The special meeting of the Brandon Valley Board of Education, Brandon, SD was held at 6:30 p.m. on the 16th of August, 2021 at the Brandon Valley High School Performing Arts Center with the following members present:  Renee Ullom, Gregg Ode, Gregg Talcott, Ellie Saxer, and Nick Scott.  Absent:  None.  Also in attendance were Superintendent Jarod Larson, Business Manager Paul Lundberg, along with several patrons of the Brandon Valley School District #49-2.

Renee Ullom called the special meeting to order at 6:30 p.m., beginning with the Pledge of Allegiance.

Motion by Scott, seconded by Ode to approve the agenda as presented.  Motion carried.

The purpose of this meeting was to revisit the 2021-22 Pandemic Response Plan agenda action item as follows:  a) Masking Protocol.  

Community input this evening included thirty-six (36) patrons of the Brandon Valley School District; thirty (30) individuals who support a voluntary only masking protocol, and six (6) patrons who support a mandatory masking protocol.  Thank you to all who came to share your input or support someone who spoke.

The Brandon Valley Board of Education members also discussed their feelings on masking with all members (Saxer, Talcott, Scott, Ode, and Ullom) supporting a voluntary masking protocol and fell that would be the most suitable for the 2021-22 school district.

As previously discussed at the last Board of Education meeting, the BVSD #49-2 2021-22 Pandemic Response plan suggests a Masking Protocol of Voluntary Masking.  Motion by Saxer, seconded by Talcott to approve this recommendation of Voluntary Masking, as presented. On a roll call vote, the following voted aye:  Saxer, Talcott, Ode, Scott, Ullom; voted nay: none.  Motion carried.

Motion by Saxer, seconded by Talcott to adjourn the meeting at 9:11 p.m.  Motion carried.

The Brandon City Council met in a briefing session at 5:30 p.m. on Thursday, August 12, 2021 at the Council Chambers at 308 S Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Vickie David, Barb Fish, Tim Jorgenson, David Kull and Mayor Jim Heinitz.  Present via phone conference call was Jack Parliament.  Other’s present were: City Administrator, Bryan H Read; Finance Officer, Christina Smith; Public Works Director, Rollie Hoeke; Police Chief, Jamie Steffel and Golf Course Manager, Andrew Bauer.  Absent: None.

The Council discussed items on the agenda for the upcoming August 16, 2021 regular Council meeting.  No formal action was taken.

Tom Wullstein, 201 S. Augusta Avenue, Brandon, SD, was present for discussion.  Tom owns Brandon Pharmacy at 116 E. Holly Blvd. and was present to express his support of medical cannabis.  Tom expressed his disapproval with the requirement that all medical cannabis dispensaries be located in freestanding buildings.

ONE-DAY ALCOHOL LICENSE

A public hearing was held, as advertised, to consider a one-day alcohol license for Double D Saloon, for a street dance to be held on September 11, 2021.  Alderwoman Clark moved Alderman Kull seconded to approve the one-day alcohol license as presented.  Motion carried.

GOLF COURSE RETAINING WALL DESIGN PROPOSAL

Alderwoman Fish moved Alderwoman Clark seconded to approve the annual salary adjustment for Cory Carlson, to step 10-12 on the wage scale, $24.80 per hour, effective August 11, 2021.  Motion carried.

DRAFT MEDICAL CANNABIS REGULATIONS

Lisa Marso, Brandon City Attorney, was present for discussion and presented a proposed draft ordinance for Medical Cannabis.  Lisa recommended measuring from property line to property line, instead of building to building, as locations relate to schools.  Further discussion held on limiting the number of dispensaries up to 3, distance between businesses.  No action required at this time.  

BRANDON 90 PRELIMINARY PLANS

The Administration Committee report was heard.  Preliminary plans for Brandon 90 were presented.  Developer Darrell Viereck was present.  Alderman Jorgenson moved Alderwoman Clark seconded to approve the preliminary plans for the Brandon 90 development, as presented.  Motion carried.

ENCORE PARK PRELIMINARY PLANS

Alderman Jorgenson moved Alderwoman Clark seconded to approve the preliminary plans for the Encore Park development, as presented.  Motion carried.

Alderman Jorgenson moved Alderman Kull seconded to approve pay application #4 to Asphalt Surfacing Company in the amount of $549,164.44 for the Rushmore area reconstruction project.  Motion carried.

