The regular meeting of the Brandon Valley Board of Education, Brandon, SD was held at 6:30 p.m. on the 9th of August, 2021 at the Brandon Valley High School Community Room with the following members present:  Renee Ullom, Gregg Ode, Gregg Talcott, and Nick Scott.  Absent:  Ellie Saxer.  Also present were Superintendent Jarod Larson, Business Manager Paul J. Lundberg, High School Principal Mark Schlekeway, Activities Director Bill Freking, High School Associate Principal Jordan Paula, High School Associate Principal Mitzi Moore, Middle School Principal Brad Thorson, Intermediate School Principal Nick Skibsted, Intermediate School Assistant Principal Rick Pearson, Robert Bennis Elementary Principal Kristin Hofkamp, Valley Springs/Inspiration Elementary Principal Tanya Palmer, Fred Assam Elementary Principal Susan Foster, Director of Instruction Sherri Nelson, Special Services Director Wendy Otheim, and Operations Manager Ty Hentschel.

Renee Ullom called the regular meeting to order at 6:30 p.m., beginning with the Pledge of Allegiance.

Motion by Talcott, seconded by Ode to approve the agenda as presented.  Motion carried.

President Renee Ullom, along with Superintendent Larson presented the following conflict of Interest Disclosure – Waiver Request that was presented for review at tonight’s meeting:  Superintendent Larson advised the board of his wife, Amanda Larson, has the position of long-term substitute nurse within the Brandon Valley School District for the 2021-22 school year.   Motion by Scott, seconded by Talcott to approve and authorize this request for school board waiver as presented by Dr. Larson, because the terms of this contract are fair and reasonable and are not contrary to the public interest.  Motion carried.

President Renee Ullom, along with Superintendent Larson presented the following Conflict of Interest Disclosure – Waiver Request that was presented for review at tonight’s meeting:  Board Member Gregg Talcott advised the board of his former role with the Brandon Valley School District as a former employee who is now receiving compensation from the Brandon Valley School District from the early retirement benefit (year #3) and from the South Dakota Retirement System upon his retirement.  Motion by Ode, seconded by Scott to approve and authorize this request for school board waiver as presented by Dr. Talcott because of the terms of this contract are fair and reasonable and not contrary to the public interest. On a roll call vote, voting aye: Ode, Scott, and Ullom; abstain: Talcott.  Motion carried.

Motion by Scott, seconded by Ode to approve the minutes of the annual organizational meeting of July 12, 2021 as presented.  Motion carried.

Community input this evening included Dr. Amy Kelley, an OB/GYN in Sioux Falls that requested to speak at this evening’s Board of Education meeting.  Dr. Kelley had two requests:  1) That the school district consider requiring all staff and students (age 5 and up) to be vaccinated for COVID when fully approved and authorized by the FDA; and 2) Place a mandatory mask mandate on all students and staff until at least 85% of Minnehaha County has been vaccinated and when all students age 5 and up will be able to be vaccinated.  Dr. Kelley stated that these requests may seem unrealistic at the present time and also requested that the Board consider at the very least strongly recommend or even possibly EXPECT mask wearing.  

Business Manager Paul Lundberg reviewed the Accounts Payable process with the Board of Education this month.  Lundberg reviewed this process considering the 1,000+ invoices that the Business Office has processed in this month alone.

Motion by Scott, seconded by Ode to approve the bills & claims as submitted (see attached).

Motion carried.

The cash report for the month of July, 2021 showed receipts of $3,017,648.35 and disbursements of $5,998,478.47, leaving a balance of $19,073,212.92.  The General Fund had receipts of $2,377,085.94, sent a temporary interfund transfer of $30,248.95 to the Bond Fund, and disbursements of $2,616,685.27, leaving a balance of $10,220,657.03.  Capital Outlay Fund had receipts of $45,202.46 and disbursements of $1,153,182.81, leaving a balance of $5,151,316.54.  Special Education Fund had receipts of $281,892.75 and disbursements $375,257.51, leaving a balance of $1,361,780.39.  Bond Redemption Fund had receipts of $23,002.29, received a temporary interfund transfer of $30,248.95, and disbursements of $900,018.75, leaving a balance of $0.00.  Enterprise Fund had receipts of $0.00 and disbursements of $2,704.71, leaving a balance of $36,936.18. Lastly, the Capital Projects Fund has receipts of $290,464.91 and disbursements of $950,629.42, leaving a balance of $2,302,522.49.

