Notice of Mayor Vacancy
The City of Brandon has a vacancy on the Brandon City Council for Mayor.  Interested Brandon residents must be a registered voter in the City of Brandon and need to submit a completed Expression of Interest Form by 4:30pm on Friday March 26, 2021.  Forms can be obtained at City Hall, 304 S Main Ave or on the City’s website at www.cityofbrandon.org.  It is anticipated that the Brandon City Council will consider an appointment to fill the vacancy during their regular meeting on April 5, 2021.  The appointment will expire on May 2, 2022 at which time the remaining one-year term will be filled by the individual elected at the Municipal Election on April 12, 2022.

NOTICE IS HEREBY GIVEN that the governing body, sitting as a Review Board of Equalization for the City of Brandon, Minnehaha County, South Dakota, will meet at 6:00 p.m. at the Brandon City Council Chambers at 308 S Main Avenue, on Tuesday, March 16, 2021 for the purpose of reviewing and correcting the assessment of the City of Brandon for the year 2021.

Voter registration for the City of Brandon Municipal Election to be held on April 13, 2021, will close on March 29, 2021 at 5:00 p.m. Failure to register by this date will cause forfeiture of voting rights for this election. If you are in doubt about whether you are registered, check the Voter Information Portal at www.sdsos.gov or call the county auditor at (605)367-4220.
Registration may be completed during regular business hours at the county auditor’s office, municipal finance office, secretary of state’s office, and those locations which provide driver’s licenses, SNAP, TANF, WIC, military recruitment, and assistance to the disabled as provided by the Department of Human Services. The Brandon City Council met in a briefing session at 5:30 p.m. on Thursday, February 25, 2021 at the Council Chambers at 308 S Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Barb Fish, David Kull and Jack Parliament.  Others present were: City Administrator, Bryan H Read; Finance Officer, Christina Smith; City Engineer, Tami Jansma; Public Works Director, Rollie Hoeke; Interim Police Chief, Jamie Steffel; Park Superintendent, Devin Coughlin; Golf Course Manager; Andrew Bauer; and Fire Chief, Robert Dykstra.  Absent: Vickie David and Tim Jorgenson.
The Council discussed items on the agenda for the upcoming March 1, 2021 regular Council meeting.  No formal action was taken. 
At 6:27 p.m., hearing no further business, the meeting adjourned.

PLANNING & ZONING COMMISSION
The Brandon Planning & Zoning Commission met in regular session at 6:30 p.m. on February 18, 2021 at the Brandon City Council Chambers. 
Roll call was taken.  Members present were Commissioners Brian Heidbrink, Brookes Noem, Chuck Parsons, Rob Schoeneman, Jim Starzl and Alica Thiele.  Also present were Alderman Tim Jorgenson, City Administrator Bryan Read and City Engineer Tami Jansma.  Absent were Building Official Paul Clarke and Mayor Paul Lundberg.
Commissioner Heidbrink moved Commissioner Parsons seconded to approve the agenda as amended, removing item 3 from the consent calendar for discussion.  Motion carried.
Commissioner Parsons moved Commissioner Heidbrink seconded to approve the following items from the consent calendar: a plat of Alliance Plaza 2nd Addition Lots 1A & 2A and a plat of Aspen Park Addition Tract 1.  Motion carried.
Discussion held on the plat presented for Brandon 90 Plaza Addition Tract A & Lot 2 Block 2.  Commissioner Heidbrink had concerns with Lot 2 Block 2 being landlocked, with no road access.  Commissioner Heidbrink moved Commissioner Parsons seconded to approve the plat as presented.  Motion carried.
Commissioner Thiele moved Commissioner Starzl seconded to approve the minutes of the February 4, 2021 regular meeting as amended.  Motion carried.
A Re-Zone Application was presented for Brandon 90 Plaza Addition.  Darrel Viereck, developer, was present for discussion.  Darrel reviewed the project, and reviewed minor changes to the concept plan as far as some lot sizes and access points.  Darrel hosted a neighborhood meeting on Wednesday, February 17, 2021.  Steven Westhoff, 1600 E. Liberty Circle, was present.  Steven had concerns regarding Birch Street being extended into this new development.  Neighbors would like to see used as a one-way street into the development, and for emergency access only.  Pat Schwebach, JSA Engineers, civil engineer for the project, was present for discussion.  Pat stated that fire code requires a secondary access into this development.  Steven and neighbors abutting the development asked for adequate screening between the residential and commercial zoned properties.  Scott Vogelsong, 1520 E. Liberty Circle, was present.  Scott suggested the access into this new development, off Birch Street, have a gate and key to be used by emergency personnel.  Chris Bergst, 1513 E. Birch Street, was present.  Chris had concerns with the sidewalks not being finished in the French Creek Subdivision and no place for kids to safely walk.  Commissioner Parsons moved Commissioner Thiele seconded to approve the Re-Zone Application as presented and made recommendation to City Council for approval.  Motion carried.
A Re-Zone Application was presented for 917 S. Aspen Park Road, Aspen Park.  The City of Brandon is requesting to re-zone Aspen Park to IN-Institutional District.  Commissioner Parsons moved Commissioner Thiele seconded to approve the Re-Zone Application as presented and made recommendation to City Council for approval.  Motion carried.
An annexation request was received from the City of Brandon for Tract 1 of Lift Station Addition (1028 E. Birch Street).  This lot needs to be annexed into the City as part of the Brandon 90 Plaza development.  Commissioner Thiele moved Commissioner Noem seconded to approve the annexation as requested.  Motion carried.  
At 7:15 p.m., having no further business, Commissioner Parsons moved Commissioner Starzl seconded to adjourn the Planning & Zoning Commission meeting.  Motion carried.