UTILITY BILLING PRINTING PROPOSAL

The Water & Sewer Committee report was heard.  Alderman Jorgenson moved Alderwoman Clark seconded to approve the quote from Qualified Presort Service for the monthly utility bill printing.  Motion carried.

SALARY REVIEW AND ADJUSTMENT

Alderman Jorgenson moved Alderwoman Clark seconded to approve the annual salary adjustment for Donovan Carpenter, to step 16-7 on the wage scale, $32.46 per hour, effective August 24, 2021.  Motion carried.

WEST SIDE TRUNK SANITARY SEWER EXTENSION COST ESTIMATE

A preliminary cost estimate of $3,907,000.00 was received from DGR Engineering for the west side trunk sanitary sewer extension.  

At 7:37 p.m. Alderwoman Clark moved Alderman Kull seconded to go into executive session to discuss potential litigation, per SDCL 1-25-2.3.  Motion carried.  At 7:44 p.m. Mayor Jim Heinitz declared the executive session ended.

At 7:44 p.m. on a motion by Alderwoman Clark seconded by Alderwoman Fish the meeting was adjourned.  Motion carried.

City of Brandon

______ ORDINANCE #634 ______

AN ORDINANCE ESTABLISHING A STORMWATER UTILITY FEE FOR 

THE CITY OF BRANDON, SOUTH DAKOTA 

WHEREAS, the City of Brandon, South Dakota has certain responsibilities in managing stormwater within its boundaries; 

WHEREAS, these responsibilities require continual upkeep and maintenance of the stormwater system throughout the City of Brandon, South Dakota;  

WHEREAS, the City has determined the need for a revenue source to create, maintain, operate, repair, remove, or otherwise modify the stormwater system;

WHEREAS, the imposition of a stormwater utility fee offers additional financial management options for improving drainage services;

WHEREAS, the stormwater utility fee provides a revenue source for education and mitigation costs to reduce pollution of local bodies of water by supporting the pollutant discharge elimination system requirements for the municipal stormwater drainage system which includes the ponds, streams, and rivers; 

WHEREAS, it is in the best interests of the residents of the City that stormwater management be funded by the imposition of a stormwater utility fee which allocates the cost of stormwater management to all property owners.   

NOW, THEREFORE, be it enacted by the City Council of the City of Brandon, South Dakota that Chapter 14-12 of the Ordinances of the City of Brandon, South Dakota be adopted as follows:  

CHAPTER 14-12

STORMWATER UTILITY FEE

14-12-1 PURPOSE

The provisions of this Chapter establish a Stormwater Utility Fee for the City.  A monthly Stormwater Utility Fee shall be collected for each Residential property located within the City and annual Stormwater Utility Fee shall be collected for each Nonresidential property located within the City.

14-12-2 DEFINITIONS

The following definitions shall apply in the interpretation and enforcement of this Chapter:  

Unless specifically otherwise identified in this Chapter or may otherwise be identified by Resolution of the City Council, the Current Use of Property is that classification identified, as may be amended from time to time 

Area – is the total square footage of all improved and unimproved property contained within the boundaries of each parcel of land as determined by the City Engineer or the City Engineer’s designee.  

City – The City of Brandon, South Dakota.  

Stormwater Utility Rate – is the rate set by the City Council, as may be set from time to time for certain categories of property. 

Stormwater Utility Fee – is the actual charge imposed against each parcel of land within the City.  

Nonresidential Property – is any property that does not meet the definition of residential property. 

Residential Property – is any property with a one, two, three, or four-unit dwelling, or a group home as defined under the City of Brandon, South Dakota R-1 and R-2 Zoning code, or otherwise shares the characteristics of any of these, which is currently used as a residential dwelling.

14-12-3 COLLECTION

The Stormwater Utility Fee will be included as a separate line item on the monthly utility bill for Residential Property.  If a Residential parcel of property does not have a utility account, the City shall establish an account and send a bill to the owner of the property on a monthly basis. The Stormwater Utility Fee for Nonresidential property will be certified for collection with real estate taxes on an annual basis. The City shall accept any and all prepayments for the Stormwater Utility Fee collected thru property taxes. 