The July, 2021 payroll totaled $1,660,101.41 of which $986,426.16 was instructional, $378,740.18 was support services, $30,763.67 was co-curricular, $237,659.37 was Special Education, $23,999.53 was Food Service, and $2,512.50 was Driver’s Education. 

Motion by Talcott, seconded by Scott to approve the financial reports as presented for the month of July, 2021.  Motion carried.

Administrative reports were presented.   Superintendent Jarod Larson outlined the Inspiration Elementary School construction timeline:

Spring 2020:

° Construction in progress

° Collaborative BVSD/Sioux Falls Playground/Park Development/Expense Agreement ($336,823)

Fall 2020:  Naming Facilities Committee: November 23, 2020 recommendation; Process completed

Fall 2020:  Elementary boundary line committee: Process completed

2020-21 School year:  Construction continues

Fall 2021:  School opens (July 31, 2021: Substantial Completion; August 13, 2021: Punch List Completed)

° Inspiration Elementary School Open House/Ribbon Cutting* – August 17, 2021

° New Staff in-service – August 18, 2021

° Popsicles in the Park – August 19, 2021

° First Day of School – August 25, 2021

*Inspiration Elementary School Open House/Ribbon Cutting will be held Tuesday, August 17, 2021 as follows:  4:00 – 5:00 p.m. Open House and 5:00 p.m.  Ribbon Cutting with tours to follow.

The 2021-22 Brandon Valley Distance Learning Academy will continue as follows: Grades K-4: Brandon Valley Teachers/Platform; Grades 5-12: SD Virtual School (5-6 Black Hills On-line Learning and 7-12 SD Virtual School).  The deadline to select Distance Learning is August 11, 2021.

Brandon Valley High School addition priorities have been reviewed and discussed as follows:

- General Classrooms, Ground Floor Special Education, Science Lab Classrooms, Maximize Land Usage/ Upgrade East Facility Face, Minimize Impact to parking.

The tentative BVHS Addition timeline is as follows:

- Preliminary planning in-progress:  Preliminary planning with the Building and Grounds Board Committee, Central Office Administration and BVHS Administration

- Fall 2021 – Information sharing as follows:  Community with Board of Education, Administrative Council, Teacher Liaison Council, Classified Council, and the Brandon Valley High School Staff

- Winter 2022 – Bid the project

- Spring/Summer 2022 – BVHS Addition begins

- 2022-2023 School year – Construction in-progress

- Fall 2023 – Addition opens

Information sharing regarding the BVHS Addition begins with preliminary planning (in-progress) with Building and Grounds Committee, Central Office Administration and BVHS Administration.  In the Fall of 2021, Communication will continue with the Board of Education, Administrative Council, Teacher Liaison Council, Classified Council, and the Brandon Valley High School Staff. 

2021-22 School Calendar items include the following:  August 18, 2021 ~ New Staff in-service day; August 19, 2021 ~ In-service/workshop day; August 23, 2021 ~ In-service/workshop day; August 24, 2021 ~ In-service/workshop day; August 25, 2021 ~ First Day of School Grades 1-12; Friday, August 27, 2021 ~ First Day of School for Kindergarten; Monday, August 30, 2021 ~ First Day of School for Early Childhood programs.

Lastly, Superintendent Larson presented updated pictures of work in progress for Inspiration Elementary School including the exterior view of the building; 1st – 4th Grade wing classroom, and 1st – 4th Grade Wing Restrooms.

Brandon Valley High School Principal Mark Schlekeway introduced the two new Associate Principals starting with the 2021-22 school year:  Mr. Jordan Paula and Mrs. Mitzi Moore.  Welcome!  High School Activities including band, dance, soccer, volleyball, and football are up and running and freshmen unity day and the senior retreat are coming up in the days ahead.  The start of the school year has begun!

Brandon Valley Middle School Principal Brad Thorson stated that the schedules for the BVMS students will be released on Friday, August 13, 2021.  Seventh grade orientation will be held on campus on Monday, August 16th.  

Special Services Director Wendy Otheim reported that during the upcoming BV in-service days, she will be collaborating with the Teachwell staff to offer a professional development on disabilities to Educational Assistants and Classified Staff.

Director of Instruction, Sherri Nelson, updated on the recent ELA Adoption and training that has been on-going since the adoption began.  Nelson also reviewed the upcoming In-Service Staff Development schedule.

