CALL TO ORDER
The Commissioners of the City of Valley Springs met in regular session on Tuesday, June 9, 2020 at 6:00 PM in the VS American Legion. Due to COVID-19, audience members and commissioners were required to practice social distancing within the legion meeting room. Mayor Carl Moss presided. Answering roll call were Commissioners Lance Bauske, Dean Helgeson, Brian Staeffler and Lynn Schmidt. Also present was City Maintenance Ryan Nussbaum, Finance Officer Linda Hunnel, City Attorney Patrick Glover, City Engineer Gabe Laber and Jamie Hult from the Brandon Valley Journal.
Motion by Bauske to approve the June 9, 2020 Posted Agenda. Schmidt seconded the motion. Motion carried, all voting aye.
APPROVAL OF MINUTES
Motion by Helgeson to approve the May 12, 2020 Minutes as presented.
Staeffler seconded the motion. Motion carried, all voting aye.
CLAIMS AND PAYROLL
Motion by Bauske to approve the June 9, 2020 Claims in the amount of $25,235.96. Helgeson seconded the motion. Motion carried, all voting aye.
MONTHLY FINANCIAL REPORTS
The Commission reviewed the May Proof of Cash Report and the May YTD Budget Report, as submitted by the Finance Officer. Motion by Staeffler, second by Bauske, to approve the May 2020 Proof of Cash Report. Motion carried, all voting aye. Motion by Staeffler, second by Helgeson, to approve the May YTD Budget Report. Motion carried, all voting aye.
PUBLIC COMMENT
There was no one present for open public speaking.
CITY ENGINEER
City Engineer Gabe Laber of HDR presented the Commission with the May 19th Water Tower Coating bid opening numbers. Bids ranged from $298,650 to $406,100. Laber recommended accepting the lowest bid of $298,650 from Viking Industrial Painting. Staeffler made a motion to approve the low bid of $298,650 from Viking Industrial Painting, contingent on funding agency approval. Schmidt seconded the motion. Motion carried, all voting aye.
NEW BUSINESS
City Attorney Patrick Glover clarified the language in the funding resolutions concerning surcharges, loan agreements, revenue bonding and pledging project revenues.
Resolution 2020-06 Drinking Water SRF Loan Approval for Public Improvements
Bauske made a motion to approve Resolution 2020-06. Helgeson seconded the motion. Motion carried, all voting aye.
Resolution 2020-07 Clean Water SRF Loan Approval for Public Improvements
Staeffler made a motion to approve Resolution 2020-07. Bauske seconded the motion. Motion carried, all voting aye.
Resolution 2020-08 Water\Sewer Rates and Surcharges
The Commission discussed the amount of surcharges needed to repay loans for the upcoming water and sewer improvement projects. The project is estimated to cost $3,382,000, with construction starting in 2021. Staeffler made a motion to approve Resolution 2020-08. There will be no monthly rate charge increase; however, there will be a $19 monthly water surcharge and a $5 monthly sewer surcharge implemented to repay water\sewer improvement construction loans. These monthly surcharges will take effect on the October 2020 billing. Bauske seconded the motion. Motion carried, all voting aye.
TAP Funding-Shared Use Path Application-Letter of Intent.
This item was tabled until the July 14 regular monthly meeting as information was not available by meeting time.
Employee Health\Life Insurance Change
Due to an upcoming increase in health insurance premiums from the current provider, Finance Officer Hunnel presented the commission with lower rate price information from another provider. Helgeson made a motion to change the health and life insurance provider to the Health Pool of South Dakota, Plan B Medical and $50K Life. Bauske seconded the motion. Motion carried, all voting aye.
2020-2021 MUNICIPAL APPOINTMENTS
Motion by Helgeson, second by Schmidt, to approve First National Bank of Sioux Falls as the City of Valley Springs’ Financial Institution. Motion carried, all voting aye.
Motion by Staeffler, second by Helgeson, to approve Patrick Glover of Meierhenry Sargent as the City of Valley Springs’ City Attorney. Motion carried, all voting aye.
Motion by Helgeson, second by Schmidt, to approve Commissioner Brian Staeffler as the City of Valley Springs’ Acting Mayor in the event that Mayor Moss is absent. Motion carried, all voting aye.
Motion by Staeffler, second by Helgeson, to approve Lance Bauske as the City of Valley Springs’ Commissioner of Public Works. Motion carried, all voting aye.
Motion by Bauske, second by Staeffler, to approve Dean Helgeson as the City of Valley Springs’ Commissioner of Public Utilities. Motion carried, all voting aye.
Motion by Helgeson, second by Bauske, to approve Lynn Schmidt as the City of Valley Springs’ Commissioner of Finance and Revenue. Motion carried, all voting aye.
Motion by Bauske, second by Schmidt, to approve Brian Staeffler as the City of Valley Springs’ Commissioner of Public Safety. Motion carried, all voting aye.
OLD BUSINESS

PUBLIC WORKS REPORT
City Maintenance Employee Ryan Nussbaum gave the June 9, 2020 Maintenance Report. Nussbaum reported that the four trees donated by the Community Club and the Tim Hanson memorial tree donated by Shannon Hansen have been planted in the park. Special thanks to the Community Club and Shannon Hansen for the donation of these trees. Nussbaum presented the commission with creek drain tile prices. After much discussion this issue was tabled until the July 14th meeting. Nussbaum is awaiting a bid for sidewalk repair in front of City Hall.
FINANCE OFFICER REPORT
FO Hunnel reported that the 2017-2018 Municipal Audit is underway. JULY 4th FIREWORKS-Municipal Ordinance states fireworks are permitted July 4th from 10am to 11pm. Hunnel has sent out numerous code enforcement letters concerning pools without fences and failure to mow. Hunnel also asked City Attorney Glover if a home occupation permit or a conditional use was needed for daycares. It was Glover’s opinion that a home occupation permit was needed for an in-home daycare.
COMMISSION REPORTS
Staeffler said that summer swimming lessons had been cancelled due to COVID-19. The Commission had discussed implementing a front footage or property maintenance fee to generate funding for street repairs and maintenance in the past. The issue was revisited and an annual fee of $100 per parcel was decided upon. Hunnel will have a resolution drafted according to SDCL 9-43-138, Special Maintenance Fee, at the July meeting. Mayor Moss and Commission discussed various code enforcement violations throughout the city and instructed Hunnel to send letters. The Minnehaha County Sheriff will be contacted to perform their yearly report on unlicensed vehicles.