14-12-4 CALCULATION

The Stormwater Utility Fee shall be a flat fee based on the Stormwater Utility Rate as may be set from time to time by the City Council.  The City Council may base the Stormwater Utility Rate on: the percentage of impervious surface and the size of the property draining into the City’s Stormwater system; the square footage of the property; the property’s current or anticipated use; or any other consideration within the City Council’s discretion for the health, safety, and welfare of the City.  

14-12-5 FEES FOR RESIDENTIAL AND NONRESIDENTIAL PROPERTIES

Residential Property within the City shall be assessed a monthly Stormwater Utility Fee.  Nonresidential Property within the City shall be assessed an annual Stormwater Utility Fee. The amount of the Stormwater Utility Rate and resulting Stormwater Utility Fee shall be established by Resolution of the City Council.  

14-12-6 EXEMPTIONS OR REDUCED FEES

Exemptions and reduced fees may be adopted by Resolution of the City Council. 

14-12-7 FREQUENCY OF CHANGE

The Current Use of Property for a parcel shall be changed no more than twice during a calendar year, and only upon the recommendation of the City Engineer and by authorization of the City Administrator, provided that the City Administrator may, at their discretion, refer the proposed change to the City Council for action.

14-12-8 REVIEW OF STORMWATER UTILITY FEE FOR NONRESIDENTIAL PROPERTY OWNERS

1. Any nonresidential property owner may seek review of the Stormwater Utility Fee by filing a signed, written request for review with the City Engineer.  The request shall be filed in writing within thirty (30) days of the mailing of the first real estate tax bill containing a new Stormwater Utility Fee. The request must be received at the City Engineer’s Office at City Hall.  The request shall set forth the particular grounds in which the review is sought. Grounds for review included questions relating to the City’s determination of the parcel’s area and the parcel’s impervious area.

2. Any nonresidential property owner may apply for a credit based on demonstrated reduction in service needs from the City storm water system through installation of structural storm water management measure. All adjustments are determined on a case-by-case basis through the City Engineer’s office per City Policy.

3. The City Council, by Resolution and upon recommendation of the City Engineer, may adjust the Stormwater Utility Fee after considering all pertinent data, including data provided by the property owner before determining the merits of each petition.  

14-12-9 CERTIFICATION OF UNPAID CHARGES

The balance of any Stormwater Utility Fee for Residential Property, which has not been paid within one (1) year of issuance, may be certified for collection with the real estate taxes in the following year. Certification shall only occur after notice is sent to the record title owner of the property.  

14-12-10  PROCEEDS OF THE STORMWATER UTILITY FEE

The City of Brandon, South Dakota Stormwater Utility Fee proceeds shall be used to construct, operate, maintain, repair, improve or remove the City of Brandon, South Dakota Stormwater system, for stormwater nonpollution discharge elimination, for stormwater education, and any other expenses related thereto.    

14-12-11 STORMWATER UTILITY FUND

The Stormwater Fees paid to the City shall be maintained in a separate fund to be known as the “Stormwater Utility Fund.”

PLANNING & ZONING COMMISSION

The Brandon Planning & Zoning Commission met in regular session at 6:30 p.m. on August 5, 2021 at the Brandon City Council Chambers. 

Roll call was taken.  Members present were Commissioners Brian Heidbrink, Brookes Noem, Chuck Parsons, Rob Schoeneman and Alica Thiele.  Also present were Alderman Tim Jorgenson, Building Official Paul Clarke, Mayor Jim Heinitz, City Administrator Bryan Read and City Engineer Tami Jansma.  Absent was Commissioner Thomas Nichols.

Commissioner Parsons moved Commissioner Noem seconded to approve the agenda.  Motion carried.

Commissioner Noem moved Commissioner Parsons seconded to approve the consent calendar which contained the following items: a plat of The Bluffs Addition Lots 20 & 21 Block 12, Lots 9-13 & Lots 15-21 Block 13, Lots 5-7 & Lots 9-13 Block 14, Lots 5-11 Block 15 and Lots 1-12 Block 16; a plat of Brandon Industrial park First Addition Lot 8 Block 2; a plat of Larson Addition Tracts 1 & 2; a plat of Original Town of Brandon Lot 9A Block 3; a plat of Tallgrass Addition Lot 17 Block 6 and a plat of Whipple’s Addition Tract 1, 2 & 3.  Commissioner Heidbrink abstained due to the lateness of getting the agenda and having no time to review prior to the meeting.  A roll call vote showed Noem, Parsons, Schoeneman, Thiele aye.  Motion carried.