The following Board Policies were presented for a first reading at tonight’s meeting:

1. JHCDE:  Administration of Medical Cannabis to Qualifying Students

2. IGDK:  Participation of Alternative Instruction Students

Superintendent Jarod Larson presented the 2021-22 Pandemic Response Plan Survey Results (presented for information only).  The survey results are as follows:

Question 1: Indicate if you support or oppose the “draft” protocol for voluntary Masking?  88.38% of District Patrons (1,901 responses) support the protocol for voluntary masking with 11.62% of District Patrons (250 responses) opposed to the protocol for voluntary masking.

Question 2: Indicate if you support or oppose the “draft” daily individual health screening process being completed prior to entering school facilities?  81.83% support and 18.17% oppose the protocol for daily individual health screening.  

 Question 3: Indicate if you support or oppose the “draft” protocol for an individual exhibiting symptoms? 89.13% support and 10.87% oppose the protocol for an individual exhibiting symptoms.

Question 4: Indicate if you support or oppose the “draft” close contact protocol?  79.05% support and 20.95% oppose the close contact protocol.

Question 5: Indicate if you support or oppose the “draft: positive case communication protocol?  84.49% support and 15.51% oppose the positive case communication protocol.

Question 6: Indicate your support or oppose the “draft” school district facility access and usage approach?  90.75% support and 9.25% oppose the school district facility access and usage approach.

Dr. Larson presented the 2021-22 COVID-19 Pandemic Response Plan developed by the Brandon Valley Safety Committee and Administration, revised as of August 3, 2021.  The Response Plan and survey results listed above can all be found on the School District web-site link: https://brandonvalley.k12.sd.us/covid/covid.html

Superintendent Larson presented the 2021-22 Pandemic Response Plan agenda action items as follows:  a) Masking Protocol, b) Daily Individual Health Screening Process, c) Protocol for Individuals Exhibiting Symptoms, d) Close Contact Protocol, e) Positive Case Communication, and f) Facility Access & Usage.  Motion by Talcott, seconded by Ode to address these action items individually.  On a roll call vote, the following voted aye:  Talcott, Ode, Scott, Ullom; Voting nay:  none.  Motion carried.

a. Masking Protocol:   the BVSD #49-2 2021-22 Pandemic Response plan suggests Voluntary Masking.  Motion by Scott, seconded by Ode to approve this recommendation with Voluntary Masking, as presented. Board member Gregg Talcott began the discussion with his concern of K-6th grade students that cannot protect themselves since there is no vaccination available to them presently.  Talcott stated “We are not dealing with last year, and (we are) exposing younger students to greater risk with less protection.”  Talcott feels barriers need to return and masking needs to be mandatory at the very least for K-6th grade.  The Delta variant is not “last year” and needs to be treated differently.

Board Member Nick Scott agreed that our students’ and staffs’ safety is our #1 concern.  Scott believes that this will continue to be an on-going concern but believes that the way that we handled things last year, adjusting on the go, was the best-case scenario.  Not everyone will be pleased with this decision but feels that the CDC recommendation of voluntary masking can and should be followed. 

Vice Chairperson Gregg Ode stated that this is a very touchy subject.  He believes that what we have in place works, but the Delta variant is a different breed.  Ode feels we need to do the utmost that we can to prevent this from spreading and agrees with Talcott that we mandate the use of masks.

With the motion on the floor to leave the administrative recommendation of Voluntary Masking as presented, and on a roll call vote, the following voted aye: Scott, Ullom; nay: Talcott, Ode.  Motion failed.

A second motion was made as follows:  Motion by Talcott, seconded by Ode, that masking be mandatory at the Elementary and Intermediate School levels and voluntary, but strongly recommended/encouraged. at the Middle School and High School levels until the COVID-19 vaccination is fully authorized and available to students in the K-6th grade levels.  The Motion died for lack of a second.

Since the motion was unsuccessful, the Masking Protocol was tabled and will be reconsidered at a Special Board of Education Meeting scheduled for Monday, August 16, 2021 @ 6:30 p.m. in the Brandon Valley High School Performing Arts Center. 

b.  Daily Individual Health Screening Process: the BVSD #49-2 2021-22 Pandemic Response plan suggests completing the daily health screening process at home prior to coming to the Brandon Valley School District facilities.    Motion by Talcott, seconded by Scott to approve this Daily Screening at home as presented.  On a roll call vote the following voted aye:  Talcott, Scott, Ode, Ullom; Nay:  None.  Motion carried.  

