Stuart Peschel, 212 E. Tabor Court, Brandon, SD, was present for discussion.  Stuart is the President of the Brandon Valley Baseball Association and was present to express thanks for all the help making the SD 2021 State A Senior Legion Baseball Tournament a success.

Chris Brown, 300 E. Meadowbrook Trail, Brandon, SD, was present for discussion.  Chris expressed his thanks for all the volunteers and City that helped pull off the baseball tournament.

WHEREAS, the Brandon Valley Baseball Association hosted the South Dakota Class A Senior American Legion Baseball Tournament on July 23-27, 2021; and

WHEREAS, the tournament took countless volunteer hours by members of the Brandon Valley Baseball Association to plan for the tournament; and

WHEREAS, hundreds of community volunteers helped to make the tournament a success.

THEREFORE, I, Jim Heinitz, Mayor of the City of Brandon, South Dakota, and on behalf of the City of Brandon, want to thank the Brandon Valley Baseball Association for the professional and meticulous way in which the South Dakota State A Senior Legion Baseball Tournament at First National Field was run last week.  The attention to detail in all aspects led to a very fun and safe 5 days at the ballpark. SO many great comments on the field and in general the whole Aspen Park complex. We also extend a great thanks to the over 200 volunteers from the communities of Brandon and Valley Springs that worked very hard to make sure fans enjoyed the games. Also, a BIG thanks to the Parks Department for insuring that the fields were in great shape. Every aspect of the 5 days reflected extremely well on the City of Brandon. Other than the Mayor’s imperfect first pitch, everything else was perfect. WELL DONE ALL!!!!!

GOLF COURSE HIRE SEASONAL STAFF

The Golf Course Committee report was heard.  Alderwoman Clark moved Alderman Kull seconded to approve the hiring of Alicia King at $7.60 per hour for the position of Lounge/Beverage Cart.  Motion carried.

RESOLUTION #15-21 - DONATION OF DASHER BOARDS

The Parks & Recreation Committee report was heard.  Alderwoman Fish moved Alderwoman Clark seconded to approve Resolution #15-21.  A roll call vote showed Clark, David, Fish, Jorgenson, Kull aye.  Motion carried.

RESOLUTION #15-21

RESOLUTION DONATING HOCKEY RINK DASHER BOARDS TO THE BRANDON VALLEY HOCKEY ASSOCIATION

WHEREAS, the City of Sioux Falls is willing to donate used hockey dasher boards to the City of Brandon; and

WHEREAS, it is the intention that the hockey dasher boards will be donated to the Brandon Valley Hockey Association; and

WHEREAS, the Brandon Valley Hockey Association is a nonprofit corporation; and

WHEREAS, SDCL 6-5-2 allows municipalities to donate property to nonprofit corporation; and

NOW THEREFORE BE IT RESOLVED by the City Council of Brandon, South Dakota that the City of Brandon hereby accepts the used hockey dasher boards from the City of Sioux Falls and donates said dasher boards to the Brandon Valley Hockey Association to be used in a hockey facility in Brandon, South Dakota.

REQUEST FOR ALCOHOL CONSUMPTION IN MCHARDY PARK

Alderwoman Fish moved Alderwoman Clark seconded to approve the alcohol consumption permit application from Tami Jansma, for McHardy Park on August 9, 2021 from 7:00pm to 9:00pm.  Motion carried.

BASA/TEA SOCCER TOURNAMENT

Alderwoman Fish moved Alderwoman Clark seconded to approve the request from the Brandon Area Soccer Association and Tea Area Soccer Association to host a soccer tournament at McHardy Park on September 24-26, 2021.  Motion carried.

SAMPLE MEDICAL CANNABIS ORDINANCES

The Public Safety Committee report was heard.  Model ordinances were presented on medical cannabis.  For informational purposes at this time, no action required.

BLOCK PARTY REQUEST 

The Administration Committee report was heard.  Alderwoman Clark moved Alderman Kull seconded to approve the block party request from Aaron Carroll, 301 S. 8th Avenue, to be held on September 4, 2021 from 3:00pm to 10:00pm, as presented.  Motion carried.

