The Brandon City Council met in regular session at 6:00 p.m. on March 21, 2022 in the Council Chambers at 308 S. Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Vickie David, Barb Fish, Tim Jorgenson, David Kull, Jack Parliament and Mayor Jim Heinitz.  Others present were:  City Administrator, Bryan Read; Finance Officer, Christina Smith;  City Attorney, Lisa Marso; City Engineer, Tami Jansma;  Police Chief, Jamie Steffel; Park Superintendent, Devin Coughlin; Golf Course Manager, Andrew Bauer and Public Works Director, Rollie Hoeke.

Alderwoman Clark moved Alderwoman David seconded to approve the agenda, as amended.  Motion carried.

Alderwoman Fish moved Alderwoman Clark seconded to approve the minutes of the March 3, 2022 briefing meeting and the minutes of the March 7, 2022 regular meeting.  Motion carried.

Alderman Jorgenson moved Alderman Kull seconded to approve the consent calendar which contained the following items:  a plat of Aspen Harbor Addition Lots 8, 19 & 20 Block 2; a plat of Heartland Business Park Addition Lot 1A Block 2; a plat of Rovang Industrial Park Lot 2 Block 1 and a plat of Twin Rivers Crossing Addition Lots 4, 5, 6 & 17 Block 4 and Lot 1 Block 5 and Drainage Tract 1.  Motion carried.

SEASONAL STAFF

The Golf Course Committee report was heard.  Alderwoman Clark moved Alderwoman David seconded to approve the hiring of the following seasonal staff for the Golf Course.  Motion carried.

  Community Room Bussers: Michael Hurney, $12.00 per hour; Keegan Jorgenson,      $12.00 per hour; Cael Weber, $12.00 per hour; Abby Gruber, $12.00      per hour

  Lounge Bartender: Jenny Christian, $7.95 per hour; Matt Hurney, $7.95 per hour

RETAINING WALL SCHEDULE TO REBID

A bid schedule was presented to rebid the golf course retaining wall project.  No action required.  

ART PROJECT AT VETERANS MEMORIAL

The Parks & Recreation Committee report was heard.  Alderwoman Fish moved Alderwoman Clark seconded approve the art project at the Veterans Memorial, as presented.  Motion carried. 

BRANDON WELLNESS REQUEST FOR SUPPORT

Alderwoman Fish moved Alderwoman Clark seconded to support the Brandon Wellness in their efforts to explore the potential to build a community wellness center in Brandon.  Motion carried.

TALLGRASS PARK PLAY STRUCTURE BID

Alderwoman Fish moved Alderman Parliament seconded to approve the quote from Churchich Recreation in the amount of $270,961.49 for the purchase of a new play structure at Tallgrass Park.  Motion carried.

SALARY REVIEW AND ADJUSTMENT

Alderwoman Fish moved Alderwoman Clark seconded to approve the annual salary adjustment for Devin Coughlin, to step 14-10 on the wage scale, $31.95 per hour, effective April 4, 2022.  Motion carried.

SALARY REVIEW AND ADJUSTMENT

The Public Safety Committee report was heard.  Alderwoman Clark moved Alderman Kull seconded to approve the annual salary adjustment for Tyler Carda, to step 13-12 on the wage scale, $31.14 per hour, effective March 22, 2022.  Motion carried.

2021 AUDIT REPORT

The Administration Committee report was heard.  Christina Smith, Finance Officer, presented the 2021 Annual Report.  Alderwoman Fish moved Alderman Parliament seconded to approve the 2021 Annual Report, as presented.  Motion carried.

ENCORE PARK DEVELOPMENT AGREEMENT

Alderwoman Clark moved Alderman Jorgenson seconded to approve the agreement between The City of Brandon, SD and Encore Park concerning the Tax Increment District #7.  Motion carried.

REQUEST TO AMEND CHAPTER 2-3-2 ON-SALE OR OFF-SALE LICENSES

A request was received to consider amending Ordinance Chapter 2-3-2 as it relates to the distance between on-sale and off-sale alcohol licenses to churches and schools.  Julie Lanoue, Market Coordinator for the Brandon Farmers Market, was present via conference call.  The Brandon Farmers Market is requesting the amendment to the Ordinance.  Current Ordinance requires 100 yards to any door or exit of a church and school to an establishment that sells alcohol either on-sale or off-sale.  Alderman Kull moved Alderman Jorgenson seconded to direct staff to develop a draft ordinance of this change to be presented at a future meeting.  A roll call vote showed Fish, Jorgenson, Kull aye; Clark, David, Parliament nay.  Mayor Heinitz voted aye.  Motion carried.