c. Protocol for Individuals Exhibiting Symptoms:  the BVSD #49-2 2021-22 Pandemic Response plan suggests an individual exhibiting symptoms of illness will be offered a surgical mask, be evaluated by Student Health Services, and may be required to leave the facility.  Motion by Talcott, seconded by Scott to approve this Protocol for Individuals Exhibiting Symptoms as presented.  On a roll call vote the following voted aye:  Talcott, Scott, Ode, Ullom,; Nay: None.  Motion carried.  

d. Close Contact Protocol: the BVSD #49-2 2021-22 Pandemic Response plan suggests that close contacts are recommended to adhere to the South Dakota Department of Health Guidance.  Motion by Talcott, seconded by Ode to approve this Protocol for Close Contact as presented.  On a roll call vote the following voted aye: Talcott, Ode, Scott, Ullom; Nay: None.  Motion carried.  

e. Positive Case Communication: the BVSD #49-2 Pandemic Response plan suggests that no Positive Case Communication will occur throughout the grade levels.  Board member Talcott discussed the importance of individual cases being shared with elementary classrooms involved. After brief discussion on the specifics of that communication, this response was amended to include Positive Case Communication to be made with K-4th grade levels and no positive case communication will occur for grades 5-12.  Motion by Talcott, seconded by Scott to approve this amended Protocol for Positive Case Communication.  On a roll call vote the following voted aye: Talcott, Scott, Ode, Ullom; Nay: None.  Motion carried.  

f. Facility Access & Usage:   the BVSD #49-2 Pandemic Response plan suggests that Facility Access and Usage be open. There is no restriction on school visitation, activity attendance, or outside organization facility usage. Motion by Talcott, seconded by Ode to approve this Protocol Facility Access and Usage as presented.  On a roll call vote the following voted aye: Talcott, Ode, Scott, Ullom; Nay: None.  Motion carried.  

Superintendent Larson presented the American Rescue plan (ARP) Elementary and Secondary School Emergency Relief (ESSER) Fund School District Plan. The Brandon Valley School District total ARP ESSER funding available is $1,004,882 with the amount set aside currently for lost instructional time set at $200,976.  Motion by Scott, seconded by Talcott to approve the ARP and ESSER Plan for the Brandon Valley School District as presented.  Motion carried.

Motion by Talcott, seconded by Ode to approve the following general business items:

1. Approve a 2021-22 COVID-19 Stipend of $850 for full-time staff and $425 for part-time staff, to be paid in October, 2021.

2. Approve contract and addendum by and between the Brandon Valley School District #49-2 and South Dakota State University/Division of Education, Counseling and Human Development, for supervision of student teachers, at a rate of $200/full-time teacher candidate (first semester), and $400/full-time teacher candidate (second semester) effective with the 2021-22 school year, as presented.

3. Approve administrative recommendation to cast runoff ballot for South Dakota High School Activities Association (SDHSAA) West River At-large Representative for Todd Palmer (Sturgis Brown), effective July 1, 2021 to June 30, 2024.

4. Approve contract by and between the Brandon Valley School District #49-2 and Universal Pediatrics for nursing services for three students at a rate of $50/hour, effective for the 2021-22 school year as presented.

5.  Approve service agreement by and between the Brandon Valley School District #49-2 and Children’s Care Hospital and School (dba LifeScape) for services for one student, $194/day (July 1, 2021 to August 20, 2022), $198/day (August 23, 2021 to August 22, 2022), and therapy services of $84.75/15 minutes, effective July 1, 2021 to June 30, 2022, as presented.

Motion carried.

4. Approve recommendation to hire Katelyn Rhoades, BE Special Education Educational Assistant (Aspire Classroom) full-time, $15.90/hour, effective August 25, 2021.

21. Approve recommendation to hire Jamie Hofland, BVIS Special Education Teacher, MA Step 5 ~ $49,031.00, effective with the 2021-22 school year.

22. Approve resignation from Laurie Veld, BVIS Child Nutrition Manager, effective July 30, 2021.

23. Approve resignation from Keren Shafer, VSE Special Education Educational Assistant, effective August 2, 2021.

24. Approve recommendation to hire Kathy Tews, BE School Counselor, MA Step 7 ~ $49,752.00, effective for the 2021-22 school year.

25. Approve resignation of Larenzo Williams, BVIS Special Education Educational Assistant, effective August 2, 2021.

26. Approve recommendation to hire Laurie Veld, BVMS and BVIS Administrative Assistant, full-time, 10-month position, $17.30/hour, effective August 16, 2021.