Yannick Laroche, 101 S. Main Avenue, Sioux Falls, SD was present for discussion.  Yannick was representing Marmen Energy and was present to discuss their excitement with the railroad crossing repairs scheduled for the Corson Industrial Park crossing.  
Chuck Parsons, 600 N. Yellowstone Drive, Brandon was present for discussion.  Chuck is the Chair of the Brandon Development Foundation.  Chuck was present to discuss the proposed railroad crossing repairs for the Corson Industrial Park, and recommended City Council approve the bid received.
Perry Schneekloth, 808 E. Heatherwood Drive, was present for discussion.  Perry was present representing the BV Hockey Association and expressed their support for the repairs scheduled for Aspen Park Road.  
Alderman Parliament discussed closing the Corson railroad crossing completely, not just one lane, for the repair work.  Yannick Laroche, representing Marmen Energy, discussed that leaving one lane open during the repair process would be better for their business.

Glenwood Drive, was present for discussion.  Tanya was present to express her concerns with idea/discussion of possibly disbanding the police department.  Tanya expressed her support of the police department and asked if anything is considered that it be taken to a public vote.

HIRE POLICE DETECTIVE
Interim Police Chief, Lt. Jamie Steffel, was present for discussion.  Lt. Steffel made recommendation to City Council that Officer Micah Henning be promoted to the position of Detective.  Alderwoman Clark moved Alderman Kull seconded to approve the promotion of Officer Micah Henning to Detective, at a wage of $27.05 per hour.  Motion carried.
LIST OF APPROVED TREE SPECIES FOR PLANTING IN STREET RIGHT OF WAY
The Golf Course Committee and Parks & Recreation Committee reports were heard.  Park Superintendent, Devin Coughlin, was present for discussion.  The Park Advisory Committee met and has made recommendation to City Council for the approval of the updated tree species for planting in the street right of way.  Alderman Kull moved Alderwoman Clark seconded to approve the updated tree species list, as presented.  Motion carried.
ASPEN PARK ROAD ADVERTISEMENT FOR BIDS
Tami Jansma, City Engineer, presented information pertaining to advertising for bids for the Aspen Park roadway and utility improvements project, estimated cost of $474,000.00.  Alderwoman Fish moved Alderman Jorgenson seconded to approve staff to advertise for bids, as presented.  Motion carried.
AGREEMENT WITH SWIM AMERICA TO USE OF POOL
Alderwoman Fish moved Alderwoman Clark seconded to approve the agreement with Swim America to use the pool between 11:45am-12:55pm for the 2021 summer months, as presented..  Motion carried.
Fire Chief, Robert Dykstra was present to give an update on the Brandon Volunteer Fire Department.
EXPLORE MINNEHAHA COUNTY TO PROVIDE LAW ENFORCEMENT SERVICES
The Public Safety Committee report was heard.  Alderman Jorgenson moved Alderwoman Fish seconded to explore Minnehaha County to provide law enforcement services to the City of Brandon.  Alderman Jorgenson discussed the capital improvement needs for the City of Brandon, at a value of $200 million, and the need to decrease spending.  Alderwoman Clark discussed communication on this topic and how it created unneeded anxiety for the residents through social media.  Alderwoman David thanked the residents who were in attendance and those who reached out to Council members directly.  Alderwoman David went on to discuss how the police department has been underpaid, recently lost their Police Chief and currently operate in a substandard police station.  Alderman Parliament discussed the need for cutting costs, but not at the expense of public safety.  Alderman Kull expressed his support and continued need for the Brandon Police Department.  City Administrator, Bryan Read, explained that this was placed on the agenda at the request of two City Council members and did not come from staff.  A roll call vote showed Fish, Jorgenson aye; Clark, David, Jorgenson, Parliament nay.  Motion failed.
RESIGNATION OF MAYOR LUNDBERG
The Administration Committee report was heard.  City Administrator, Bryan Read, discussed the timeline for appointing a new Mayor.  Alderman Kull moved Alderwoman Clark seconded to accept the resignation of Mayor Lundberg, effective immediately.  Motion carried.

