediate School Assistant Principal Rick Pearson, and Director of Instruction Sherri Nelson.

Renee Ullom called the regular meeting to order at 6:30 p.m., beginning with the Pledge of Allegiance.

Motion by Saxer, seconded by Scott to approve the agenda as amended to add Personnel Item #6, Approve resignation from Jillian Grabinski, BE First Grade Teacher effective December 3, 2021, to include liquidated damages of $1,500.  Motion carried.

District Patron, Ryan Hofer, spoke to the Board of Education on how thankful he was to be part of the Brandon Valley School District.   At tonight’s meeting, Mr. Hofer read a letter that his son, Sam, wrote to him from football practice.  Sam’s 8th grade football team wrote letters of gratitude to people they felt made a difference in their lives.  Sam’s letter was to his parents for supporting him and cheering him on with football.  Mr. Hofer is so proud of the coaching staff for making this a priority in teaching our young people to be responsible and thankful adults.  Hofer also added his appreciation to all the School District Staff and Board of Education for the support given to make Brandon Valley the BEST school district in the state of South Dakota!

Administrative reports were presented.   Superintendent Jarod Larson reported on the following:

The COVID-19 Information Website: https://brandonvalley.k12.sd.us/covid/covid.html is the centralized communication hub.   THE MESSAGE:  If you are sick – stay home! 

Gifted Education Programming Workgroup Process:  Objectives:  Review current challenges, evaluate similar school strategies, develop options, utilize a SWOT Analysis in evaluation of options, develop a programmatic recommendation.  Committee result:  Develop programmatic recommendation of Elementary – Middle School Gifted Education.  Committee meetings as follows:  9/21/2021, 10/05/2021, and 10/19/2021.  The Board of Education will receive the Committee Report and recommendation in November.

Fourth Grade Orchestra Programming Workgroup Process:  Objectives:  Review current challenges, evaluate similar school strategies, develop options, utilize a SWOT Analysis in evaluation of options, develop a programmatic recommendation.  Committee result:  Develop programmatic recommendation.  Committee meetings as follows:  9/23/2021, 10/07/2021, and 10/21/2021. The Board of Education will receive the Committee Report and recommendation in November.

Accountability Report Card update.  The public release of the district accountability report card has been released and the State and District School Report Card data is available on the school web-site.  A State of the Schools address will follow this release in November.

A tentative District 10 & 25 Legislative breakfast is sent for Wednesday, December 8, 2021 at 7:30 a.m. the Governor’s budget address is scheduled for Tuesday, December 7, 2021.

2021-22 School Calendar items include the following:  Thursday, November 11, 2021 ~ no school, Veteran’s Day; Wednesday-Friday, November 24-26, 2021 ~ no school, Thanksgiving Break; Wednesday, December 22, 2021 ~ two-hour early dismissal; Thursday, December 23 through Friday, December 31, 2021 ~ no school, winter break; School resumes, Monday January 3, 2022.

The BVHS Addition priorities include General Classrooms, Ground Floor Special Education, Science Lab Classrooms, Maximize Land Usage/ Upgrade East Facility Face, all while minimizing the impact to parking.

Lastly, Dr. Larson presented a picture collage commemorating Renee Ullom’s 2019 South Dakota Outstanding Board Member of the Year honor as chosen by the Associated School Boards of South Dakota (ASBSD).  This is a huge honor to present this display in Mrs. Ullom’s honor.  

Motion by Talcott, seconded by Scott to approve the following general business items:

1. Approve Change order #6 for Inspiration Elementary for an additional amount of $12,334.00 to add  HDMI, USB and speaker cabling at future SmartBoard/Projector Locations, as presented.

2. Approve agreement by and between the Brandon Valley School District #49-2 and South Dakota State University College of Nursing for clinical learning program, effective October 25, 2021, automatically renewed July 1 of each year, as presented.

3. Approve proposal from Ace Signs for installation of new exterior electronic signs at BV Middle School, BV Intermediate School, Brandon Elementary, Valley Springs Elementary, Robert Bennis Elementary, and Fred Assam Elementary in the amount of $130,072.00 as presented, paid from ESSER I Funds.

Motion carried.

Motion by Saxer, seconded by Ode to approve the following personnel items:

1. Approve recommendation to hire Cathy Finn, part-time BVIS Child Nutrition worker, $14.75/hour, effective October 26, 2021.