27. Approve recommendation to hire Mallory Efta, RBE Kindergarten Teacher, BA Step 1 ~ $47,054.00, effective for the 2021-22 school year.

28. Approve recommendation to hire Kama Kwiecinski, long-term substitute for Amanda Ringling, 7th/8th grade BVMS Science, starting on or around August 25, 2021 for approximately 8 weeks.

29. Approve recommendation to hire Amanda Aaseng, BV Academic and Student Health Services (COVID) Educational Assistant, full-time, one-year position $15.90/hour, effective August 25, 2021.

30. Approve recommendation to hire Kathy Carda, BVIS Child Nutrition Kitchen Manager, full-time, $17.75/hour, effective August 25, 2021.

31. Approve recommendation to hire Teresa Van Belle, full-time BVIS Child Nutrition worker, $14.75/hour, effective August 25, 2021.

32. Approve new substitutes for the 2021-22 school year as follows:  Rebecca Bradley, Nancy Brown, Germaine Glieden-Lindquist, Jennifer Klawitter, Susan Meyer, Heather Mulder, and Lisa Parker.

The following personnel items were reviewed by the Board of Education for information only:

1. Transfer Heidi Bilben from part-time Child Nutrition worker at FAE to part-time Child Nutrition worker at Inspiration Elementary, effective with the 2021-22 school year.

2. Request for maternity leave by Jayna Silvernail, RBE 2nd Grade teacher, on or about September 30, 2021 for approximately nine (9) weeks.)

3. Request for paid leave by Chad Garrow, BVHS Physical Education teacher, effective August 19, 2021 for eight weeks.

4. Request for additional maternity leave by Lindsey Farmen, BVIS 5th Grade Social Studies Teacher from August 19, 2021 through September 3, 2021 (11 days).

5. Request for maternity leave by Andrea Kruse, Child Nutrition Director, effective on or about September 24, 2021 for approximately 11 weeks.

Communications received by the Central Office and Board of Education were reviewed.  They included the following item:

1. July 2021 Building Permits.

2. Thank you from Vickie David and Tyler Carda for BVSD support of Safety Town program for children.

3. Thank you from the Brandon Valley Area Chamber of Commerce for BVSD commitment to the students and the BV community.

4. Thank you from the Ode family for the plant sent in memory of their father, Robert Ode.

Board reports were heard.  Board President Renee Ullom reported on Alternative Education and Teachwell.  Ullom and was happy to hear that our staff and the Teachwell staff will be working together at the upcoming BV in-service days to offer a professional development on disabilities to Educational Assistants and Classified Staff.

Board Vice President Gregg Ode, along with his sister Allison Rasmussen and brother Doug Ode, thanked the Board members and community for the outpouring of support and condolences on the recent passing of his father, Robert Ode.

Travel reports were reviewed.

Motion by Ode, seconded by Talcott to adjourn the meeting at 8:17 p.m.  Motion carried.

The Brandon City Council met in a special meeting session at 5:30 p.m. on Monday, August 9, 2021 at the Council Chambers at 308 S Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Vickie David, Barb Fish, Tim Jorgenson, David Kull and Mayor Jim Heinitz.  Others present were: City Administrator, Bryan H. CALL TO ORDER 

The Commissioners of the City of Valley Springs met in regular session on Tuesday, August 10, 2021 at 6:00 PM in the VS American Legion.  Mayor Carl Moss presided.  Answering roll call were Commissioners Brian Staeffler, Dean Helgeson, Sandy Severtson and Lynn Schmidt.  Also present was City Maintenance Blaine Eilts, Finance Officer Ginger Miller and outgoing Finance Officer Linda Hunnel, City Attorney Patrick Glover, City Engineer Gabe Laber, and Jill Meier with the BV Journal.  Motion by Helgeson to approve the agenda as posted.  Schmidt seconded the motion.  Motion carried, all voting aye. 

APPROVAL OF MINUTES

Motion by Staeffler to approve the July 13, 2021 Minutes as presented. 

Severtson seconded the motion.  Motion carried, all voting aye.  

CLAIMS AND PAYROLL

Motion by Helgeson to approve the July Claims in the amount of $312,583.10.  Schmidt seconded the motion.  Motion carried, all voting aye.

MONTHLY FINANCIAL REPORTS

The Commission reviewed the July Financial Reports. Motion by Staeffler, second by Helgeson, to approve the July 2021 Proof of Cash Report.  Motion carried, all voting aye.  Motion by Severtson, second by Schmidt, to approve the July YTD Budget Report.  Motion carried, all voting aye.  