VFW RAFFLE

A request was received from the Brandon VFW to conduct a raffle within the City of Brandon, starting August 1, 2021 through November 6, 2021.  It was the consensus of the Council to allow the request as presented.  No further action required.

AMERICAN RESCUE PLAN ACT OF 2021

Alderwoman Fish moved Alderwoman Clark seconded to approve the Financial Assistance Agreement and the Assurances of Compliance with Title VI of the Civil Rights Act, as presented.  Motion carried.

BLOCK PARTY REQUEST

Alderman Kull moved Alderwoman David seconded to approve the block party request from Barbi Roberts, 800 N. Copper Avenue, to be held on August 7, 2021 from 12:00pm to 10:00pm, as presented.  Motion carried.

RESOLUTION #16-21

RESOLUTION APPROVING TAX INCREMENT FINANCING DISTRICT NUMBER 6 PROJECT PLAN AND DEVELOPER’S AGREEMENT.

WHEREAS, the City of Brandon passed Resolution #13-21, pursuant to SDCL 11-9-2, which created Tax Increment Financing District Number 6, City of Brandon, and defined its boundaries, and

WHEREAS, the Planning Commission has recommended a proposed Project Plan for Tax Increment Financing District Number 6 and the City of Brandon, pursuant to SDCL § 11-9-17, has the power to adopt a project plan for the district, and

WHEREAS, tax increment contracts or agreements shall be authorized by resolution of the governing body without a requirement of voter approval, pursuant to SDCL § 11-9-34, and the City of Brandon has the power to contract and adopt a developer’s agreement.

THEREFORE, IT IS HEREBY RESOLVED BY THE CITY OF BRANDON COMMON COUNCIL AS FOLLOWS:

Project Plan. The Tax Increment Financing District No. 6 Project Plan is hereby approved.

Developer’s Agreement. The Mayor and Finance Officer are authorized to enter into a Developer’s Agreement with a developer.

BUDGET WORK SESSION

Alderwoman Clark moved Alderwoman David seconded to authorize staff to work with Hegg Construction on their submission of the LIIP Grant Application for their Encore Park Development project.  Motion carried.

TREE BRANCH DROP OFF

The next tree branch drop off day is scheduled for Saturday, October 2, 2021 at 409 N. Sioux Blvd.

JOINT REPAIR PROJECT

Alderwoman Clark moved Alderwoman David seconded to approve the agreement with SD DOT for the joint repair work and inlet replacement on Splitrock Blvd, as presented.  Motion carried.

4TH AVENUE OVERLAY QUOTE

Alderman Kull moved Alderwoman David seconded to approve the quote from Seal Pros in the amount of $99,958.34 for the overlay project on 4th Avenue from Holly Blvd. to Aspen Blvd.  Motion carried.

WATER TOWER PROJECT CHANGE ORDER

The Water & Sewer Committee report was heard.  Alderwoman Fish moved Alderwoman Clark seconded to approve change order #1 to AB Contracting in the amount of $23,342.70 for the water tower project.  Motion carried.

At 7:14 p.m. on a motion by Alderwoman David seconded by Alderwoman Clark the meeting was adjourned.  Motion carried.

The Brandon City Council met in a briefing session at 5:30 p.m. on Thursday, July 29, 2021 at the Council Chambers at 308 S Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Vickie David, Barb Fish, Tim Jorgenson and Mayor Jim Heinitz.  Others present were: City Administrator, Bryan H Read; Public Works Director, Rollie Hoeke; Police Chief, Jamie Steffel and Park Superintendent, Devin Coughlin.  Absent: David Kull and Jack Parliament.

The Council discussed items on the agenda for the upcoming August 2, 2021 regular Council meeting.  No formal action was taken.

PLANNING & ZONING COMMISSION

The Brandon Planning & Zoning Commission met in regular session at 6:35 p.m. on July 15, 2021 at the Brandon City Council Chambers. 

Roll call was taken.  Members present were Commissioners Brian Heidbrink, Brookes Noem,  Rob Schoeneman and Alica Thiele.  Also present were Alderman Tim Jorgenson, Mayor Jim Heinitz, City Administrator Bryan Read and City Engineer Tami Jansma.  Absent were Commissioners Chuck Parsons and Jim Starzl. 