ENGAGEMENT LETTER WITH DA DAVIDSON FOR CORE PHASE 2A FINANCING

Alderman Parliament moved Alderman Jorgenson seconded to approve the underwriting engagement letter with DA Davidson for the Core Phase 2A project, as presented.  Motion carried.

RESIGNATION OF EMPLOYEE

The Streets Committee report was heard.  Alderwoman Clark moved Alderman Jorgenson seconded to approve the resignation letter from Michael Dorenkamper, effective March 20, 2022.  Motion carried.

CORE AREA PHASE 2A CONSTRUCTION ADMIN CONTRACT

Alderman Jorgenson moved Alderman Parliament seconded to approve the construction administration contract for the Core Area Reconstruction Project – Phase 2A with HDR for $414,935.00.  Motion carried.

DRAFT CHAPTER 1 – ENGINEERING DESIGN STANDARDS

The last time the Engineering Design Standards were updated was January 2013.  Tami Jansma, Brandon City Engineer, is in the processing of updating all 20 Chapters.  A draft was presented revising Chapter 1 – Engineering Design Standards.  No action required at this time.

WESTSIDE SANITARY SEWER PROJECT

The Water & Sewer Committee report was heard.  Alderman Jorgenson moved Alderman Kull seconded to approve the West Side Trunk Sewer construction administration contract with DGR Engineers in the amount of $311,500.00.  Motion carried.

PURCHASE AGREEMENT WITH GREAT BEAR SAND & GRAVEL

Alderman Jorgenson moved Alderman Kull seconded to approve the purchase agreement with Great Bear Sand & Gravel in the amount of $164,924.00 for the land acquisition costs for the West Side Sanitary Sewer Extension Project.  Motion carried.

WATER TOWER PROJECT PAY APPLICATION

Alderwoman Clark moved Alderman Parliament seconded to approve pay application #9 to AB Contracting, LLC. in the amount of $236,381.78 for the water tower project.  Motion carried.

WATER TOWER PROJECT PLAQUE

Alderwoman Clark moved Alderman Parliament seconded to approve the installation of a plaque on the new water tower.  Motion carried.

FRENCH CREEK GENERATOR QUOTE

Alderwoman David moved Alderwoman Clark seconded to approve the purchase of a generator for the French Creek lift station in the amount of $31,675.00 from IState Power Systems.  Motion carried.

Dana Clark mentioned the possibility of adding the Planning & Zoning Commission meeting recordings on the City website, similar to City Council meetings.  Staff will look into this and present information at a future City Council meeting.

At 6:58 p.m. on a motion by Alderwoman Clark seconded by Alderwoman David the meeting was adjourned.  Motion carried.

The Brandon City Council, acting as a Local Board of Equalization, met at 6:00 p.m. on Tuesday, March 22, 2022 in the Council Chambers at 308 S Main Avenue, Brandon, South Dakota.  Present were Dana Clark, Vickie David, Barb Fish, Tim Jorgenson, David Kull, Jack Parliament and Mayor Jim Heinitz.   Also present was Ellie Saxer representing the School Board.  Others in attendance were Bryan Read, City Administrator and Christina Smith, Municipal Finance Officer.  Absent:  None.

THE MINNEHAHA COUNTY BUILDING COMMITTEE CONVENED AT 8:00 A.M. March 22, 2022, pursuant to adjournment on February 1, 2022. Committee Members present were: Commissioners Barth, Bender, Beninga, Heiberger, and Karsky; Facilities Director Kriens, and Auditor Kyte. Also present were Kym Christiansen, Commission Recorder, and Eric Bogue, Chief Civil Deputy State’s Attorney.

MOTION by Barth, seconded by Beninga, to approve the February 1, 2022, Building Committee Meeting Minutes. 6 ayes.