PUBLIC COMMENT

Several residents of Valley Springs voiced concern over an increase in reckless driving on Broadway. A citizen has been doing burnouts on Broadway with cars and motorcycles, which is a hazard to children and pedestrians. The sheriff was called 8 times in July concerning this.  Commission Staeffler requested an invitation be sent to the new Patrol Commander, Capt. Zishka to attend the next board meeting.  Ardell Johnson said there are many sidewalks in town that are not accessible due to the construction. City ordinance states vehicles can’t block the sidewalks.

ENGINEER REPORT

City Engineer Gabe Laber spoke of the construction project’s progress.  The sewer main installation is done on Cliff Ave.  Project completion should be early September.  Laber requested an SRF Loan Reimbursement pay request.  Motion by Helgeson, second by Severtson to approve the SRF Loan Reimbursement Request in the amount of $221,591.26: $33,112 payable to HDR, $188,479.26 payable to ASCO.  Motion carried, all voting aye.

OLD BUSINESS

Fence Drainage Easement Issue

Jennifer Kielman of Dakota Circle was again present to ask the Commission to consider allowing her to cut six inches from the bottom of her fence to allow drainage rather than removing the fence. Some neighboring property owners expressed concern over the possible buildup of ice and snow restricting water flow.  Ms. Kielman contacted her title company, who takes no responsibility or liability concerning the drainage easement notification.  The commissioners agreed to allow her to cut 6” off the bottom of her fence to allow drainage.  The issue will be revisited in the spring. 

NEW BUSINESS

Schoenfish Audit Report.  Miller said the annual audit was a clean audit and requested a motion for approval.  Schmidt made a motion to approve the 2019-2020 Municipal Audit, second by Staeffler.   Motion carried, all voting aye. 

DOT – Transportation Alternative Project (TAP) Grant Resolution 2021-07.  Severtson motioned to approve, second by Helgeson.  Motion carried, all voting aye.  This phase is for the shared use path to be constructed from Southside Avenue to Skyline Drive. 

Volunteer Painting Project – Scott Wentler of Mad Tatter volunteered to paint the Legion Baseball Park Dugouts and the southern Valley Springs Welcome Sign.  He will be invited to the September board meeting to present his design ideas.  Citizen Mike Herding offered to provide the paint. 

PUBLIC WORKS REPORT

City Maintenance Supervisor Blaine Eilts gave his monthly maintenance report.  Items included:  exercised hydrant isolation valves on water mains, tractor and bucket truck repair, hauled road millings and graded Olson Street.   After construction, Eilts will contract with a company to jet sewer mains for designated streets. Who is responsible for mowing the waterway behind Park Drive and the trailer court was discussed.  Eilts will determine responsible parties by GIS mapping.  

FINANCE OFFICER REPORT

Due to a CD maturing August 15, 2021, a motion was made by Staeffler to cash it in and shop for better interest rates. Schmidt seconded the motion.  Motion carried, all voting aye.  The Serbian Church’s small fireworks display was confirmed for January 6, 2022 at 6PM.  Miller said the My Town Text alert system is live and being used for city alerts.  Citizens are urged to sign up.  A link will be provided on the city website.  120 residents have signed up for text alerts to date.

CITY ATTORNEY REPORT- City Attorney, Patrick Glover is waiting for the Department of Health’s decision on medical cannabis regulations.

COMMISSIONER REPORTS –Commissioner Helgeson inquired into train whistle warnings at intersections.  City Attorney Glover will research the requirements of this.

Transportation Alternatives Grant Application

To the

South Dakota Department of Transportation

WHEREAS the City of Valley Springs desires assistance from the South Dakota Department of Transportation – Transportation Alternatives Grant Program for the purpose of completing a new non-motorized trail to expand alternative transportation as part of the Shared Use Path Phase IV Recreational Trail; and

WHEREAS the City Council hereby commits to the continued maintenance and operation of the trail; and

WHEREAS the City Council hereby commits local match of not less than 18.05 percent of the project; and

WHEREAS the City Council acknowledges its responsibility to secure right-of-way or easements for construction.

NOW THEREFORE BE IT RESOLVED that the City Council hereby authorizes the filing of a grant application, including all understanding and assurances contained therein, for the Transportation Alternatives Grant Program, and hereby authorizes the Mayor to in connection with the application and to provide such additional information as may be required.