2. Approve resignation from Jennifer Duscher, part-time FAE Child Nutrition worker, effective October 18, 2021.

3. Approve recommendation to hire Wesley Gravning II, Substitute Driver, paid according to the 2021-22 Transportation Hiring Schedule, effective October 26, 2021. 

4. Approve resignation from Lana Schwab, part-time IE Child Nutrition worker, effective October 29, 2021.

5. Approve a new substitute for the 2021-22 school year as follows:  Isabel Sylvanie.

6. Approve resignation from Jillian Grabinski, BE First Grade Teacher, effective December 3, 2021 to include liquidated damages of $1,500.

Motion Carried.

Board reports were presented.  Board Member Gregg Talcott reported on Student Activities, Curriculum and Technology Committee, commenting that the two programming workgroup processes are now complete and he appreciated the process and involvement of our stakeholder groups.  Talcott also acknowledged our Dance Team’s first place showing at the State AA Cheer and Dance Competition along, which was hosted this year at Brandon Valley.  He also noted that many of the other fall sports teams ended their seasons with hardware as well.  Congratulations to all student athletes and coaches on these great seasons! Lastly, Talcott noted that the Band Turkey Supper will be held Tuesday, October 26, 2021.

Board Member Ellie Saxer reported on the City Affairs & Legislation Committee.  An Associated School Boards of South Dakota (ASBSD) regional meeting is up coming and it is our intent to discuss the standing positions and resolutions at an upcoming board of education meeting for additional information.  Saxer also thanked Mr. Hofer for his “good news” report at tonight’s meeting.

Board President Renee Ullom reported on Alternative Education.  Things are going very well at TeachWell and programs continue to grow.

Travel Reports were reviewed.

Sealed bids will be received by the City of Brandon, South Dakota, at City Hall at 304 Main Avenue, P.O. Box 95, Brandon South Dakota 57005 until 2:00pm, local time, November 9th, 2021 and then will be publicly opened at 308 Main Avenue and read immediately thereafter.

The project generally consists of installing approximately 700 new water meters with an automated water meter reading system which the City will purchase and supply.

PLANNING & ZONING COMMISSION

The Brandon Planning & Zoning Commission met in regular session at 6:30 p.m. on October 7, 2021 at the Brandon City Council Chambers. 

Roll call was taken.  Members present were Commissioners Brian Heidbrink, Thomas Nichols, Brookes Noem, Chuck Parsons, Rob Schoeneman and Alica Thiele.  Also present were Alderman Tim Jorgenson, Building Official Paul Clarke, City Administrator Bryan Read and Mayor Jim Heinitz.  Absent: City Engineer, Tami Jansma.

Commissioner Noem moved Commissioner Nichols seconded to approve the agenda.  Motion carried.

 

Commissioner Heidbrink moved Commissioner Schoeneman seconded to approve the consent calendar which contained the following items: a plat of Pearson’s Subdivision Lots 12A & 13A and a plat of Tallgrass Addition Lot 16 Block 6.  Motion carried.

Commissioner Thiele moved Commissioner Nichols seconded to approve the minutes of the September 16, 2021 regular meeting and the minutes of the September 21, 2021 special meeting.  Motion carried.

A Home Occupation Permit Application was presented for 105 E. Maureen Drive.  Applicants Danielle Milner and David White were present.  Danielle & David want to open an outdoor sports sales & service business out of their home to include online sales, sear-coating and hydro-dipping.  Will be installing an exhaust fan with carbon filtration in their garage to control fumes, painting will be done in a paint booth.  Commissioner Heidbrink moved Commission Parsons seconded to approve the home occupation permit with the conditions that the painting is done with a contained spray booth that has carbon filtration system.  Motion carried.

A public hearing was held, as advertised, to consider updates to the Zoning Ordinance as it relates to the minimum lot area per unit in the R-3 High Density Residential District.  Wade Behm, Hegg Construction, was present for discussion.  Commissioner Parsons moved Commissioner Heidbrink seconded to make recommendation to City Council for approval.  Motion carried.

At 6:44 p.m. Alderman Tim Jorgenson called to order the Board of Adjustment meeting.

Roll call was taken.  Members present were Commissioners Brian Heidbrink, Thomas Nichols, Brookes Noem, Chuck Parsons, Rob Schoeneman and Alica Thiele.  Also present were Alderman Tim Jorgenson, Building Official Paul Clarke, City Administrator Bryan Read and Mayor Jim Heinitz.  Absent: City Engineer, Tami Jansma.