FAIRGROUNDS TASK FORCE

Tyler Klatt, Assistant Commission Administrative Officer, presented a briefing on the formation of a task force for the review and establishment of a vision for the William H. Lyon Fair Grounds. There was a total of 67 applications for the task force and it is anticipated that the Commission will appoint the task force members in April during a Commission meeting. Discussion involving the following topics was held: communication to those selected for the task force as well as contract with the consultant. SUMMIT CARBON SOLUTION PIPELINE

   Tyler Klatt, Assistant Commission Administrative Officer, presented a briefing regarding the consideration of communication to the South Dakota Public Utilities Commission concerning the proposed Summit Carbon Solutions Pipeline. During the March 15 Commission Meeting, citizens provided their concerns regarding the proposed Summit Carbon Solutions Pipeline. The County Commissioners had asked the Commission Office to draft a letter to the Public Utilities Commission that related those concerns expressed by Minnehaha County residents. Eric Bogue, Chief Civil Deputy State’s Attorney, briefed the Commission regarding the draft letter to the South Dakota Public Utilities Commission and an upcoming meeting of that body that will held in Sioux Falls on March 23, 2022, and the potential to incorporate the comments received at that meeting into the draft letter. The Commission requested that staff revise the letter to the Public Utilities Commission to include any new concerns raised at that meeting. In addition, all comments which have been submitted to the Commission office will be included with the letter. Eric Bogue noted that there would be sufficient time to send a letter to the South Dakota Public Utilities Commission following the April 5, 2022, meeting and still be within the public comment period. Dan Lederman, Dakota Dunes, presented an update on the pipeline from Summit Carbon Solutions and the ability to bring in experts if requested by the Minnehaha County Commissioners. Mr. Lederman also informed the Commission that the pipeline will pay some property tax based on the project footprint and the project will not be involved in fracking. Peggy Hoogstraat, Chandellor, presented a picture from 2020 showing work being done on the pipeline going through her property and stated that one of the PUC Commissioners is not participating and Governor Norem has submitted a new name. Joy Hohn, presented questions raised regarding the depth of the pipelines and the request for more shut off values on the pipeline, and asked the Commissioners to apply for party status with the Public Utilities Commission. MOTION by Barth, seconded by Karsky, to defer consideration of communication to the SD Public Utilities Commission concerning the proposed Summit Carbon Solutions Pipeline. 5 ayes.

   PRESENTATION 

Dr. Kenneth Snell, Coroner/Medical Examiner, presented on the Minnehaha County Coroner’s Office highlighting the following areas: 2021 case data, the causes of death, information related to infant deaths, examined natural deaths and accidental deaths along with the deaths related to drugs and suicide, and future needs, including the increase toxicology costs and transport costs. 

PLANNING & ZONING NOTICE 

   Kevin Hoekman, Planner, gave the first reading and requested authorization for the Auditor to publish a Notice of Hearing for April 19, 2022, to consider the adoption of the 2021 International Building Code, the 2021 International Residential Code, and the 2021 International Existing Building Code. MOTION by Karsky, seconded by Barth, to authorize the Auditor to publish a Notice of a Public Hearing at or after 9:00 a.m. on April 19, 2022, for the adoption of the 2021 International Building Code, 2021 International Residential Code, and the 2021 International Existing Building Code. 5 ayes.

 NON ROUNTINE PERSONNEL 

Carey Deaver, Human Resources Director, presented a request for approval for a new position in the Human Resources Office. The past long-range plans for Human Resources have reflected the need for a new position in 2023, but due to the growth of the county and the impact of COVID, the new position is needed in 2022. COVID related functions such as safety, policy development, leave and benefits management, and health plan impacts have required a significant time commitment over the past two years. The pandemic has also impacted the county’s employment trends. Minnehaha County is experiencing higher rates of turnover, which, in turn, requires more time for turnover processing and recruitment. There were 34 job postings for 2022 by the end of February. The process for recruitment has changed significantly over the past two years. We can no longer post a position announcement, review applications, and interviews. Due to a record low number of applicants, we must be more strategic in our advertising approach, including relying more heavily on social media and actively recruiting in areas throughout the United States. The recruitment functions for each vacancy absorb a higher portion of time. In addition to the previous issues, Human Resources has received requests for assistance in employee training, recognition, and development-areas which are critical for supporting a growing workforce, but which fall secondary to the more immediate need of filling positions. MOTION by Karsky, seconded by Barth, to approve new position in the Human Resources Office. 5 ayes.