Commissioner Noem moved Commissioner Schoeneman seconded to approve the agenda as amended.  Motion carried.

Commissioner Thiele moved Commissioner Schoeneman seconded to approve the minutes of the July 1, 2021 regular meeting as amended.  Motion carried.

Discussion held on joint zoning with Minnehaha County.  Bryan Read presented information explaining the process of establishing a joint zoning district with Minnehaha County.  Commissioner Heidbrink moved Commissioner Thiele seconded to recommend to City Council to pursue this joint venture.  Motion carried.

Discussion held on changes to Ordinance Chapter #15-14-3 (7)(b).  Patrick Andrews, SECOG, was present for discussion.  Should this be expanded to include R-3, LI and HI zoning districts?  It was the consensus of the Commission to schedule a public hearing with the changes discussed.

Discussion held on changes to R-2 and R-3 residential districts as it relates to allowing 0’ setbacks on properties that are individually platted, with the common area around the structure platted in a separate lot.  Patrick Andrews, SECOG, was present for discussion.  Commissioner Heidbrink mentioned some definitions that need to be updated.  An updated draft will be presented at the next meeting.

At 7:11 p.m., having no further business, Commissioner Heidbrink moved Commissioner Thiele seconded to adjourn the Planning & Zoning Commission meeting.  Motion carried.

PUBLIC COMMENT:  John Cunningham, 4904 S. Oxbow, Sioux Falls, SD, asked what amount of the $4.18 million Relief for the Poor 2022 budget item is related to health care.  Commissioner Karsky directed Lori Montis, Assistant Human Services Director, to provide Mr. Cunningham with the information requested.

Scott Wick, CEO Sioux Empire Fair Association, thanked the County for their quick response in repairing the Expo roof and addressing the water supply issues. He briefed the commission on this year’s events. 

REGULAR BUSINESS 

Upon the request of Steve Groen, Highway Superintendent, MOTION by Bender, seconded by Heiberger, to authorize chair to sign a 12-month lease agreement between Minnehaha County and Four Fat Guys, LLC for fleet truck storage during the construction of the new Highway Shop. 4 Ayes. Commissioner Bender was not present for the vote.

Upon the request of Steve Groen, Highway Superintendent, MOTION by Beninga, seconded by Barth, to authorize chair to sign an agreement to participate in the 2021 SDDOT County Pavement Striping Program.  5 Ayes

Jacob Maras, Sr. Project Engineer, Highway Department, introduced the Highway Department’s new Engineering Specialist, Aaron Wohlwend. Jacob introduced Anthony Peters and Noah Semansky, summer interns for the Highway Department.  The interns gave a presentation on a Culvert Data Collection Project that is performed every three years for the county.  This project collects data to update the condition of the culverts so replacement decisions can be made. 

Ben Kyte, Auditor, briefed the commission on the Upcoming Tax Deed Sale. Currently 11 properties are slated to be auctioned off on September 25, 2021.  These properties are four or more years behind on property taxes.

Lori Montis, Assistant Director Human Services, briefed the commission on the NACo Housing & Health Action Learning Cohort.  The period of the cohort was from October 2019 to July 2020, but was extended with Covid-19 in 2020 and the final cohort call took place in April 2021.  The focus was to support counties in exploring and understanding the impact of stable, affordable housing on health outcomes. 

Melinda Storley, Commission Assistant, presented an application to discharge fireworks at Huset’s Speedway on August 22, 2021, submitted by Mike Denning, Fireworz Store. MOTION by Barth, and seconded by Heiberger, to approve the application.  Pursuant to SDCL 34-37-14 and 34-37-13.1, South Dakota counties have the statutory authority to issue permits for the use of “display firework” and “consumer firework” at public and private events. 

Upon the request of Carol Muller, Commission Administrative Officer, MOTION by Barth, seconded by Bender, to authorize the chair to sign Reaffirmation and the 2nd Amendment to the Tegra contract for the Administration and Extension Building remodel.  The 2nd amendment adds a 16-month time extension at $17,250 per month to the initial phase of 7 months at $15,500 for a total of $384,500 for Tegra consultation services for ownership representation.