 Commissioner Thiele moved Commissioner Schoeneman seconded to approve the minutes of the July 15, 2021 regular meeting.  Motion carried.

Steve Westhoff, 1600 E. Liberty Circle, was present for discussion regarding the preliminary plans for Brandon 90 Plaza Addition.  Steve informed the Commission that he currently has no agreement in place with the developers for access to his property for raising elevations, etc.  Steve expressed concerns with increased traffic through his neighborhood and proper screening between the General Business and Residential Districts.  City Engineer Tami Jansma met with the developers earlier this week, and confirmed that Steve’s property has been removed from the portion that needed elevations raised.  

Darwin Hohn, 1612 E. Liberty Circle, was present for discussion regarding the preliminary plans for Brandon 90 Plaza Addition.  Darwin also has concerns with increased traffic through their residential neighborhood, but doesn’t feel it will be commercial vehicles going through.  

Chris Bergst, 1513 E. Birch Street,  was present for discussion regarding the preliminary plans for Brandon 90 Plaza Addition.  Chris has concerns with increased traffic through their neighborhood and kids playing/crossing the streets where there are currently no sidewalks.  

Ruth Mayer, 712 S. Splitrock Blvd. was present for discussion.  Ruth lives across from Rapid Fitness located at 712 S. 8th Avenue and expressed concerns with the brightness of their sign on the back of the building.  Paul Clarke has spoken with the owner of Rapid Fitness and Ace Signs and they are currently checking to make sure they meet City Ordinances as related to the sign brightness.

Preliminary Plans for Brandon 90 Plaza Addition were presented.  Darrel Viereck, developer of Brandon 90 Plaza Addition and Pat Schwebach, JSA Engineers, were present for discussion.  Pat gave updates regarding Birch Street layout, stop light at Splitrock Blvd & Ash Street, retaining walls & fencing on top of walls.  Pat discussed relocating the lift station and will have plans submitted to City Engineer Tami Jansma soon.  Grading has begun and will be complete in 2021, will pave streets next year and being developing sites.  Commissioner Parsons moved Commissioner Thiele seconded to approve the preliminary plans as presented.  Motion carried.

Preliminary Plans for Encore Park were presented.  Darwin, ISG Consulting, was present for discussion.  Encore Park will consist of commercial, industrial and multi-family housing.  Commissioner Heidbrink questioned the private road adjacent to Lot 4.  Wade Behm, Hegg Construction, was present and said they are currently negotiating that private road with adjacent land owners.  Commissioner Parsons moved Commissioner Schoeneman seconded to approve the preliminary plans as presented.  Motion carried.

Discussion held on minimum lot area per unit in an R-3 High Density Residential District.  The Encore Park development being proposed by Hegg Construction will have approximately 300 multi-family units at 2,200 sq ft per unit.  Staff will present information on possible changes at a future meeting.

Off-Street Parking Chapter 15-14-3 – discussion held on the current requirement that no driveway(s) exceed a total cumulative width of 40’ or half the width of the lot at the property line, whichever is less, in the R-1 & R-2 zoning districts.  Staff will present information on possible changes at a future meeting.

Discussion held on changes to R-2 and R-3 residential districts as it relates to allowing 0’ setbacks on properties that are individually platted, with the common area around the structure platted in a separate lot.  An updated draft was presented, as prepared by Patrick Andrews, SECOG.  It was the consensus of the Commission to proceed with scheduling a public hearing.

Building permits for July were presented: #20210301 - #20210340.  No action required.

At 8:02 p.m., having no further business, Commissioner Parsons moved Commissioner Thiele seconded to adjourn the Planning & Zoning Commission meeting.  Motion carried.

PUBLIC HEARINGS

Kevin Hoeckman, Planner II, Planning and Zoning, notified the commission that the planned public hearing to appeal the decision for a conditional use permit #21-56 had been cancelled. MOTION by Barth, seconded by Heiberger, to deny the CUP for the lime storage operation and dismiss the appeal. 5 Ayes.

