PLANNING & ZONING COMMISSION

The Brandon Planning & Zoning Commission met in regular session at 6:30 p.m. on January 6, 2022 at the Brandon City Council Chambers. 

Roll call was taken.  Members present were Commissioners Brian Heidbrink, Thomas Nichols, Brookes Noem, Chuck Parsons, Rob Schoeneman and Alica Thiele.  Also present were Alderman Tim Jorgenson, Building Official Paul Clarke, City Administrator Bryan Read and Mayor Jim Heinitz.  Absent: City Engineer Tami Jansma.

Commissioner Nichols moved Commissioner Noem seconded to approve the agenda, with the removal of item #9 per the applicant’s request.  Motion carried.

Commissioner Parsons moved Commissioner Heidbrink seconded to approve the consent calendar which contained the following items: a plat of Hidden Valley Country Estates Addition Tracts 18A & 18B and a plat of Knochenmus Addition Tract 3.  Motion carried.

Commissioner Thiele moved Commissioner Nichols seconded to approve the minutes of the December 2, 2021 regular meeting, as amended.  Motion carried.

Jeremy Sanford, 316 S. Country Club Avenue, was present for discussion.  Jeremy was present representing the property he owns at 700 S. 8th Avenue in Brandon.  Jeremy addressed the Conditional Use Application for 704 S. 8th Avenue that is on the agenda, for a proposed commercial kennel.  Jeremy has concerns with noise, smell, sanitary upkeep, potential for him to lose tenants, parking and traffic flow.

Sara Shoffner, 112 W. River Oak Court, was present for discussion.  Sara was present for discussion regarding the Conditional Use Application for 704 S. 8th Avenue that is on the agenda, for a proposed commercial kennel.  Sara works at Agape Counseling, 700 S. 8th Avenue and has concerns with noise and her ability to perform her job as a counselor.  

Erin Sanford, 316 S. Country Club Avenue, was present for discussion.  Erin was present for discussion regarding the Conditional Use Application for 704 S. 8th Avenue that is on the agenda, for a proposed commercial kennel.  Erin founded Agape Counseling Center in 2013.  Erin has concerns with noise, smells and sounds that will affect her business.  Erin asked the Planning & Zoning Commission to deny the request.  

Dan Plut, 1012 E. Aspen Blvd., was present for discussion.  Dan was present for discussion regarding the Conditional Use Application for 704 S. 8th Avenue that is on the agenda, for a proposed commercial kennel.  Dan has concerns with pet waste, smells, dogs barking and property values dropping. 

A Conditional Use Application was presented for 1805 N. Walnut Avenue, Suite West.  Applicant Kenneth Barber was present.  Kenneth wants to open a medical cannabis cultivation establishment at 1805 N. Walnut Avenue, Suite West.  Kenneth described their process of cultivation, all being done inside, to include growing, processing and selling to a dispensary.  The building will be a 3,000 square foot facility with a security system.  Commissioner Heidbrink moved Commissioner Nichols seconded to approve the application as presented, with the condition that the applicant obtains the necessary licenses from the City and State.  Motion carried.

A Conditional Use Application was presented for 1328 E. Cedar Street.  Applicant Steve Rickenbach was present for discussion.  Steve is requesting to open an on-sale malt beverage license for 1328 E. Cedar Street.  Commissioner Parsons moved Commissioner Schoeneman seconded to approve the application as presented.  Motion carried.

A Conditional Use Application was presented for 704 S. 8th Avenue.  Applicant Suzie Meyer, 705 S. 8th Avenue, was present for discussion.  Suzie is requesting to open a commercial dog boarding facility at 704 S. 8th Avenue.  Suzie addressed neighbor concerns of: noise - stating that staff will be present and would take barking dogs inside; odors – pet waste will be cleaned up/hosed off promptly.  Property is fenced and will have 26 kennels to start with.  Dogs will stay overnight and will be inside during the nights.  No staff present daily from 9:00pm-6:00am.  

There are 9 parking spaces on-site, with set times for pick-ups/drop-offs.  Would use the closest vet in case of an emergency, otherwise would be customer choice.  

Connie Plut, 1012 E. Aspen Blvd. was present for discussion.  Connie asked if the applicant could guaran

tee that property values would not decrease, on properties around the proposed commercial dog boarding facility.  Commissioner Nichols moved Commissioner Parsons seconded to approve the conditional use application as presented, with the following conditions: anytime an animal is outside they be supervised by a staff member, clean up pet waste immediately, maintain a 6’ tall privacy/opaque fence, no dog breeding or dog sales on the premise, kenneling only, no dogs shall be housed outside, dogs will be allowed outside the building for play and relief only during business hours and when the premise is supervised.  Motion carried.

Building permits for December were presented: #20210668 - #20210681.  No action required.

Year-end building permit totals were presented.  No action required.

At 7:46 p.m. having no further business, Commissioner Heidbrink moved Commissioner Nichols seconded to adjourn the Planning & Zoning Commission meeting.  Motion carried.