Commissioner Parsons moved Commissioner Nichols seconded to approve the agenda.  Motion carried.

A Variance Application was presented for 313 S. 1st Avenue.  Applicant Matt Russell was present for discussion.  Matt wants to pour a concrete driveway to line up with the current detached garage.  City Ordinance allows detached accessory structures to be within 5’ of the side property line; driveways/parking pads need to be 7’ from the side property line.  Matt is requesting a variance so his driveway could line up with the detached garage.  Commissioner Heidbrink moved Commissioner Parsons seconded to approve the variance application as presented.  Motion carried.

A Variance Application was presented for 101 N. Heritage Road.  Applicant Wade Dumont, Kwik Trip, was present for discussion.  Wade is requesting driveways that will exceed the 60’ maximum currently allowed by City Ordinance.  Wade is requesting 3 – 35’ driveways, which are needed for truck traffic delivering product, etc.  Commissioner Parsons moved Commissioner Nichols seconded to approve the variance application as presented, with the literal interpretation depriving the applicant of the following rights – multiple driveways exceeding the maximum cumulative driveway width of similar businesses in the General Business District.  A roll call vote showed Nichols, Noem, Parsons, Schoeneman, Thiele aye; Heidbrink nay.  Motion carried.  

At 7:04 p.m., having no further business, Commissioner Parsons moved Commissioner Thiele seconded to adjourn the Board of Adjustment meeting.  Motion carried.

At 7:04 p.m. Alderman reconvened the Planning & Zoning Commission meeting.

Ben Soles was present for discussion on the possibility of re-zoning Lot 1 Block 7 Tallgrass Addition for higher density residential.  Ben would like to build townhouses on this property.  

Building permits for September were presented: #20210407 - #20210540.  No action required.

At 7:47 p.m.having no further business, Commissioner Parsons moved Commissioner Heidbrink seconded to adjourn the Planning & Zoning Commission meeting.  Motion carried.

This project consists of reconstructing 5.3 miles of County Highway 149 beginning at 254th Street and ending near Colton, South Dakota.  The project generally includes salvaging the existing highway surfacing, grading, installing pipe culverts and drainage structures, placing interim surfacing, and installing erosion control measures and miscellaneous related items.

Carey Deaver, Human Resources Director, presented the annual health and dental insurance review. Due to a lower than expected increase in medical and pharmacy claims, a 5% increase in health insurance premiums was recommended for 2022 vs a 15% 2022 budget increase. A 5% increase in dental insurance premiums was also recommended due to a lower than expected increase in dental costs. MOTION by Bender, seconded by Barth, to approve 2022 Health and Dental Insurance premiums. 4 ayes. 

LIEN COMPROMISE

Melinda Storley, Commission Assistant, gave a briefing on an application for a compromise of lien for DPNO-46282 in amount of $24,725.87. The lien represents Public Defender and Poor Relief services. The applicant is in the process of purchasing the home and needed to resolve the lien before moving forward with the purchase. The compromise request was to release the lien in full upon payment of $8,000.00. MOTION by Heiberger to compromise the lien in the amount of $7,000.00 and payable within one year. Motion denied for lack of second.

BRIEFING

Mike Lynch, Forward Sioux Falls Director of Investor Relations, gave a presentation on Forward Sioux Falls including the governing structure, funding, Forward Sioux Falls history, growing property tax base & quality jobs, attracting talent and workforce development programs, Foundation Park, USD Discovery District, business advocacy, and other initiatives along with public/private partnerships. Forward Sioux Falls 2026 new initiatives include housing fund, career connections, REACH, cyber/it park, Innovation Center of Excellence, and Future Sioux Falls strategic plan. Finally, Mr. Lynch highlighted the national acclaim that the area has received. 

Scott Wick, President and CEO of the Sioux Empire Fair Association, gave a presentation on the 2021 Sioux Empire Fair Report including contributions, special events, community service, fairground improvements, livestock, arts center, and commercial and food vendors. There were no attendance comparisons to the 2020 vs 2021 Sioux Empire Fair. Some of the COVID-19 protocols were still used in 2021. A total of $1,062,960 in expenses and $1,450,346 in revenue resulted in a net profit of $387,386. 