Joe Bosman, Captain, Sheriff’s Department, facilitated a public hearing to consider the 2021 Byrne/JAG Program Joint Spending Plan.  $140,349.00 was allocated and will be split between the Sioux Falls Police at 65% and the County Sheriff at 35%. Sarah Koob,4509 S Tennis Lane, Sioux Falls, SD, commented on public safety. 

Rhonda Bennett, Deputy Auditor, presented a public hearing and a MOTION by Heiberger, and seconded by Barth, was made to approve the Special Event Malt Beverage Retailer’s License for WoodGrain Brewing for a Farm to Table Dinner held at Cherry Rock Farms on August 29, 2021. 5 Ayes.

RESOLUTIONS

Upon the request of Ben Kyte, Auditor, MOTION by Heiberger, seconded by Beninga to pass a resolution to establish the number for on-sale and for off-sale licenses available in the county and fees to be charged. 4 ayes, 1 nay, Barth. 

RESOLUTION MC 21-45

A RESOLUTION DETERMINING THE NUMBER OF ON-SALE AND OFF-SALE ALCOHOLIC BEVERAGE LICENSES

 AND THE FEES FOR EACH CLASSIFICATION OF LICENSE

WHEREAS, SDCL 35-4-11.1, as amended, provides that the board of county commissioners shall on or before the first of September in each year determine by ordinance or resolution the number of on-sale and off-sale licenses (other than malt beverage) it will approve for the ensuing calendar year and the fees to be charged for the various classifications of licenses.

NOW, THEREFORE, BE IT HEREBY RESOLVED:

1. Off-Sale:

a. That the number of off-sale liquor licenses be set at thirteen (13);

b. That the fee for such a license be set at $1,200; and

c. That the renewal fee for such a license be set at $500.

2. On-Sale:

a. That the number of on-sale liquor licenses be set at thirteen (13); and

b. That the initial and renewal fees for such a license shall be set at the same amount charged by the nearest municipality to the license location according to SDCL 35-4-2(6).

3. That the application fee for a special event alcohol license shall be as follows:

a. A temporary special malt beverage retailer’s license: $25.00 per day;

b. A temporary special on-sale wine retailer’s license: $25.00 per day;

c. A temporary special on-sale liquor license: $50.00 per day; and

d. A temporary special off-sale package wine dealers license $25.00 per day.

4. A $50.00 publishing fee shall be required in addition to the applicable application or renewal fee.

BE IT FURTHER RESOLVED that this Resolution shall replace any and all prior ordinances or resolutions adopted by the Minnehaha County Board of County Commissioners regarding the number of approved on-sale licenses and fees for on-sale licenses, off-sale licenses, and special events licenses within the County.

Minnehaha County Auditor   Ben Kyte, Auditor, presented the first reading for an Ordinance establishing the requirements, fees, and

regulation for the issuance of Alcoholic Beverage Licenses within Minnehaha County. The commission provided guidance to establish May 15th as the date to annually establish the number of liquor licenses available and fees to be charged for special events alcohol licenses.  Additionally, the Commission recommended that conditional approval may be given to an applicant of a liquor license and the license will be held by the county for up to 4 months to allow for rezoning to be completed.

Upon the request of Ben Kyte, Auditor, MOTION by Barth, seconded by Bender, to pass a resolution to declaring certain county owned property as surplus and authorize an appraisal for the 2021 Tax Deed Sale. 5 ayes.

WHEREAS, Minnehaha County is the owner of the following parcels of real property pursuant to a Treasurer’s Tax Deed duly signed and recorded: Record ID 29190, Record ID 30344, Record ID 32892, Record ID 34309, Record ID 48244, Record ID 52876, Record ID 56406, and Record ID 70628, all located in Sioux Falls, Minnehaha County, South Dakota; and

LIAISON REPORTS

Commissioner Heiberger gave a briefing on SD Association of County Commissioners Board Meeting. Topics discussed were Eide Bailey consulting on the spending of the American Recue Plan funds, HB 1259 – Rural Access Infrastructure Bill, Medical Marijuana, and involuntary commitment of youth with known mental issues to JDC. Commissioner Heiberger also attended a Farm to Fork Event at the Scott Farm near Valley Springs.

Commissioner Bender noted that involuntary commitment of mentally ill adults was also an issue.

Chairmen Karsky commented that one in five grade school age children have experienced a mental health crisis.