PUBLIC COMMENT

LEGISLATIVE REDISTRICTING 

Ben Kyte, Auditor, provided a briefing on the Legislative Redistricting for Minnehaha County. Since mid-December, the Auditor’s Office has been working with the Minnehaha County GIS Department, and our voter registration database vendor, Total Vote, to develop updated and new voter splits to correctly identify the new or modified boundaries for legislative districts and municipalities. As of January 25th, we were able to apply those new splits into Total Vote to complete the updates resulting from the redistricting process for Minnehaha County. The 2020 census required the state legislative district boundaries to be updated to reflect changes in population. Concurrent with that change, several municipalities within Minnehaha County have updated their ward boundaries as a result of population changes. The changes necessitated the need to adjust our voter registration database to correctly identify voters’ jurisdictions. The boundaries of the eight existing and one new legislative district were included in the change, along with wards of three municipalities. During this process we updated the records of some 35,000 voters to place them in new districts or wards. The voter splits identify the voting jurisdiction that each registered voter resides in and includes some or all of the following information: Precinct, Legislative District, School District, Municipality, Municipality Ward, Circuit Court District, Water District, Soil Conservation District, and Heartland Consumer Power. The updates required the addition of 57 new splits and changes to 137 existing splits. Minnehaha County will now maintain a total of 194 active voter splits. Finally, Total Vote was recently upgraded to allow for Precinct mapping. Minnehaha County GIS staff took advantage of this opportunity to update Total Vote to map our existing precinct boundaries. Minnehaha County is the first county in South Dakota to have a precinct mapping Total Vote, which will allow the Auditor’s Office to more easily adjust precinct boundaries in the future. 

DEBT ISSUANCE 

Ben Kyte, Auditor, provided a briefing on the upcoming debt issuance. The Auditor’s Office has engaged Colliers Securities to issue $7.4M of debt to finance the construction needs of Minnehaha County’s new Highway Shop, Extension Building remodel, and refinancing of existing debt. On January 26th, Moody’s Investors Service affirmed Minnehaha County’s credit rating at Aa1. Colliers expects the interest rate for this issuance, along with marketing of the debt to investors, to take place on February 9th. Proceeds are expected to be made available to our trustee on March 15th. 

MACARTHUR FOUNDATION 

Amos Abu, Housing Clinic Coordinator with the City of Sioux Falls, provided an overview regarding the personal invitation from the MacArthur Foundation to submit a Letter of Interest to apply for grants funds to support an Equitable Housing Demonstration Project. This project is to focus on the planning and development of housing programs that identify ways to address the needs of the racially disproportionate foot print of our criminal justice-involved. Minnehaha County would act as the identified fiscal pass through should we be selected as grant a receipt. Demonstration awards to support both planning and implementation are expected to range from $620,000.00 to $775,000.00 per site. Erin Srstka with University of South Dakota spoke about how the funds would be used and some of the funds would be used for a facilitator to develop the housing. The grant goals include promoting and supporting the work of community partners to develop a much-needed housing option for this subset of homeless individuals who have high recidivism rates for incarceration. These types of housing programs would provide intensive case management and appropriate community support to optimize the trajectory of the participants, with the goals focusing on remaining out of custody and establishing a support system to build stability and become self-reliant.

MOTION by Barth, seconded by Bender, to authorize Minnehaha County’s participation as the fiscal agent in the submission an RFP by the Accessible Housing Advisory Board for grant funds from the MacArthur Foundation. 5 ayes.

AGREEMENTS

Upon request of Steve Groen, Highway Superintendent, MOTION by Barth, seconded by Bender, to authorize Chair to sign a professional services agreement with Civil Design, Inc. for preliminary design of Project MC22-06, Structure 50-101-080 Bridge Replacement. 5 ayes.

Upon request of Steve Groen, Highway Superintendent, MOTION by Beninga, seconded by Karsky, to authorize the Chair to sign an agreement with Civil Design, Inc. for construction administration of Project MC21-10 Structure 50-330-066 Rehabilitation. 5 ayes.

BRIEIFING

Monte Watembach, Information Technology Director, gave a briefing on the Minnehaha County Information Technology Department highlighting completed projects, current projects, and future opportunities. The three main projects that were highlighted were the continuation of the migration of applications off of the AS400, upcoming implementation of case management for the State’s Attorney’s office, and the migration to Microsoft Office 365. 

LIEN COMPROMISE

Melinda Storley, Commission Assistant, gave a briefing on an application for a compromise of lien for DPNO 59120 in the amount of $29,810.26. The liens represent legal fees for the lienee, poor relief, and legal representation for children. The applicant is in the process of purchasing a home and needs to resolve the lien before moving forward with the purchase. The compromise request was to release the lien with no payment.

MOTION by Barth, seconded by Bender, to deny the compromise of lien DPNO-59120 in the amount of $29,810.26. By roll call vote: 4 ayes 1 nay Karsky.