Jessica Wells, LifeScape Foundation President, gave a presentation on LifeScape and highlighted the following: the history of LifeScape, the individuals they serve, and their programs and services. The presentation also highlighted legislation related to the pay for the direct support professionals as well as future projects that were undertaken by the organization. 

HIGHWAY SURPLUS PROPERTY AUCTION RESULTS 

Upon request of Steve Groen, Highway Superintendent, MOTION by Barth, seconded by Heiberger, to deposit $139,115.00 in Proceeds from the September 28, 2021 Purple Wave Auction of Highway Surplus Property to the Highway and Bridge Fund. By roll vote: 4 ayes. 

EQUIPMENT PURCHASE

BRIEFING

Melinda Storley gave a briefing on the use of a consent agenda for future commission meetings. A consent agenda is part of the meeting agenda where various types of items are grouped and approved in one action instead of making multiple motions for individual approval. There would be an opportunity for the public and members of the Commission to remove items from the consent agenda to allow for detailed discussion on a particular item. A sample agenda was presented that showed what items would be included on a consent agenda. The use of the consent agenda will be discussed at a later meeting. 

LIAISON REPORTS

Commissioner Barth gave a briefing regarding the Planning Commission meeting noting that one issue was tabled for a future meeting as well the potential sale of a building eligibility from one parcel to another. 

NEW BUSINESS

Carol Muller presented a letter addressed to U.S. Representative Johnson from the Minnehaha County Commission supporting the flexibility in the use in the American Rescue Plan Act funding which passed in the U.S. Senate. No action was needed from the Commission but Chair Karsky wanted to discuss the letter before signing.

The Petitioner, Rebakah B. Dehaai, being first duly sworn, deposes and states as follows:

1. I am a resident of Minnehaha County, Sioux Falls, South Dakota, and have been a bona fide resident of said county for the last six months prior to the filing of this Petition;

2. That the minor children’s father, Sean Dougherty, (hereinafter referred to as “Father”), and I were divorced on August 16, 2021 after the Court in Brule County, the Honorable Bruce Anderson, entered written Findings of Fact and Conclusions of Law and signed a Judgment and Order for Divorce upon Father’s default within the divorce proceedings. See 07DIV21-03.

3. That during Father and my relationship, two children were born, namely: Parker James Dougherty (DOB 05/14/2019) and Paxton Ellis Dougherty (DOB05/14/2019). Parker and Paxton are twins. SEE EXHIBIT A.

4. That prior to our divorce, Father and I moved to South Carolina as I was offered an employment opportunity. That while in South Carolina, Father failed to pass a drug test in order to secure employment; engaged in an extramarital affair; and subjected me to both physical and mental abuse.

5. That in August 2020, Father returned to South Dakota due to the passing of his grandmother. I believe Father did not have any intention of returning to South Carolina to be with the children and myself. Father, to my knowledge, only returned to South Carolina once to retrieve his items as the children and I moved back to South Dakota to have more support from my family. 

6. I informed Father that the children and I would be returning to South Dakota.

7. Once the children and I were in South Dakota, Father made minimal effort to see the children. In fact, his communication with me mainly revolved around finances.

8. Father has not seen the boys since September 2020.

9. Father, while having a child support order in place, has not made full or consistent payments. See 07REC20-019. In Fact, Father is currently in arrears of approximately $5,000.

10. That I believe Father is residing and working in Chamberlain, South Dakota.

11. That Father has not provided physical or emotional support for the children since late July/early August 2020.

12. That I am now seeking a change in the minor children’s surnames as I believe it is in the children’s best interest if their last names were the same as mine. I am also seeking a change of name of the minor’s biological half-brother’s names in order for all four (4) of my sons to have the same last name. 

13. That the children are of an age wherein the surname change would not create unreasonable difficulties. 

14. That I request this Court for an Order amending Parker James Dougherty’s name to Parker James Dehaai, pursuant to SDCL 21.37-3, not for any fraudulent purposes but for the reasons herein;

15. That I request this Court for an Order amending Paxton Ellis Dougherty to Paxton Ellis Dehaai, pursuant to SDCL 21.37-3, not for any fraudulent purposes but for the reasons herein;

16. That I am unaware of any objections to the change of name

WHEREFORE, your Petitioner prays the Court as follows:

1. That the name of Parker James Dougherty’s name be changed to Parker James Dehaai; and