Carey Deaver, Human Resource Director, presented a briefing about the creation of a new position in the Auditor’s Office. The request from Auditor Ben Kyte is to create a position for grant administration. The position would serve as the contact for departments that have submitted and received grants. The primary purpose would be to establish grant revenue and expense tracking to ensure sustainability and compliance with grant guidelines. In a briefing provided by Auditor Kyte, the Auditor’s Office has been impacted by the COVID-10 pandemic and the growth of county operations in multiple ways. Much of the impact has increased the employee work load to exceed the capacity of the office to maintain it long term. Examples of the increased responsibilities resulting from COVID-19 and growth in county services: increase management of grants and other external funding sources, financial control, and elections. MOTION by Barth, seconded by Beninga, to approve new position in the Auditor’s Office. 5 ayes.

For Proposal No. 4, the proposal invitation and form were ambiguous and led to an inconclusive result.   BRIEFING

   Daniel Haggar, State’s Attorney, gave a presentation on the State’s Attorney’s Office. The Minnehaha County State’s Attorney’s Office remains committed to public safety, community service, and equal justice under the law. The presentation highlighted the areas of staffing and caseload. Some key statistics for the Minnehaha County State’s Attorney’s Office for 2021 include jury trials-42; new cases opened-10,979; new entrants into Minnehaha County Specialty Courts-70; graduations from Minnehaha County Specialty Courts-29; juvenile team cases handled-1,644; total abuse and neglect cases-194 and total filed abuse and neglect cases-107; and successful juvenile diversions-344.  

   AGREEMENTS 

  Upon request of Tyler Klatt, Assistant Commission Administrative Officer, MOTION by Karsky, seconded by Beninga, to authorize Chair to sign the amendment for the professional legal services agreement for drug and alcohol involuntary commitments. 5 ayes.

EMPLOYEE COMPENSATION 

   Tyler Klatt, Assistant Commission Administrative Officer, presented a request for consideration for the authorization to adjust employee compensation and updates to the employee handbook. In order to provide quality service to the community is dependent upon our ability as an employer to attract and retain experienced staff. In order to attract and retain experienced staff, the County strives to offer a competitive compensation package while working within the limitations of funding sources and being careful stewards of tax payers’ dollars. The County has often struggled with recruiting candidates for key positions, and unfortunately, during the past year, this challenge has become more prevalent as we’ve experienced higher rates of employee turnover, increased difficulty in recruiting candidates for many positions, and wage growth which has lagged behind the cost of living. The following actions prioritize raising base wages and reducing turnover: 

1. Implement a new pay matrix which has two main changes: 1) Increase base wages by 7%, and 2) eliminate steps two and four in order to provide an accelerated increase for employees hire at range minimums.

2. Increase the night shift differential from $.50/hour to $1.00/hour

3. Increase on-call pay from $15/day to $20/day.

4. Reclassification of the following JDC positions-Juvenile Correctional Officer I from pay grade 12 to pay grade 13; Juvenile Correctional Officer II and the Juvenile Correctional Training and Compliance Officer from pay grade 14 to pay grade 16; Juvenile Correctional Officer III from pay grade 16 to pay grade 18.

MOTION by Beninga, seconded by Bender, to authorize the adjustments to the employee compensation plan and updates to the employee handbook. By roll call vote: 5 ayes.

CONTRACT 

   Carey Deaver, Human Resources Director, presented the updated contract with the Minnehaha County Deputies Association. The updated contract recognizes the critical need to address wages now, and will run through the end of 2025.  The major points of the contract are: Clarification for inclusion of Court Records Officer, addition of language for management to determine recruitment methods, adjustment to the pay matrix which includes a 7% increase effective April 2, 2022; removing steps 2 and 4; reclassify Correctional Officers and Court Records Officers from grade 13 to 14; employees promoting to Sergeant will be guaranteed a 15% salary increase.  Additional major points include the shift premium increase from fifty cents to $1.00 per hour; adding Juneteenth as a recognized holiday. The 2023 health insurance premium County share will be 75%, an increase of 5%; and the addition of annual mental health session for Jail Division. MOTION by Karsky, seconded by Beninga, to approve the Minnehaha County Deputies Association Contract. By roll call vote: 5 ayes.

  LIAISON REPORTS

  Commissioner Beninga reported on the beginning of the Juvenile Detention Center project.

Commissioner Heiberger reported on the one-day conference put on with the assistance of the Safety and Justice grant. 

Commissioner Karsky reported on the recent meeting of the Sioux Metro Growth Alliance.