RESOLUTION ANNEXING CERTAIN PROPERTY IN SECTION 26-102N-48W TO THE CITY OF BRANDON, SOUTH DAKOTA
WHEREAS, the City of Brandon, South Dakota has authority under SDCL 9-4-1 to annex territory on a petition filed by three-fourths of the registered voters or landowners in the area to be annexed; and
WHEREAS, one hundred percent of the owners of the property described as:  Tract One of Lift Station Addition In The NW1/4 SW1/4 Of Section 26, Township 102 North, Range 48 West Of The 5th Principal Meridian, Minnehaha County, South Dakota; and
WHEREAS, the above described property is contiguous to the City of Brandon; and
WHEREAS, the Brandon Planning and Zoning Commission reviewed the petition during their regular meeting on February 18, 2021 and has recommended that this property, as described, be annexed into the City of Brandon.
BE IT RESOLVED that the following described property be annexed and included in the boundaries of the City of Brandon, South Dakota:

WHEREAS, SDCL 9-14-28 requires that the governing body of every municipality shall fix and determine by ordinance or resolution, the amount of salaries and compensation of all municipal officers and the time at which the same shall be paid; and
WHEREAS, the City council shall publish the salaries for compliance with the provisions of SDCL 9-14-28 and SDCL 6-1-10
WHEREAS, the City Council approved a new pay plan structure on February 16, 2021.
THEREFORE, BE IT RESOLVED by the Brandon City Council that the following resolution is effective March 1, 2021.
FURTHER, BE IT RESOLVED by the Brandon City Council that the following resolution, repealing all prior salary and wage resolutions of the employees listed, be passed and approved. Employees shall be paid every two weeks at the following yearly salary or hourly wage for the remaining of the year 2021.

PRELIMINARY 2022-2026 CAPITAL IMPROVEMENTS PLAN
A draft Capital Improvements Plan was presented.  Will hold another CIP work session on Thursday, March 11, 2021 after the 5:30 p.m. briefing meeting.
VFW RAFFLE
A request was received from VFW Three Rivers Post 4726 to hold a raffle for a gun safe, March 1, 2021 to May 2, 2021.  Hearing no opposition, no further action required.
CORSON RAILROAD CROSSING QUOTE
The Streets Committee report was heard.  Alderman Jorgenson moved Alderwoman Clark seconded to approve the base bid proposal from Soukup Construction, in the amount of $71,170.00, for the Corson railroad crossing improvements/repair project.  Motion carried.
GEOTEK CONTRACT FOR RUSHMORE AREA PROJECT
Alderwoman Clark moved Alderman Jorgenson seconded to approve the contract with GeoTek for the Rushmore Area Reconstruction Project Phase 1 materials testing in the amount not to exceed $18,975.00.  Motion carried.
MAIN AVENUE INTERCEPTOR CHANGE ORDER
The Water & Sewer Committee report was heard.  Alderman Kull moved Alderwoman Clark seconded to approve change order #7 to H&W Contracting in the amount of ($122,016.70) for the Main Avenue interceptor project.  Motion carried.
MAIN AVENUE INTERCEPTOR PAY APPLICATION & FINAL
Alderwoman Clark moved Alderman Jorgenson seconded to approve pay application #7 and final to H&W Contracting in the amount of $636,240.09 for the Main Avenue interceptor project.  Motion carried.
At 7:35 p.m. on a motion by Alderwoman Clark seconded by Alderwoman David the meeting was adjourned.