 LEGISLATIVE UPDATE

  Tyler Klatt, Assistant Commission Administrative Officer, gave a briefing on the 2022 Legislative bills that impact Minnehaha County, specifically highlighting House Bills (HB) 1053 which was amended to allow the use of a bond election for the issuance of bonds as outlined in the bill only if the county has not done so in the previous five years. The bill was also deferred until February 3rd. The new bills that have been added since the last update include: House Bills (HB) 1089, 1104, 1110, 1114, 1140, 1154, 1168, and 1203 as well as Senate Bills (SB) 90, 91,123, 124, and 138. HB 1089 would revise provisions related to abandoned mobile or manufactured homes which has been withdrawn. HB 1104 would revise provisions related to the location of courtroom facilities. HB 1110 would revise a provision related to the appointment of a guardian ad item or a special advocate to represent an abused or neglected child. HB 1114 would revise a notice requirement for a hearing on the comprehensive plan in a joint jurisdictional area. HB 1140 would permit the use of tribal identification cards when registering to vote. HB 1154 would reduce the number of years delinquent property taxes required for a county to issue a tax deed on a property. HB 1203 would require taxing districts to hold a public hearing when increasing property tax revenues relative to the previous year. SB 90 would revise certain provisions regarding local building codes. SB 91 would revise provisions regarding the use of certain lights by county highway department authorized vehicles. SB 123 would provide for certain requirements in the absentee ballot application process. SB 124 would protect the integrity and accuracy of voter registration information. SB 138 would clarify provisions related to filing a petition to refer an ordinance or resolution. 

Gary Tuschen, Executive Director of the Carroll Institute, provided an update on the Carroll Institute along with the proposed legislation to help with a building project. 

LIAISON REPORTS  

Commissioner Karsky reported on the Link annual meeting with no changes in the officers and other items related to the Link.

Commissioner Barth gave an update on the building eligibility that was discussed at the last planning commission meeting and how the area to the west may be annexed in the future. 

Commissioner Bender reported on the Sioux Falls Development Foundation meeting and the amount of interest that the Fair Grounds Task Force has generated with the group.

THE MINNEHAHA COUNTY BUILDING COMMITTEE CONVENED AT 8:00 A.M. February 1, 2022, pursuant to adjournment on December 7, 2021. Committee Members present were: Commissioners Barth, Bender, Beninga, and Heiberger; Facilities Director Kriens, Auditor Kyte, and Commission Administrative Officer Muller. Also present were Kym Christiansen, Commission Recorder, and Eric Bogue, Chief Civil Deputy State’s Attorney.

MOTION by Barth, seconded by Beninga, to approve the December 7, 2021, Building Committee Meeting Minutes. 7 ayes.

JUVENILE DETENTION CENTER PROJECT 

Tyler Klatt, Assistant Commission Administrative Officer, gave a briefing regarding the Juvenile Detention Center project. The Requests for Proposals for both the Architect/Construction Manager-at-Risk have published. There has been considerable interest in the project as RSVP’s are starting to be received for the two available tour dates. The necessary data has been submitted to Paul Garnos for the JDC feasibility study. 

1900 W. RUSSELL AVE AUCTION 

Tyler Klatt, Assistant Commission Administrative Officer, gave a briefing regarding the auction on 1900 W. Russell Ave. The minimum bid price for the property needs to be determined prior to entering into an agreement with Sutton Auction. A broker’s opinion from February 2021 identified a price of $1,071,758.00 or $5.50/square feet. The Minnehaha County appraisal board established a property value of $1,000,000.00 in August 2021. With the assumption that the existing structure would be demolished by any future buyer, it has been suggested to consider a lower minimum price in order to account for that cost. Chuck Sutton with Sutton Auctioneer was present to discuss the valuation report that was received and provide their recommendations regarding if the building should be demolished prior to the sale. Discussion was held on whether to move forward with the demolition. Auditor Kyte stated that this project would be eligible for funds under the American Rescue Plan Act but certain requirements that would need to be met if those funds would be used. It was the consensus of the committee to have Facilities Director Kriens obtain additional estimates for the demolition for review. 

908 N WEST AVE

Tyler Klatt, Assistant Commission Administrative Officer, gave a briefing regarding the direction on to how to proceed with 908 N West Ave. The property is not under contract with a listing agent. Previously, the property was listed with NAI from March 14, 2018-March 31, 2019. The contract was extended two additional times by the commission (March 2019-March 2020 and March 2020-March 2021). It was the consensus of the committee to perform a request for proposals for a realtor to list the property. 

YOUTH LIVESTOCK BUILDING

Scott Wick, Sioux Empire Fair CEO, presented a plan to replace the youth livestock building at W.H. Lyons Fair Grounds. The building would replace the numerous livestock barns that are in poor conditions. The original proposal was for $1.3M (2019 dollars) which would now be $1.7M. The project has since been scaled down to a 100x100 structure with a cost between $227,441 and $278,133. The building would have the ability to expand in the future. The Sioux Empire Fair would like to move forward with the project as soon as bids are confirmed with the goal of having the building ready for the 2022 fair. This project will be put on future Commission meeting agenda.