Commissioner Barth commented on the City of Brandon’s desire to look into a joint jurisdiction with Minnehaha County. He also mentioned an appeal being filed after the lime storage was approved for a 5-year continuing plan at a property along Highway 115. 

Chairmen Karsky briefed on a meeting with The Link Board and their search being narrowed to two final candidates for the Executive Director position. He also stated that the first sixty days of operation of the Link appears to be successful.

Tuesday, July 20, 2021

The annual meeting of East Dakota Educational Cooperative was called to order at 5:09 p.m. on Tuesday, 

July 20, 2021, via Zoom by President Renee Ullom. Members present were Renee Ullom, Lexy Klinkhammer ,and Scott Sandal, all by Zoom.  Members of administration present were Joan Frevik, Lisa Bjorneberg, and Dave Vander Grift, all by Zoom.

Motion by Sandal, seconded by Klinkhammer to approve the agenda as presented  On a roll call vote, the following voted aye:  Sandal, Klinkhammer, and Ullom.  Voting nay: none.  Motion carried.

Motion by Sandal, seconded by Klinkhammer to approve the June 15, 2021, board meeting minutes as published.  On a roll call vote, the following voted aye:  Sandal, Klinkhammer, and Ullom.  Voting nay: none.  Motion carried.

President Ullom asked for Conflict of Interest Disclosures.  None were presented.

Joan Frevik gave an update on administrative matters.

Board members (and alternates) for the upcoming year include Lexy Klinkhammer (Paula Hawks) from West Central, Scott Sandal (Clayton Wulf) from Lennox, Renee Ullom (Ellie Saxer) from Brandon Valley, and Gordon Sweeter (Annie First) from the East Dakota Foundation.

Director Frevik assumed the gavel and opened for nominations for Board President. Motion by Sandal, second by Klinkhammer to nominate Renee Ullom. Motion by Sandal, second by Kinkhammer that nominations cease. On a roll call vote, the following voted aye: Sandal, Larson, and Ullom. Voting nay: none. Motion carried.

The consent agenda addressed the following items:  

Board meetings will be held the third Tuesday of each month at 5:00 PM at East Dakota Educational Cooperative. The Official Newspaper will be the Brandon Valley Journal. The Official Depository will be the First National Bank of Sioux Falls. The Business Manager will be Dave Vander Grift. The substitute teacher rate will be $17.00 per hour. The resolution for withholding benefits. The cost per page of records requested by parents will be $0. The Civil Rights/Equal Employment Opportunity Officer will be Lisa Bjorneberg. Lisa Bjorneberg will be designated as Title IX Coordinator.  Authorization to invest funds in the South Dakota Public Funds Investment Trust for the general fund. The Federal Programs Authorized Representative will be Dave Vander Grift. Authorize the business manager to pay utilities, credit cards, leases, fiscal agent stipends and other expenses, and other bills as needed when due dates are prior to board meetings. Authorize Dave Vander Grift, the Board President, and Vice President as authorized signers on bank accounts. Authorize Dave Vander Grift, Joan Frevik, and Board President as authorized signers on contracts and agreements. Authorize Dave Vander Grift to sign revenue agreements with South Dakota State departments for renewing ongoing projects as needed prior to board meeting. Set reimbursement rates for staff use of personal vehicles and per diem meals. Set school nutrition meal rates at @2.50 (30 cents reduced) and $4.35 (40 cents reduced). 

June payroll report: $346,536.24 Salaries expense; $24,710.74 FICA/Medicare expense; and $55,343.70 Benefits Expense, for a total payroll of $426,587.68.

Motion by Sandal, seconded by Klinkhammer to approve the adjustment to the Fiscal Year 2021 budget.  On a roll call vote, the following voted aye:  Sandal, Klinkhammer, and Ullom.  Voting nay: none.  Motion carried.

The board entered executive session at 5:29 PM and exited at 5:34 PM.  Motion by Klinkhammer, seconded by Sandal to carry ten annual leave days earned in fiscal year 2021 into fiscal year 2022 for the Director.  On a roll call vote, the following voted aye:  Sandal, Klinkhammer, and Ullom.  Voting nay: none.  Motion carried.
